Ustavni sud objavio je odluku po kojoj država mora u roku od tri mjeseca isplatiti 50 tisuća kuna Dimitriju Škrpanu iz Srbca u BiH i to zbog zlostavljanja kojeg je kao civil pretrpio početkom kolovoza 1992. godine. Tada su ga, zbog sumnje da surađuje s neprijateljem, priveli pripadnici HV-a.

Sumnjalo se da Škrpan ima mali minobacač te je nakon privođenja u vojarnu u Novoj Gradišci 9. kolovoza bio psihički i fizički zlostavljan od strane više nepoznatih pripadnika HV-a, zbog čega je pokušao počiniti samoubojstvo. Komadom stakla više puta se ubo u trbuh, čime je ozlijedio želudac i jetru, a život mu je na kraju spašen zahvaljujući liječničkoj intervenciji.

Nedostatak dokaza

Škrpan je 15. ožujka 2010. podnio DORH-u zahtjev radi naknade štete zbog trajnog oštećenja zdravlja i stalnih fizičkih bolova, a oni su ga dostavili Županijskom državnom odvjetništvu Slavonski Brod koje je zatražilo izvide od policije. PU Brodsko-posavska potom, nakon izvida, podnosi kaznenu prijavu protiv A.B. zbog ratnog zočina protiv civila. Provodi se istraga i ŽDO Slavonski Brod odustaje od kaznenog progona protiv A.B. zbog - nedostatka dokaza.

Mešu ostalim, navode da se “radnje kojima se teretio osumnjičeni A. B. svode na udaranje šakama po cijelom tijelu te da je kod oštećenika kod prijema u bolnicu utvrđen “prijelom šestog i sedmog rebra s lijeve strane”.

U svibnju 2012. godine Škrpan podnosi optužnicu protiv A.B. kao oštećenik te se na sudu u Osijeku utvrđuje identitet još dvojice vojnih policajaca koji su ga priveli. Naposljetku, A.B. biva oslobođen, a Županijski sud u Osijeku u svom obrazloženju, među ostalim, navodi kako je “izvan svake sumnje je da je Dimitrije Škrpan zadobivao udarce po tijelu od strane većeg broja nepoznatih pripadnika oružanih snaga RH (...). Uobičajno bi u prostor u kojem je bio zatvoren dolazila po četvorica pripadnika oružanih snaga RH i naizmjenično su ga udarali nekoliko minuta”.

- S obzirom na nalaz i mišljenje vještaka psihijatra da se pokušaj suicida ne može dovesti u uzročno-posljedičnu vezu s psihofizičkim zlostavljanjem od strane A. B., a da je istovremeno stav suda da zadavanje nekoliko udaraca po tijelu oštećenika, od strane A. B., ne predstavlja onu kriminalnu količinu koja bi mogla dovesti do zaključka da je optuženik kršeći pravila međunarodnog prava za vrijeme oružanog sukoba nečovječno postupao prema civilnoj osobi - naveo je osječki sud.

Povreda Ustava

Vrhovni sud u studenom 2004. godine potvrđuje presudu. Ali, Škrpan ne odustaje i u siječnju 2015. podnosi prijavu protiv nepoznatog počinitelja.

U svojoj odluci Ustavni sud navodi i da je nedvojbeno da je postupanje koje je uključivalo tjelesno zlostavljanje “takvog oblika da ga je Županijski sud u Osijeku okarakterizirao kao ‘tortura’”.

- Ustavni sud primjećuje da je Županijski sud utvrdio da su podnositelja zlostavljali pripadnici Oružanih snaga RH... Ustavni sud nalazi da je zlostavljanjem došlo do povrede Ustava - navodi se u odluci koju potpisuje predsjednik vijeća dr. sc. Miroslav Šeparović.

Ustavni sud objavio je odluku po kojoj država mora u roku od tri mjeseca isplatiti 50 tisuća kuna Dimitriju Škrpanu iz Srbca u BiH i to zbog zlostavljanja kojeg je kao civil pretrpio početkom kolovoza 1992. godine. Tada su ga, zbog sumnje da surađuje s neprijateljem, priveli pripadnici HV-a.

Sumnjalo se da Škrpan ima mali minobacač te je nakon privođenja u vojarnu u Novoj Gradišci 9. kolovoza bio psihički i fizički zlostavljan od strane više nepoznatih pripadnika HV-a, zbog čega je pokušao počiniti samoubojstvo. Komadom stakla više puta se ubo u trbuh, čime je ozlijedio želudac i jetru, a život mu je na kraju spašen zahvaljujući liječničkoj intervenciji.

Nedostatak dokaza

Škrpan je 15. ožujka 2010. podnio DORH-u zahtjev radi naknade štete zbog trajnog oštećenja zdravlja i stalnih fizičkih bolova, a oni su ga dostavili Županijskom državnom odvjetništvu Slavonski Brod koje je zatražilo izvide od policije. PU Brodsko-posavska potom, nakon izvida, podnosi kaznenu prijavu protiv A.B. zbog ratnog zočina protiv civila. Provodi se istraga i ŽDO Slavonski Brod odustaje od kaznenog progona protiv A.B. zbog - nedostatka dokaza.

Mešu ostalim, navode da se “radnje kojima se teretio osumnjičeni A. B. svode na udaranje šakama po cijelom tijelu te da je kod oštećenika kod prijema u bolnicu utvrđen “prijelom šestog i sedmog rebra s lijeve strane”.

U svibnju 2012. godine Škrpan podnosi optužnicu protiv A.B. kao oštećenik te se na sudu u Osijeku utvrđuje identitet još dvojice vojnih policajaca koji su ga priveli. Naposljetku, A.B. biva oslobođen, a Županijski sud u Osijeku u svom obrazloženju, među ostalim, navodi kako je “izvan svake sumnje je da je Dimitrije Škrpan zadobivao udarce po tijelu od strane većeg broja nepoznatih pripadnika oružanih snaga RH (...). Uobičajno bi u prostor u kojem je bio zatvoren dolazila po četvorica pripadnika oružanih snaga RH i naizmjenično su ga udarali nekoliko minuta”.

- S obzirom na nalaz i mišljenje vještaka psihijatra da se pokušaj suicida ne može dovesti u uzročno-posljedičnu vezu s psihofizičkim zlostavljanjem od strane A. B., a da je istovremeno stav suda da zadavanje nekoliko udaraca po tijelu oštećenika, od strane A. B., ne predstavlja onu kriminalnu količinu koja bi mogla dovesti do zaključka da je optuženik kršeći pravila međunarodnog prava za vrijeme oružanog sukoba nečovječno postupao prema civilnoj osobi - naveo je osječki sud.

Povreda Ustava

Vrhovni sud u studenom 2004. godine potvrđuje presudu. Ali, Škrpan ne odustaje i u siječnju 2015. podnosi prijavu protiv nepoznatog počinitelja.

U svojoj odluci Ustavni sud navodi i da je nedvojbeno da je postupanje koje je uključivalo tjelesno zlostavljanje “takvog oblika da ga je Županijski sud u Osijeku okarakterizirao kao ‘tortura’”.

- Ustavni sud primjećuje da je Županijski sud utvrdio da su podnositelja zlostavljali pripadnici Oružanih snaga RH... Ustavni sud nalazi da je zlostavljanjem došlo do povrede Ustava - navodi se u odluci koju potpisuje predsjednik vijeća dr. sc. Miroslav Šeparović.

Muškarac kojem su rebra slomljena u zarobljeništvu jer se sumnjalo da ima minobacač dobio odštetu od 50 tisuća kuna

Ustavni sud objavio je odluku po kojoj država mora u roku od tri mjeseca isplatiti 50 tisuća kuna Dimitriju Škrpanu iz Srbca u BiH i to zbog zlostavljanja kojeg je kao civil pretrpio početkom kolovoza 1992. godine. Tada su ga, zbog sumnje da surađuje s neprijateljem, priveli pripadnici HV-a.

Sumnjalo se da Škrpan ima mali minobacač te je nakon privođenja u vojarnu u Novoj Gradišci 9. kolovoza bio psihički i fizički zlostavljan od strane više nepoznatih pripadnika HV-a, zbog čega je pokušao počiniti samoubojstvo. Komadom stakla više puta se ubo u trbuh, čime je ozlijedio želudac i jetru, a život mu je na kraju spašen zahvaljujući liječničkoj intervenciji.
