Ustavni sud je odbio žalbu 15-godišnjaka koji je optužen za bludne radnje nad devetogodišnjakinjom tijekom igre "žandara i lopova" u ljetnom periodu neodređenog dana 2010. godine u Zadru.

Maloljetnik se žalio Ustavnom sudu da mu tijekom kaznenog postupka na Općinskom sudu u Zadru nije utvrđena krivnja, no Ustavni sud je žalbu odbio i potvrdio prvostupanjsku presudu kojom mu je izrečena odgojna mjera pojačane brige i nadzora, koja ne može biti kraća od šest mjeseci ni dulja od dvije godine, javlja Zadarski.hr.

Petnaestogodišnjak je optužen za bludne radnje na štetu djeteta nakon što je tijekom igre "žandara i lopova" sa devetogodišnjakinjom otišao u jednu kućicu koja se nalazi u dvorištu u kojem su se igrali. Djevojčicu je nagovorio da mu sjedne u krilo, a kada je ona u jednom trenutku vidjela da u blizini prolazi njezin brat, htjela ga je zvati ali joj je 15-godišnjak rekao da ga ne zove jer da će ih uhvatiti, budući da je on u toj igri žandar.

Kada je njezin brat prošao devetogodišnjakinja se htjela dignuti ali on joj je rekao da opet sjedne. Dok je tako sjedila on ju je dirao ispod nogu, nakon čega je djevojčica pobjegla i sve rekla roditeljima.

Nakon prijave i kaznenog postupka kojim je proglašen krivim, 15-godišnjak se žalio Ustavnom sudu da u presudi nisu obrazloženi razlozi na kojima se temelji ocjena o krivnji, tj. o njegovoj ubrojivosti, namjeri ili nehaju, te o svijesti o protupravnosti djela.

Ustavni sud je međutim utvrdio da je prvostupanjski nakon provedenog dokaznog postupka, dao pravilnu ocjenu o svim provedenim dokazima, pa i o iskazu svjedokinje oštećenice, te da je u inkriminiranom razdoblju kod maloljetnika već bio razvijen seksualni nagon jer je u to vrijeme imao djevojku, piše Zadarski.hr.

Ustavni sud je odbio žalbu 15-godišnjaka koji je optužen za bludne radnje nad devetogodišnjakinjom tijekom igre "žandara i lopova" u ljetnom periodu neodređenog dana 2010. godine u Zadru.

Maloljetnik se žalio Ustavnom sudu da mu tijekom kaznenog postupka na Općinskom sudu u Zadru nije utvrđena krivnja, no Ustavni sud je žalbu odbio i potvrdio prvostupanjsku presudu kojom mu je izrečena odgojna mjera pojačane brige i nadzora, koja ne može biti kraća od šest mjeseci ni dulja od dvije godine, javlja Zadarski.hr.

Petnaestogodišnjak je optužen za bludne radnje na štetu djeteta nakon što je tijekom igre "žandara i lopova" sa devetogodišnjakinjom otišao u jednu kućicu koja se nalazi u dvorištu u kojem su se igrali. Djevojčicu je nagovorio da mu sjedne u krilo, a kada je ona u jednom trenutku vidjela da u blizini prolazi njezin brat, htjela ga je zvati ali joj je 15-godišnjak rekao da ga ne zove jer da će ih uhvatiti, budući da je on u toj igri žandar.

Kada je njezin brat prošao devetogodišnjakinja se htjela dignuti ali on joj je rekao da opet sjedne. Dok je tako sjedila on ju je dirao ispod nogu, nakon čega je djevojčica pobjegla i sve rekla roditeljima.

Nakon prijave i kaznenog postupka kojim je proglašen krivim, 15-godišnjak se žalio Ustavnom sudu da u presudi nisu obrazloženi razlozi na kojima se temelji ocjena o krivnji, tj. o njegovoj ubrojivosti, namjeri ili nehaju, te o svijesti o protupravnosti djela.

Ustavni sud je međutim utvrdio da je prvostupanjski nakon provedenog dokaznog postupka, dao pravilnu ocjenu o svim provedenim dokazima, pa i o iskazu svjedokinje oštećenice, te da je u inkriminiranom razdoblju kod maloljetnika već bio razvijen seksualni nagon jer je u to vrijeme imao djevojku, piše Zadarski.hr.
