Na zadarskom Općinskom sudu u srijedu je počelo prvo suđenje za slučaj mobbinga u Hrvatskoj, a na optuženičku klupu sjeli su šef i domar trgovačkog centra Interspar u Zadru, Aleksandar Knežević (45) i Šime Strika (43).

Kako hrvatski zakon još uvijek nema kazneno djelo mobbinga, Općinsko državno odvjetništvo u Zadru u listopadu prošle godine podiglo je protiv Kneževića optužni prijedlog zbog povrede prava na rad i drugih prava iz rada na štetu 31-godišnje trgovkinje J.B. koja ga je više puta prijavljivala zbog mobbinga i maltretiranja na radnom mjestu.

Za ovo kazneno djelo predviđena je novčana kazna ili zatvor do jedne godine. Domar u istom centru, Šime Strika optužen je zbog bludnih radnji nad 39-godišnjom radnicom A.D. koja je pred kraj radnog vremena s leđa napadnuta u skladištu, kad ju je zlostavljač zgrabio za grudi.

Zbog zaštite žrtava, sudski postupak je zatvoren za javnost, a neslužbeno doznajemo kako su na jučerašnjoj raspravi saslušani Aleksandar Knežević, Šime Strika te 31-godišnja trgovkinja J.B. koja tereti Kneževića za mobbing.

- Sretna sam što je suđenje napokon počelo - kratko je rekla J.B. na izlasku iz sudnice dodajući kako je već godinu dana na bolovanju zbog psihičkih problema uzrokovanih zlostavljanjem na radnom mjestu.

Druga trgovkinja, žrtva seksualnog mobbinga u srijedu se nije pojavila na Općinskom sudu u Zadru zbog zdravstvenih razloga.

Na zlostavljanje koje trpe u Intersparu dvije radnice upozoravale su još od početka prošle godine, prvo putem sindikata, a potom su obavijestile upravu «Spara» usmeno i pismeno tražeći samo da ih se na radnom mjestu zaštiti od zlostavljača.

Međutim, uprava je domaru uputila samo pisanu opomenu, a Kneževiću ni to, iako on od ranije ima opomenu jer su ga zbog verbalnog zlostavljanja krajem 2005. također prijavile dvije djelatnice Interspara.

Kako je reakcija poslodavca izostala, dvije trgovkinje obraćaju se medijima, a temeljem njihovog svjedočenja Općinsko državno odvjetništvo u Zadru po službenoj dužnosti pokreće istragu i slučaj predaje policiji.

PU Zadarska u travnju podiže kaznene prijave protiv dvojca iz Interspara, a pet mjeseci nakon toga ODO protiv Kneževića i Strike podiže optužne prijedloge.

Suđenja je nastavlja krajem travnja.

Ovaj slučaj bit će model za budućnost

- Kao prvi ovakav slučaj, zadarsko suđenje bit će model po kojemu će se rješavati ostalih šest tisuća slučajeva mobbinga u Hrvatskoj. Ovo je dokaz da Hrvatskoj hitno treba zakon o mobbingu koji još uvijek nemamo. Zakon o radu ga tek sporadično spominje, a u kaznenom zakonu mobbinga nema kao inkriminirane radnje- rekao je pravni zastupnik dvoju radnica Vedran Uranija.

O ishodu ovog postupka ovisit će i zahtjev za naknadom štete.

Na zadarskom Općinskom sudu u srijedu je počelo prvo suđenje za slučaj mobbinga u Hrvatskoj, a na optuženičku klupu sjeli su šef i domar trgovačkog centra Interspar u Zadru, Aleksandar Knežević (45) i Šime Strika (43).

Kako hrvatski zakon još uvijek nema kazneno djelo mobbinga, Općinsko državno odvjetništvo u Zadru u listopadu prošle godine podiglo je protiv Kneževića optužni prijedlog zbog povrede prava na rad i drugih prava iz rada na štetu 31-godišnje trgovkinje J.B. koja ga je više puta prijavljivala zbog mobbinga i maltretiranja na radnom mjestu.

Za ovo kazneno djelo predviđena je novčana kazna ili zatvor do jedne godine. Domar u istom centru, Šime Strika optužen je zbog bludnih radnji nad 39-godišnjom radnicom A.D. koja je pred kraj radnog vremena s leđa napadnuta u skladištu, kad ju je zlostavljač zgrabio za grudi.

Zbog zaštite žrtava, sudski postupak je zatvoren za javnost, a neslužbeno doznajemo kako su na jučerašnjoj raspravi saslušani Aleksandar Knežević, Šime Strika te 31-godišnja trgovkinja J.B. koja tereti Kneževića za mobbing.

- Sretna sam što je suđenje napokon počelo - kratko je rekla J.B. na izlasku iz sudnice dodajući kako je već godinu dana na bolovanju zbog psihičkih problema uzrokovanih zlostavljanjem na radnom mjestu.

Druga trgovkinja, žrtva seksualnog mobbinga u srijedu se nije pojavila na Općinskom sudu u Zadru zbog zdravstvenih razloga.

Na zlostavljanje koje trpe u Intersparu dvije radnice upozoravale su još od početka prošle godine, prvo putem sindikata, a potom su obavijestile upravu «Spara» usmeno i pismeno tražeći samo da ih se na radnom mjestu zaštiti od zlostavljača.

Međutim, uprava je domaru uputila samo pisanu opomenu, a Kneževiću ni to, iako on od ranije ima opomenu jer su ga zbog verbalnog zlostavljanja krajem 2005. također prijavile dvije djelatnice Interspara.

Kako je reakcija poslodavca izostala, dvije trgovkinje obraćaju se medijima, a temeljem njihovog svjedočenja Općinsko državno odvjetništvo u Zadru po službenoj dužnosti pokreće istragu i slučaj predaje policiji.

PU Zadarska u travnju podiže kaznene prijave protiv dvojca iz Interspara, a pet mjeseci nakon toga ODO protiv Kneževića i Strike podiže optužne prijedloge.

Suđenja je nastavlja krajem travnja.

Ovaj slučaj bit će model za budućnost

- Kao prvi ovakav slučaj, zadarsko suđenje bit će model po kojemu će se rješavati ostalih šest tisuća slučajeva mobbinga u Hrvatskoj. Ovo je dokaz da Hrvatskoj hitno treba zakon o mobbingu koji još uvijek nemamo. Zakon o radu ga tek sporadično spominje, a u kaznenom zakonu mobbinga nema kao inkriminirane radnje- rekao je pravni zastupnik dvoju radnica Vedran Uranija.

O ishodu ovog postupka ovisit će i zahtjev za naknadom štete.
