Županijski sud u Bjelovaru u svojoj Presudi Kž-294/2021-8 od 29. lipnja 2022. potvrdio je prvostupanjsku presudu kojom je na zatvorsku kaznu u trajanju od godinu dana osuđen vozač koji je zbog kršenja odredbe koja nalaže vozaču da propusti sva vozila koja se kreću cestom s prednošću prolaza izazvao prometnu nesreću u kojoj je smrtno stradao motociklist. Beziznimno su svi vozači upoznati s postojanjem i značenjem prometnog znaka koji označava cestu s prednošću prolaska. To je prometni znak s kojim vas temeljito upoznaju gotovo od prvog dana u autoškoli! Pravilo kaže kako je vozač koji ulazi vozilom na cestu koja je prometnim znakom označena kao cesta s prednošću prolaza dužan propustiti sva vozila koja se kreću tom cestom. Sud izrijekom tumači tu odredbu na način da ta odredba znači kako se vozač sa sigurnošću mora uvjeriti da svojim izlaskom na cestu s prednošću prolaska neće ugroziti sigurnost sudionika u prometu koji se kreću tom cestom, makar se oni i nepropisno kretali, pod uvjetom da je mogao uočiti nailazak tog vozila, navodi HAK revija.

Dakle, kada vozite, očekujte da drugi krše prometne propise i budite spremni na to! Zapravo stvari bi tako i trebalo percipirati jer kada bi se i svi drugi sudionici u prometu držali propisa, problema ne bi ni bilo. Iskustvo međutim, govori da su prometne nesreće česte, a do njih dolazi upravo zbog kršenja propisa. Stoga valja permanentno, kontinuirano očekivati da se drugi sudionici u prometu neće pridržavati prometnih propisa. Nema tu mjesta za povjerenje u drugoga! Upravo to i naglašava sud!

Naime, konstatirano je u odnosnom sudskom predmetu kako je motociklist vozio neprilagođenom i nedopuštenom brzinom od 90 km/h, znatno višom od propisane na tom dijelu kolnika. Utvrđeno je pored toga i da je vozio bez položenog vozačkog ispita s upaljenim dugim svjetlom i bez zaštitne kacige, pri čemu se ističe da je postojala mogućnost da motociklist izbjegne nesreću da se vozio propisanom brzinom od 50 km/h, odnosno da je u trenutku ulaska vozila optuženika u raskrižje reagirao skretanjem na lijevu stranu kolnika ili poduzeo radnju kočenja.

Međutim, kretanje nedopuštenom brzinom, izostanak pravodobne reakcije motocikliste radi izbjegavanja nesreće, prema stavu suda ne isključuju kaznenu odgovornost vozača drugog vozila za nepropisno ulaženje u raskrižje. Tu osobito treba imati u vidu kako sud percipira načelo povjerenja.

Načelo povjerenja tj. pouzdanje vozača vozila u činjenicu da motociklist vozi dopuštenom brzinom, poštujući prometne propise vrijedi samo za onog sudionika u prometu koji postupa propisno. Upravo iz tog razloga na načelo povjerenja ne može se u konkretnom slučaju pozvati vozač drugog vozila koji je mogao uočiti nailazak motocikliste na cesti s prednošću prolaska na udaljenosti od oko 80 metara kad je započeo radnju uključivanja na tu cestu i bio ga je dužan propustiti. Vozač vozila iskazao je doduše kako uopće nije vidio nailazak motocikliste. Međutim, vještaci su utvrdili da ga je morao uočiti i da je postupio protivno zakonu budući je propustio obratiti pozornost na ostale sudionike u prometu i uvjeriti se da radnju uključivanja u promet na cesti s prednošću prolaska može učiniti bez opasnosti za druge sudionike u prometu.

Nepoštivanje propisa s obje strane a u konačnici smrtni ishod. Jedan život se ugasio a drugi će biti nesumnjivo obilježen izrečenom jednogodišnjom zatvorskom kaznom! Pazite stoga, pazite na sebe i druge, očekujte od drugih da se ne drže prometnih propisa i spremno reagirajte na to. Na greške drugih možete se s uspjehom pozivati samo ako na vašoj strani i u vašim postupcima grešaka, kršenja prometnih propisa nema, piše HAK revija.

Županijski sud u Bjelovaru u svojoj Presudi Kž-294/2021-8 od 29. lipnja 2022. potvrdio je prvostupanjsku presudu kojom je na zatvorsku kaznu u trajanju od godinu dana osuđen vozač koji je zbog kršenja odredbe koja nalaže vozaču da propusti sva vozila koja se kreću cestom s prednošću prolaza izazvao prometnu nesreću u kojoj je smrtno stradao motociklist. Beziznimno su svi vozači upoznati s postojanjem i značenjem prometnog znaka koji označava cestu s prednošću prolaska. To je prometni znak s kojim vas temeljito upoznaju gotovo od prvog dana u autoškoli! Pravilo kaže kako je vozač koji ulazi vozilom na cestu koja je prometnim znakom označena kao cesta s prednošću prolaza dužan propustiti sva vozila koja se kreću tom cestom. Sud izrijekom tumači tu odredbu na način da ta odredba znači kako se vozač sa sigurnošću mora uvjeriti da svojim izlaskom na cestu s prednošću prolaska neće ugroziti sigurnost sudionika u prometu koji se kreću tom cestom, makar se oni i nepropisno kretali, pod uvjetom da je mogao uočiti nailazak tog vozila, navodi HAK revija.

Dakle, kada vozite, očekujte da drugi krše prometne propise i budite spremni na to! Zapravo stvari bi tako i trebalo percipirati jer kada bi se i svi drugi sudionici u prometu držali propisa, problema ne bi ni bilo. Iskustvo međutim, govori da su prometne nesreće česte, a do njih dolazi upravo zbog kršenja propisa. Stoga valja permanentno, kontinuirano očekivati da se drugi sudionici u prometu neće pridržavati prometnih propisa. Nema tu mjesta za povjerenje u drugoga! Upravo to i naglašava sud!

Naime, konstatirano je u odnosnom sudskom predmetu kako je motociklist vozio neprilagođenom i nedopuštenom brzinom od 90 km/h, znatno višom od propisane na tom dijelu kolnika. Utvrđeno je pored toga i da je vozio bez položenog vozačkog ispita s upaljenim dugim svjetlom i bez zaštitne kacige, pri čemu se ističe da je postojala mogućnost da motociklist izbjegne nesreću da se vozio propisanom brzinom od 50 km/h, odnosno da je u trenutku ulaska vozila optuženika u raskrižje reagirao skretanjem na lijevu stranu kolnika ili poduzeo radnju kočenja.

Međutim, kretanje nedopuštenom brzinom, izostanak pravodobne reakcije motocikliste radi izbjegavanja nesreće, prema stavu suda ne isključuju kaznenu odgovornost vozača drugog vozila za nepropisno ulaženje u raskrižje. Tu osobito treba imati u vidu kako sud percipira načelo povjerenja.

Načelo povjerenja tj. pouzdanje vozača vozila u činjenicu da motociklist vozi dopuštenom brzinom, poštujući prometne propise vrijedi samo za onog sudionika u prometu koji postupa propisno. Upravo iz tog razloga na načelo povjerenja ne može se u konkretnom slučaju pozvati vozač drugog vozila koji je mogao uočiti nailazak motocikliste na cesti s prednošću prolaska na udaljenosti od oko 80 metara kad je započeo radnju uključivanja na tu cestu i bio ga je dužan propustiti. Vozač vozila iskazao je doduše kako uopće nije vidio nailazak motocikliste. Međutim, vještaci su utvrdili da ga je morao uočiti i da je postupio protivno zakonu budući je propustio obratiti pozornost na ostale sudionike u prometu i uvjeriti se da radnju uključivanja u promet na cesti s prednošću prolaska može učiniti bez opasnosti za druge sudionike u prometu.

Nepoštivanje propisa s obje strane a u konačnici smrtni ishod. Jedan život se ugasio a drugi će biti nesumnjivo obilježen izrečenom jednogodišnjom zatvorskom kaznom! Pazite stoga, pazite na sebe i druge, očekujte od drugih da se ne drže prometnih propisa i spremno reagirajte na to. Na greške drugih možete se s uspjehom pozivati samo ako na vašoj strani i u vašim postupcima grešaka, kršenja prometnih propisa nema, piše HAK revija.

Županijski sud u Bjelovaru u svojoj Presudi Kž-294/2021-8 od 29. lipnja 2022. potvrdio je prvostupanjsku presudu kojom je na zatvorsku kaznu u trajanju od godinu dana osuđen vozač koji je zbog kršenja odredbe koja nalaže vozaču da propusti sva vozila koja se kreću cestom s prednošću prolaza izazvao prometnu nesreću u kojoj je smrtno stradao motociklist. Beziznimno su svi vozači upoznati s postojanjem i značenjem prometnog znaka koji označava cestu s prednošću prolaska.
