Kada smo nedavno objavili priču o hvarskom 'mirovnjaku' Fabijanu Beliću, koji je kao njemački vojnik živ i zdrav preživio pakao Malija, on nam reče da se s tim angažmanom zaradilo i nešto novaca te da namjerava u rodnoj Jelsi sagraditi kuću, skrasiti se i nastaviti tradiciju bavljenja obiteljskim turizmom.
Naravno, takva odluka raduje svakog našeg čovjeka, a posebno njegove roditelje Tončija i Gabrielu, koji mu maksimalno pomažu oko te poslovne ideje. Točnije otac mu je na svoje ime još 2016. podnio Zahtjev za izdavanje građevinske dozvole UO za graditeljstvo i uređenje Splitsko-dalmatinske županije – Ispostavi Hvar za izgradnju ne baš velike stambene zgrade na vlastitom zemljištu, ali je nakon toga naišao na niz problema.
- Angažirao sam projektni biro da mi u građevinskom području i po postojećim propisima izradi projektnu dokumentaciju te ishodi građevinsku dozvolu. Napravljen je i geodetski projekt, s tim da sam sa svojim stvarnim susjedima postigao dogovor da mogu graditi na udaljenosti od dva metra od njihove parcele. U listopadu 2018. mi je 13 stranaka obavilo uvid u spis predmeta i nitko od njih nije imao nikakvih primjedbi. No, ipak, jedna gospođa se nije s tim složila. Naime, ona je suvlasnica susjednog zemljišta, i protivi se premda se njezin dio prema ranijoj podjeli nalazi nešto dalje od čestice zemlje na kojoj sa sinom planiram izgradnju kuće, tako da od tada nastaju prave Tantalove muke oko dobivanja dozvole – veli Tonči.

Zbog svega navedenog udaljio se četiri metra od međe sa susjedima i računao da će s tim problem biti riješen. Međutim, onda susjeda više nije priznavala među. Naravno, zato na teren izlazi i drugi geodet (vještak) iz Omiša koji je potvrdio raniji elaborat, ali Belić ni dalje nije dobivao dozvolu. Nedavno je Odjel za katastar u Starome Gradu, a radi promjene propisa do kojih je došlo u međuvremenu, zatražio doradu geodetskog projekta, koji mu je predan 25. svibnja 2020. godine, ali dozvola ni nakon toga ne stiže.
S obzirom na to da se postupak po ovom predmetu vodi već više od četiri godine, pitali smo u Državnoj geodetskoj upravi što se zapravo događa i zašto to toliko dugo traje?
- Nadležni katastarski ured postupio je sukladno pozitivnim zakonskim propisima nakon što je ovlaštena geodetska tvrtka ispravila sve nedostatke u geodetskom projektu te je isti pregledan i potvrđen – poručili su ubrzo iz te uprave, no troškovi Belića su dosegnuli gotovo 40 tisuća kuna, a gradnju nije mogao realizirati, pa je zbog toga izgubio dobit.
Drugi netko bi to pokušao nadoknaditi u redovnom sudskom postupku, ali Tonči se žali i na to što ga se kao stranku nije pravodobno obavještavalo o ishodu postupanja jer je upravo to bilo od presudnog značenja za eventualni angažman odvjetnika koji bi moguće cijelu stvar još davno doveo do kraja. S obzirom na dugotrajnost postupka s vremenom je posumnjao da se sve to možda razvlači namjerno i da se radi u korist druge strane, ali su nam to u potpunosti demantirali u Ministarstvu graditeljstva i prostornog uređenja.
- Voditeljica postupka je potvrdila da je zahtjev zaista iz 2016. godine, ali da je još uvijek otvoren ne iz razloga što se na istome nije radilo, nego iz razloga što je investitor imao problema sa susjedima i potvrdom geodetskog projekta u katastru. Radi nedobivanja suglasnosti projektno rješenje se mijenjalo, pa tako i geodetski projekt.
Službenica navodi da je zahtjev mogla okončati i ranije, ali bi time naštetila investitoru. Smatra da su opravdani razlozi čekanja dostave zakonom propisane dokumentacije. Naime, u slučaju odbijanja predmetnog zahtjeva radi nepotpune dokumentacije, a radi se o dokumentaciji koja ovisi o postupanju drugih nadležnih tijela (Općinskog suda i Katastarskog ureda), investitor bi bio bitno oštećen iz razloga što je u međuvremenu stupio na snagu novi Zakon o gradnji i novi izmijenjeni Prostorni plan uređenja Općine Jelsa, što bi za posljedicu imalo izradu kompletno nove dokumentacije i dodatne troškove podnositelja zahtjeva. Također ističemo da stranka nije uložila žalbu zbog šutnje administracije, a to je jedini pravni način zaštite njezinih prava i interesa – odgovorili su na naš upit iz Ministarstva.
No, Belić je nedugo nakon očitovanja napokon dobio građevinsku dozvolu u petoj godini od podnošenja zahtjeva za jednu relativno malu, ali vrlo simpatično projektiranu stambenu zgradu. Ipak, morat će još nekoliko dana pričekati na njezinu pravomoćnost, a nakon toga će upravo ona omogućiti povratak jednoga mladog iseljenog Hrvata u Domovinu. Mladić uz to kani zasnovati i obitelj, a to je ono što najviše u Lijepoj našoj baš svi priželjkujemo.

Kada smo nedavno objavili priču o hvarskom 'mirovnjaku' Fabijanu Beliću, koji je kao njemački vojnik živ i zdrav preživio pakao Malija, on nam reče da se s tim angažmanom zaradilo i nešto novaca te da namjerava u rodnoj Jelsi sagraditi kuću, skrasiti se i nastaviti tradiciju bavljenja obiteljskim turizmom.
Naravno, takva odluka raduje svakog našeg čovjeka, a posebno njegove roditelje Tončija i Gabrielu, koji mu maksimalno pomažu oko te poslovne ideje. Točnije otac mu je na svoje ime još 2016. podnio Zahtjev za izdavanje građevinske dozvole UO za graditeljstvo i uređenje Splitsko-dalmatinske županije – Ispostavi Hvar za izgradnju ne baš velike stambene zgrade na vlastitom zemljištu, ali je nakon toga naišao na niz problema.
- Angažirao sam projektni biro da mi u građevinskom području i po postojećim propisima izradi projektnu dokumentaciju te ishodi građevinsku dozvolu. Napravljen je i geodetski projekt, s tim da sam sa svojim stvarnim susjedima postigao dogovor da mogu graditi na udaljenosti od dva metra od njihove parcele. U listopadu 2018. mi je 13 stranaka obavilo uvid u spis predmeta i nitko od njih nije imao nikakvih primjedbi. No, ipak, jedna gospođa se nije s tim složila. Naime, ona je suvlasnica susjednog zemljišta, i protivi se premda se njezin dio prema ranijoj podjeli nalazi nešto dalje od čestice zemlje na kojoj sa sinom planiram izgradnju kuće, tako da od tada nastaju prave Tantalove muke oko dobivanja dozvole – veli Tonči.

Zbog svega navedenog udaljio se četiri metra od međe sa susjedima i računao da će s tim problem biti riješen. Međutim, onda susjeda više nije priznavala među. Naravno, zato na teren izlazi i drugi geodet (vještak) iz Omiša koji je potvrdio raniji elaborat, ali Belić ni dalje nije dobivao dozvolu. Nedavno je Odjel za katastar u Starome Gradu, a radi promjene propisa do kojih je došlo u međuvremenu, zatražio doradu geodetskog projekta, koji mu je predan 25. svibnja 2020. godine, ali dozvola ni nakon toga ne stiže.
S obzirom na to da se postupak po ovom predmetu vodi već više od četiri godine, pitali smo u Državnoj geodetskoj upravi što se zapravo događa i zašto to toliko dugo traje?
- Nadležni katastarski ured postupio je sukladno pozitivnim zakonskim propisima nakon što je ovlaštena geodetska tvrtka ispravila sve nedostatke u geodetskom projektu te je isti pregledan i potvrđen – poručili su ubrzo iz te uprave, no troškovi Belića su dosegnuli gotovo 40 tisuća kuna, a gradnju nije mogao realizirati, pa je zbog toga izgubio dobit.
Drugi netko bi to pokušao nadoknaditi u redovnom sudskom postupku, ali Tonči se žali i na to što ga se kao stranku nije pravodobno obavještavalo o ishodu postupanja jer je upravo to bilo od presudnog značenja za eventualni angažman odvjetnika koji bi moguće cijelu stvar još davno doveo do kraja. S obzirom na dugotrajnost postupka s vremenom je posumnjao da se sve to možda razvlači namjerno i da se radi u korist druge strane, ali su nam to u potpunosti demantirali u Ministarstvu graditeljstva i prostornog uređenja.
- Voditeljica postupka je potvrdila da je zahtjev zaista iz 2016. godine, ali da je još uvijek otvoren ne iz razloga što se na istome nije radilo, nego iz razloga što je investitor imao problema sa susjedima i potvrdom geodetskog projekta u katastru. Radi nedobivanja suglasnosti projektno rješenje se mijenjalo, pa tako i geodetski projekt.
Službenica navodi da je zahtjev mogla okončati i ranije, ali bi time naštetila investitoru. Smatra da su opravdani razlozi čekanja dostave zakonom propisane dokumentacije. Naime, u slučaju odbijanja predmetnog zahtjeva radi nepotpune dokumentacije, a radi se o dokumentaciji koja ovisi o postupanju drugih nadležnih tijela (Općinskog suda i Katastarskog ureda), investitor bi bio bitno oštećen iz razloga što je u međuvremenu stupio na snagu novi Zakon o gradnji i novi izmijenjeni Prostorni plan uređenja Općine Jelsa, što bi za posljedicu imalo izradu kompletno nove dokumentacije i dodatne troškove podnositelja zahtjeva. Također ističemo da stranka nije uložila žalbu zbog šutnje administracije, a to je jedini pravni način zaštite njezinih prava i interesa – odgovorili su na naš upit iz Ministarstva.
No, Belić je nedugo nakon očitovanja napokon dobio građevinsku dozvolu u petoj godini od podnošenja zahtjeva za jednu relativno malu, ali vrlo simpatično projektiranu stambenu zgradu. Ipak, morat će još nekoliko dana pričekati na njezinu pravomoćnost, a nakon toga će upravo ona omogućiti povratak jednoga mladog iseljenog Hrvata u Domovinu. Mladić uz to kani zasnovati i obitelj, a to je ono što najviše u Lijepoj našoj baš svi priželjkujemo.
