Optužnica USKOK-a opisuje nelegalnosti vezano za zemljište površine 14.445 metara četvornih u uvali Mlaska.

Kačić-Bartulović se tereti da je, kao zamjenik načelnika i potpredsjednik Općinskog vijeća, od polovice srpnja do početka listopada 2005. godine zlouporabio položaj i ovlasti i domogao se više od 14.000 metara četvornih zemljišta vrijednog 7 milijuna kuna.

Kako stoji u optužnici, podnio je tužbu protiv Općine u kojoj je naveo da je stekao pravo vlasništva nad zemljištem dosjelošću zbog čega je i bitno utvrditi je li zemljište obrađivano.

O tužbi nije obavijestio nikog u Općini te je iskoristio odsutnost tadašnjeg načelnika Vladimira Rudana da bi zatajio sudske papire koje je dobila Općina te je stoga izgubila spor, a on stekao vlasništvo.

Jedno od glavnih pitanja tijekom glavne rasprave je jesu li masline bile obrađivane ili ne što može biti glavni razlog prihvaćanja ili odbačaja tužbe za vlasništvo nad zemljištem dosjelošću. Vezano za tu okolnost svjedočio je i sadašnji načelnik Ivan Slavić.

Izjavio je kako je njemu baka kazala da je vidjela sada pokojnu tetu optuženog Kačića-Bartulovića da obrađuje masline. Direktnih saznanja o obradi ili branju maslina nije imao.

Nakon njega izjavu je dala bivša tajnica Općine Sućuraj koja se izjasnila kako ona nije potpisala pristigle sudske papire jer ih inače zaprima i potpisuje administrativna tajnica.

Općinska administrativna tajnica svjedočila je već prije i ona je zaista i kazala kao je sporne papire zaprimila s ostalom poštom, ali i kako ih je proslijedila ili načelniku ili zamjeniku načelnika, ovisno tko je bio prisutan. Tadašnji načelnik Općine Vladimir Rudan također je svjedočio na sudu kako je bio odsutan u dane kada je u Općinu pristigla sudska pošta.

Optužnica USKOK-a opisuje nelegalnosti vezano za zemljište površine 14.445 metara četvornih u uvali Mlaska.

Kačić-Bartulović se tereti da je, kao zamjenik načelnika i potpredsjednik Općinskog vijeća, od polovice srpnja do početka listopada 2005. godine zlouporabio položaj i ovlasti i domogao se više od 14.000 metara četvornih zemljišta vrijednog 7 milijuna kuna.

Kako stoji u optužnici, podnio je tužbu protiv Općine u kojoj je naveo da je stekao pravo vlasništva nad zemljištem dosjelošću zbog čega je i bitno utvrditi je li zemljište obrađivano.

O tužbi nije obavijestio nikog u Općini te je iskoristio odsutnost tadašnjeg načelnika Vladimira Rudana da bi zatajio sudske papire koje je dobila Općina te je stoga izgubila spor, a on stekao vlasništvo.

Jedno od glavnih pitanja tijekom glavne rasprave je jesu li masline bile obrađivane ili ne što može biti glavni razlog prihvaćanja ili odbačaja tužbe za vlasništvo nad zemljištem dosjelošću. Vezano za tu okolnost svjedočio je i sadašnji načelnik Ivan Slavić.

Izjavio je kako je njemu baka kazala da je vidjela sada pokojnu tetu optuženog Kačića-Bartulovića da obrađuje masline. Direktnih saznanja o obradi ili branju maslina nije imao.

Nakon njega izjavu je dala bivša tajnica Općine Sućuraj koja se izjasnila kako ona nije potpisala pristigle sudske papire jer ih inače zaprima i potpisuje administrativna tajnica.

Općinska administrativna tajnica svjedočila je već prije i ona je zaista i kazala kao je sporne papire zaprimila s ostalom poštom, ali i kako ih je proslijedila ili načelniku ili zamjeniku načelnika, ovisno tko je bio prisutan. Tadašnji načelnik Općine Vladimir Rudan također je svjedočio na sudu kako je bio odsutan u dane kada je u Općinu pristigla sudska pošta.
