Odluku kojom je Ustavni sud jednoj listi na lokalnim izborima dozvolio da se kandidira iako nema dokaza da je neophodne potpise podrške prikupila u istim rokovima kao i ostale liste, GONG je nazvao skandaloznom. Zbog toga je pozvao Hrvatski sabor da pri izboru novih ustavnih sudaca 'ne ponavlja iste greške', te stavi integritet i stručnost ispred svih ostalih kriterija, piše tportal.
Riječ je o grupi birača Ivana Gotovca na izborima za Gradsko vijeće Kaštela kojoj je odobreno prikupljanje potpisa na starim obrascima iz 2013. godine. Sve ostale grupe birača koje su se htjele kandidirati na lokalnim izborima u Hrvatskoj, pa tako i Akcija mladih koja je podnijela prigovor, imale su rok od 14 dana za prikupljanje potpisa na novim, službenim, propisanim obrascima.
Odlukom kojom je dozvoljena kandidatura listi koja je potpise podrške prikupila na obrascu s prethodnih izbora Ustavni sud je doveo sve ostale liste u nejednak položaj i time povećao rizik da se predstojeće izbore ne može proglasiti ni zakonitima niti poštenima, priopćio je GONG upozoravajući da takva odluka može imati dalekosežne negativne posljedice na integritet izbornih procesa.
'Odluka Ustavnog suda šalje poruku da svi koji se žele kandidirati na budućim izborima, bilo predsjedničkim, parlamentarnim ili nekim drugima, već sada mogu početi skupljati potpise na starim obrascima, što je presedan u ustavnopravnoj praksi te ruglo demokracije i izbornog procesa', poručuje GONG dodajući da takva praksa Ustavnog suda, umjesto da štiti Ustav i vladavinu prava, vrlo često 'rastače i ono malo vladavine prava'.
Spornu odluku su, navodi GONG, donijela tri ustavna suca Drugog vijeća za rješavanje izbornih sporova (Rajko Mlinarić kao predsjednik te članovi Antun Palarić i Miroslav Šumanović), koji su time potvrdili rješenje Županijskog izbornog povjerenstva Splitsko-dalmatinske županije kojim predsjedava sudac Marijan Miletić.

Odluku kojom je Ustavni sud jednoj listi na lokalnim izborima dozvolio da se kandidira iako nema dokaza da je neophodne potpise podrške prikupila u istim rokovima kao i ostale liste, GONG je nazvao skandaloznom. Zbog toga je pozvao Hrvatski sabor da pri izboru novih ustavnih sudaca 'ne ponavlja iste greške', te stavi integritet i stručnost ispred svih ostalih kriterija, piše tportal.
Riječ je o grupi birača Ivana Gotovca na izborima za Gradsko vijeće Kaštela kojoj je odobreno prikupljanje potpisa na starim obrascima iz 2013. godine. Sve ostale grupe birača koje su se htjele kandidirati na lokalnim izborima u Hrvatskoj, pa tako i Akcija mladih koja je podnijela prigovor, imale su rok od 14 dana za prikupljanje potpisa na novim, službenim, propisanim obrascima.
Odlukom kojom je dozvoljena kandidatura listi koja je potpise podrške prikupila na obrascu s prethodnih izbora Ustavni sud je doveo sve ostale liste u nejednak položaj i time povećao rizik da se predstojeće izbore ne može proglasiti ni zakonitima niti poštenima, priopćio je GONG upozoravajući da takva odluka može imati dalekosežne negativne posljedice na integritet izbornih procesa.
'Odluka Ustavnog suda šalje poruku da svi koji se žele kandidirati na budućim izborima, bilo predsjedničkim, parlamentarnim ili nekim drugima, već sada mogu početi skupljati potpise na starim obrascima, što je presedan u ustavnopravnoj praksi te ruglo demokracije i izbornog procesa', poručuje GONG dodajući da takva praksa Ustavnog suda, umjesto da štiti Ustav i vladavinu prava, vrlo često 'rastače i ono malo vladavine prava'.
Spornu odluku su, navodi GONG, donijela tri ustavna suca Drugog vijeća za rješavanje izbornih sporova (Rajko Mlinarić kao predsjednik te članovi Antun Palarić i Miroslav Šumanović), koji su time potvrdili rješenje Županijskog izbornog povjerenstva Splitsko-dalmatinske županije kojim predsjedava sudac Marijan Miletić.
