Ustavni sud je donio odluku o ukidanju pritvora i rješenja o provođenju istrage protiv Josipa Boljkovca (91), osumnjičenog za ratni zločin protiv civilnog stanovništva, prihvativši, tako, tužbeni zahtjev obrane.

U obrazloženju se, između ostalog, ističe kako je istražni nalog trebao donijeti nadležni državni odvjetnik, a rješenje o istražnom zatvoru – sudac istrage.

S tim u vezi podsjetimo kako je, pak, o obje «stavke» odluku donijela istražna sutkinja, a njeno je «istražno-pritvorsko» rješenje u žalbenom postupku potvrdilo izvanraspravno sudsko vijeće.

Odvjetnik Anto Nobilo je nakon toga podnio ustavnu tužbu.

Boljkovac je, podsjetimo, okrivljen po zapovjednoj odgovornosti za likvidaciju 21 civila na karlovačkom području u svibnju 1945., a prilikom iznošenja obrane nakon uhićenja negirao je krivnju.
                                              
- Primjenili su stari zakon samo zato jer po novome ne bi bilo osnove za pritvor protiv Boljkovca. Sada se vidi da je cijeli postupak pokrenut zato što je ministru policije Tomislavu Karamarku i zamjeniku ravnatelja policije Milijanu Brkiću trebao spektakl pred izbore - izjavio je za Večernji list Nobilo koji je ustavnu tužbu podnio prošli utorak.

Ustavni sud je donio odluku o ukidanju pritvora i rješenja o provođenju istrage protiv Josipa Boljkovca (91), osumnjičenog za ratni zločin protiv civilnog stanovništva, prihvativši, tako, tužbeni zahtjev obrane.

U obrazloženju se, između ostalog, ističe kako je istražni nalog trebao donijeti nadležni državni odvjetnik, a rješenje o istražnom zatvoru – sudac istrage.

S tim u vezi podsjetimo kako je, pak, o obje «stavke» odluku donijela istražna sutkinja, a njeno je «istražno-pritvorsko» rješenje u žalbenom postupku potvrdilo izvanraspravno sudsko vijeće.

Odvjetnik Anto Nobilo je nakon toga podnio ustavnu tužbu.

Boljkovac je, podsjetimo, okrivljen po zapovjednoj odgovornosti za likvidaciju 21 civila na karlovačkom području u svibnju 1945., a prilikom iznošenja obrane nakon uhićenja negirao je krivnju.
                                              
- Primjenili su stari zakon samo zato jer po novome ne bi bilo osnove za pritvor protiv Boljkovca. Sada se vidi da je cijeli postupak pokrenut zato što je ministru policije Tomislavu Karamarku i zamjeniku ravnatelja policije Milijanu Brkiću trebao spektakl pred izbore - izjavio je za Večernji list Nobilo koji je ustavnu tužbu podnio prošli utorak.
