Općinsko je državno odvjetništvo zbog bitne povrede odredaba kaznenog postupka i pogrešno utvrđenog činjeničnog stanja, podnijelo žalbu na presudu sutkinje Općinskog suda Sandre Bramberger Ostojić koja je zbog nedozvoljena presađivanja jajnih stanica, nepravomoćno oslobodila optužbi Asima Kurjaka (66), njegovu suprugu Biserku Funduk Kurjak (65), liječnicu Sanju Kuprešić i Ernesta Suchaneka.
Naime, DORH smatra da je sud na pogrešan način ocijenio provedene dokaze i donio pogrešan zaključak da nema dokaza da su optuženici u “Poliklinici MMC” provodili medicinske zahvate potpomognute oplodnje jajnim stanicama druge žene.
Iz tužiteljstva poručuju i da je sud primijenio pogrešnu metodologiju i pristup ocjeni materijalnih dokaza te je, kako bi argumentirao svoje tvrdnje o nedokazanosti krivnje optuženih, selektivno cijenio samo ono što je išlo u prilog takvoj tvrdnji.
Podsjetimo da je tužiteljstvo Kurjaka i liječnike teretilo da su u razdoblju od 2000. do 2002. godine izvantjelesno oplodili pet pacijentica jajnim stanicama drugih žena bez njihova znanja.
Za Asima Kurjaka tužiteljstvo je tražilo da mu se dosudi četiri godine i osam mjeseci zatvora, a njegovoj supruzi dvije godine. Inače, Kurjak je već osuđivan, i to na osam mjeseci zatvora zbog smrti rodilje Dragice Ivankić, no nije završio iza rešetaka, jer je nastupila zastara.

Općinsko je državno odvjetništvo zbog bitne povrede odredaba kaznenog postupka i pogrešno utvrđenog činjeničnog stanja, podnijelo žalbu na presudu sutkinje Općinskog suda Sandre Bramberger Ostojić koja je zbog nedozvoljena presađivanja jajnih stanica, nepravomoćno oslobodila optužbi Asima Kurjaka (66), njegovu suprugu Biserku Funduk Kurjak (65), liječnicu Sanju Kuprešić i Ernesta Suchaneka.
Naime, DORH smatra da je sud na pogrešan način ocijenio provedene dokaze i donio pogrešan zaključak da nema dokaza da su optuženici u “Poliklinici MMC” provodili medicinske zahvate potpomognute oplodnje jajnim stanicama druge žene.
Iz tužiteljstva poručuju i da je sud primijenio pogrešnu metodologiju i pristup ocjeni materijalnih dokaza te je, kako bi argumentirao svoje tvrdnje o nedokazanosti krivnje optuženih, selektivno cijenio samo ono što je išlo u prilog takvoj tvrdnji.
Podsjetimo da je tužiteljstvo Kurjaka i liječnike teretilo da su u razdoblju od 2000. do 2002. godine izvantjelesno oplodili pet pacijentica jajnim stanicama drugih žena bez njihova znanja.
Za Asima Kurjaka tužiteljstvo je tražilo da mu se dosudi četiri godine i osam mjeseci zatvora, a njegovoj supruzi dvije godine. Inače, Kurjak je već osuđivan, i to na osam mjeseci zatvora zbog smrti rodilje Dragice Ivankić, no nije završio iza rešetaka, jer je nastupila zastara.
