Hrvatske vlasti, kako neslužbeno doznaje Jutarnji list, pomno istražuju slučaj posvajanja djece iz Konga zbog čega su u zatvoru u Zambiji završila četiri para iz Hrvatske, a osnovana je i radna skupina u kojoj su predstavnici Državnog odvjetništva Republike Hrvatske, Sigurnosno-obavještajne agencije i resornih ministarstava koja održava sastanke oko ovog slučaja.
Ono što smo doznali od naših izvora jest da posvojena djeca iz Konga imaju sve potrebne hrvatske papire. Upisana su u matične knjige, imaju hrvatski OiB, domovnice i putovnice. Sve hrvatske dokumente dobili su na temelju sudskih rješenja, piše Jutarnji.
Naime, hrvatski sud donio je rješenje o posvajanju na temelju odluke o posvajanju suda iz Konga, a onda su uz tu dokumentaciju djeca dobila sve potrebne osobne dokumente: preko Porezne uprave osobni identifikacijski broj, matični ured ih je upisao u maticu rođenih prema mjestu prebivališta roditelja-posvojitelja, a onda je Ministarstvo unutarnjih poslova izdalo domovnice i putovnice.
Ono što je po svemu sudeći sporno u cijeloj priči - zbog čega je i osnovana radna skupina u kojoj su uz DORH i SOA-u i predstavnici Ministarstva vanjskih i europskih poslova, Ministarstva unutarnjih poslova, Ministarstva rada, mirovinskog sustava, obitelji, socijalne politike i mladih, Ministarstva pravosuđa i uprave – jest to da prema potvrdi koju smo dobili iz Ministarstva obitelji, niti jedan od četiri para nije preko njih odradio posvojenje.
Dva su od četiri para upisana u službeni Registar potencijalnih posvojitelja.
Kongo je tek od 2019. potpisnik Konvencije o zaštiti djece i suradnji u vezi s međudržavnim posvojenjem, koja je kod njih na snagu stupila 2020.
Od stupanja na snagu Konvencije, potencijalni posvojitelji koji žele posvojiti dijete iz druge države ugovornice, ne obraćaju se izravno odnosno samostalno nadležnim tijelima druge države. Prema našim informacijama posvojitelji su rješenje o posvojenju dobili na sudu u Kongu.
Potencijalni posvojitelji koji žele posvojiti dijete iz druge države potpisnice Konvencije, nakon dovršenog postupka pred nadležnim centrom za socijalnu skrb radi utvrđivanja njihove podobnosti za posvojenje djeteta, podnose zahtjev za posvojenje Ministarstvu rada, mirovinskoga sustava, obitelji i socijalne politike. Zahtjevu koji se podnosi Ministarstvu, potencijalni posvojitelji moraju priložiti stručno mišljenje Centra za socijalnu skrb da su podobni i prikladni za posvojenje djeteta, ne starije od godinu dana.
Postupak je drugačiji za države koje nisu potpisnice Konvencije.
Nakon dovršenog postupka pred nadležnim centrom za socijalnu, samostalno se zahtjevom za posvojenje djeteta obraćaju nadležnim tijelima za posvojenje djece države iz koje žele posvojiti dijete. U međudržavnom postupku posvojenja djeteta moraju biti kumulativno ispunjene pretpostavke za posvojenje sukladno zakonodavstvu države podrijetla djeteta i sukladno zakonodavstvu države potencijalnih posvojitelja. Po okončanju postupka međudržavnog posvojenja djeteta posvojitelji moraju u Hrvatskoj zatražiti priznanje strane sudske odluke o posvojenju od nadležnog suda Hrvatske kako bi odluka o posvojenju imala pravne učinke u RH.
No, sve i da Kongo nije potpisnica Konvencije, članak 186. Obiteljskog zakona kaže da "ako su posvojitelj ili dijete strani državljani, posvojenje se može zasnovati samo uz prethodno odobrenje ministarstva nadležnog za poslove socijalne skrbi".
Hrvatski sud donio je rješenje o posvojenju na temelju rješenja suda iz Konga.

Hrvatske vlasti, kako neslužbeno doznaje Jutarnji list, pomno istražuju slučaj posvajanja djece iz Konga zbog čega su u zatvoru u Zambiji završila četiri para iz Hrvatske, a osnovana je i radna skupina u kojoj su predstavnici Državnog odvjetništva Republike Hrvatske, Sigurnosno-obavještajne agencije i resornih ministarstava koja održava sastanke oko ovog slučaja.
Ono što smo doznali od naših izvora jest da posvojena djeca iz Konga imaju sve potrebne hrvatske papire. Upisana su u matične knjige, imaju hrvatski OiB, domovnice i putovnice. Sve hrvatske dokumente dobili su na temelju sudskih rješenja, piše Jutarnji.
Naime, hrvatski sud donio je rješenje o posvajanju na temelju odluke o posvajanju suda iz Konga, a onda su uz tu dokumentaciju djeca dobila sve potrebne osobne dokumente: preko Porezne uprave osobni identifikacijski broj, matični ured ih je upisao u maticu rođenih prema mjestu prebivališta roditelja-posvojitelja, a onda je Ministarstvo unutarnjih poslova izdalo domovnice i putovnice.
Ono što je po svemu sudeći sporno u cijeloj priči - zbog čega je i osnovana radna skupina u kojoj su uz DORH i SOA-u i predstavnici Ministarstva vanjskih i europskih poslova, Ministarstva unutarnjih poslova, Ministarstva rada, mirovinskog sustava, obitelji, socijalne politike i mladih, Ministarstva pravosuđa i uprave – jest to da prema potvrdi koju smo dobili iz Ministarstva obitelji, niti jedan od četiri para nije preko njih odradio posvojenje.
Dva su od četiri para upisana u službeni Registar potencijalnih posvojitelja.
Kongo je tek od 2019. potpisnik Konvencije o zaštiti djece i suradnji u vezi s međudržavnim posvojenjem, koja je kod njih na snagu stupila 2020.
Od stupanja na snagu Konvencije, potencijalni posvojitelji koji žele posvojiti dijete iz druge države ugovornice, ne obraćaju se izravno odnosno samostalno nadležnim tijelima druge države. Prema našim informacijama posvojitelji su rješenje o posvojenju dobili na sudu u Kongu.
Potencijalni posvojitelji koji žele posvojiti dijete iz druge države potpisnice Konvencije, nakon dovršenog postupka pred nadležnim centrom za socijalnu skrb radi utvrđivanja njihove podobnosti za posvojenje djeteta, podnose zahtjev za posvojenje Ministarstvu rada, mirovinskoga sustava, obitelji i socijalne politike. Zahtjevu koji se podnosi Ministarstvu, potencijalni posvojitelji moraju priložiti stručno mišljenje Centra za socijalnu skrb da su podobni i prikladni za posvojenje djeteta, ne starije od godinu dana.
Postupak je drugačiji za države koje nisu potpisnice Konvencije.
Nakon dovršenog postupka pred nadležnim centrom za socijalnu, samostalno se zahtjevom za posvojenje djeteta obraćaju nadležnim tijelima za posvojenje djece države iz koje žele posvojiti dijete. U međudržavnom postupku posvojenja djeteta moraju biti kumulativno ispunjene pretpostavke za posvojenje sukladno zakonodavstvu države podrijetla djeteta i sukladno zakonodavstvu države potencijalnih posvojitelja. Po okončanju postupka međudržavnog posvojenja djeteta posvojitelji moraju u Hrvatskoj zatražiti priznanje strane sudske odluke o posvojenju od nadležnog suda Hrvatske kako bi odluka o posvojenju imala pravne učinke u RH.
No, sve i da Kongo nije potpisnica Konvencije, članak 186. Obiteljskog zakona kaže da "ako su posvojitelj ili dijete strani državljani, posvojenje se može zasnovati samo uz prethodno odobrenje ministarstva nadležnog za poslove socijalne skrbi".
Hrvatski sud donio je rješenje o posvojenju na temelju rješenja suda iz Konga.
