Europski sud za ljudska prava presudio je da je Hrvatska povrijedila pravo na poštovanje privatnog života učitelju srpske nacionalnosti iz Darde koji je dobio otkaz jer nije predavao na standardnom hrvatskom jeziku.
Sud je otpuštenom učitelju stoga dosudio 5.000 eura na ime naknade neimovinske štete te 850 eura za troškove postupka.
Učitelj srpskog podrijetla prigovarao je da mu je neopravdano prestao radni odnos učitelja u školi u Dardi zbog toga što nije predavao na standardnom hrvatskom jeziku. Škola je smatrala da nije bi podoban za osposobljavanje za predavanje na hrvatskom jeziku s obzirom na dob i radni staž jer je u vrijeme otkaza imao je 55 godina i 29 godina staža, izvijestio je ured hrvatske predstavnice pred sudom u Strasbourgu.
Europski sud je zaključio da je odluka o otkazu predstavljala miješanje u podnositeljev privatni život jer se temeljila na činjenici da je podnositelj zbog svoje dobi i dugogodišnjeg načina predavanja te zbog nemogućnosti prilagodbe radnom mjestu dobio otkaz, što po stavu tog suda čini dio fizičkog identiteta osobe, a fizički identitet je bitan aspekt privatnog života pojedinca.
Iako je odluka o otkazu bila zakonita, ona nije bila proporcionalna cilju koji se želio postići.
Sud je primijetio da iako su u relevantno vrijeme 1998./1999. škole morale nastavu izvoditi na hrvatskom standardnom jeziku, određene škole su izvodile nastavu ili dio nastave na manjinskim jezicima, dok je u predmetnoj školi usmena preporuka za predavanje na isključivo hrvatskom jeziku donesena samo mjesec dana prije inspekcije koja je prethodila podnositeljevom otkazu.
Ni jedan učitelj hrvatskog podrijetla nije bio podvrgnut inspekciji kako bi se utvrdilo jesu li izvodili nastavu na standardnom hrvatskom jeziku, već se inspekcija odnosila samo na učitelje srpske nacionalnosti.
Premda su odredbe o prosvjetnoj inspekciji omogućavale i blaže mjere, tj. ostavljanje određenog roka za ispravljanje nepravilnosti u radu, inspekcija je podnositelju odmah odredila najstrožu mjeru zabrane obavljanja posla.
Također, iako je u slučajevima otkaza o radu iz osobno uvjetovanih razloga bilo predviđeno dodatno obrazovanje ili osposobljavanje za drugo radno mjesto, škola je odbila to omogućiti, isključivo zbog podnositeljeve dobi i staža, a domaći sudovi nisu pružili dostatno i uvjerljivo objašnjenje zašto je dob podnositelja predstavljala nepremostivu prepreku za izvođenje nastave na standardnom hrvatskom jeziku.
Imajući u vidu sličnosti dvaju jezika, činjenicu da je podnositelj veći dio profesionalnog života živio i radio u Hrvatskoj te specifični poslijeratni kontekst istočnoslavonske regije, sud je sa šest glasova za i jednim protiv smatrao da je odluka o otkazu, bez pružanja mogućnosti osposobljavanja za održavanje nastave na hrvatskom jeziku, dovela do povrede Konvencije o zaštiti ljudskih prava.
Ova presuda još nije konačna, a postat će ukoliko niti jedna stranka u roku od tri mjeseca od donošenja iste ne podnese zahtjev velikom vijeću suda.

Europski sud za ljudska prava presudio je da je Hrvatska povrijedila pravo na poštovanje privatnog života učitelju srpske nacionalnosti iz Darde koji je dobio otkaz jer nije predavao na standardnom hrvatskom jeziku.
Sud je otpuštenom učitelju stoga dosudio 5.000 eura na ime naknade neimovinske štete te 850 eura za troškove postupka.
Učitelj srpskog podrijetla prigovarao je da mu je neopravdano prestao radni odnos učitelja u školi u Dardi zbog toga što nije predavao na standardnom hrvatskom jeziku. Škola je smatrala da nije bi podoban za osposobljavanje za predavanje na hrvatskom jeziku s obzirom na dob i radni staž jer je u vrijeme otkaza imao je 55 godina i 29 godina staža, izvijestio je ured hrvatske predstavnice pred sudom u Strasbourgu.
Europski sud je zaključio da je odluka o otkazu predstavljala miješanje u podnositeljev privatni život jer se temeljila na činjenici da je podnositelj zbog svoje dobi i dugogodišnjeg načina predavanja te zbog nemogućnosti prilagodbe radnom mjestu dobio otkaz, što po stavu tog suda čini dio fizičkog identiteta osobe, a fizički identitet je bitan aspekt privatnog života pojedinca.
Iako je odluka o otkazu bila zakonita, ona nije bila proporcionalna cilju koji se želio postići.
Sud je primijetio da iako su u relevantno vrijeme 1998./1999. škole morale nastavu izvoditi na hrvatskom standardnom jeziku, određene škole su izvodile nastavu ili dio nastave na manjinskim jezicima, dok je u predmetnoj školi usmena preporuka za predavanje na isključivo hrvatskom jeziku donesena samo mjesec dana prije inspekcije koja je prethodila podnositeljevom otkazu.
Ni jedan učitelj hrvatskog podrijetla nije bio podvrgnut inspekciji kako bi se utvrdilo jesu li izvodili nastavu na standardnom hrvatskom jeziku, već se inspekcija odnosila samo na učitelje srpske nacionalnosti.
Premda su odredbe o prosvjetnoj inspekciji omogućavale i blaže mjere, tj. ostavljanje određenog roka za ispravljanje nepravilnosti u radu, inspekcija je podnositelju odmah odredila najstrožu mjeru zabrane obavljanja posla.
Također, iako je u slučajevima otkaza o radu iz osobno uvjetovanih razloga bilo predviđeno dodatno obrazovanje ili osposobljavanje za drugo radno mjesto, škola je odbila to omogućiti, isključivo zbog podnositeljeve dobi i staža, a domaći sudovi nisu pružili dostatno i uvjerljivo objašnjenje zašto je dob podnositelja predstavljala nepremostivu prepreku za izvođenje nastave na standardnom hrvatskom jeziku.
Imajući u vidu sličnosti dvaju jezika, činjenicu da je podnositelj veći dio profesionalnog života živio i radio u Hrvatskoj te specifični poslijeratni kontekst istočnoslavonske regije, sud je sa šest glasova za i jednim protiv smatrao da je odluka o otkazu, bez pružanja mogućnosti osposobljavanja za održavanje nastave na hrvatskom jeziku, dovela do povrede Konvencije o zaštiti ljudskih prava.
Ova presuda još nije konačna, a postat će ukoliko niti jedna stranka u roku od tri mjeseca od donošenja iste ne podnese zahtjev velikom vijeću suda.
