Sucu zagrebačkog Trgovačkog suda Mihaelu Kovačiću određen je istražni zatvor zbog opasnosti od ponavljanja kaznenog djela u aferi fiktivnih stečajeva, a njegovih troje suradnika zatvoreno je i zbog opasnosti od utjecaja na svjedoke.
Pored Kovačića, zbog opasnosti od ponavljanja kaznenog djela i utjecaja na svjedoke istražni zatvor određen je upraviteljici Zajedničke pisarnice zagrebačkog Trgovačkog suda Aleksandri Mažić te stečajnom upravitelju Branku Petanjeku i njegovoj kćeri Ivi Petanjek, također stečajnoj upraviteljici, precizirao je za Hinu glasnogovornik zagrebačkog Županijskog suda Krešimir Devčić.
Kovačićev odvjetnik Vlado Kartelo je izjavio da je njegovom branjeniku određen istražni zatvor zbog opasnosti da bi na slobodi mogao ponoviti kazneno djelo, iako je i prije uhićenja od Državnog sudbenog vijeća (DSV) tražio razrješenje od 1. travnja.
“S obzirom da je već podnesen zahtjev za stegovno kažnjavanje, čekamo odluku DSV-a. Ako DSV odluči o privremenom udaljenju, tražit ćemo puštanje na slobodu jer neće postojati opasnost od ponavljanja kaznenog djela”, kazao je Kartelo.
Uskok tereti Kovačića, Mažić, oca i kćer Petanjek te još devetero osumnjičenika za stečajne malverzacije kojima su oštetili stečajne dužnike za više od 30 milijuna kuna. Među osumnjičenicima su i Kovačićeva supruga Ivanka, brat Jurica, sin Patrik, sestrin partner Krunoslav Haramustek, nećak sučeve supruge Ivan Prpić, ali i suprug upraviteljice sudske pisarnice Andrija Mažić, njezina majka Branka Rajković i brat Nenad Rajković.
Uskok je precizirao da je Kovačić, od svibnja 2009. do veljače 2021. kao predsjednik i sudac Trgovačkog suda u Sisku, a potom i kao sudac zagrebačkog Trgovačkog suda, zajedno sa stečajnim upraviteljima Petanjek i deset drugih okrivljenika koristio svoje ovlaštenje da odobrava isplatu novca vjerovnicima.
Pritom je Kovačić u stečajnim postupcima u kojima je bio zadužen, uz pomoć Aleksandre Mažić, sačinjavao zaključke i naloge kojima se računovodstvu trgovačkog suda odnosno javnim bilježnicima nalaže isplata novca stečajnih dužnika, prijenos novca stečajnih dužnika s računa sudskog ili javnobilježničkih depozita na njegove privatne bankovne račune kao i na račune ostalih okrivljenika, ali i na račune većeg broja s njima povezanih osoba i tvrtki uz korištenje lažnih identiteta.
Također se sumnja da su otac i kćer Petanjek kao stečajni upravitelji u većem broju stečajnih postupaka koristili svoja ovlaštenja raspolaganja novcem na bankovnim računima stečajnih dužnika, međutim ne radi isplate stvarnih vjerovnika i pokrivanja stvarnih troškova stečajnog postupka, već su taj novac doznačavali na račune javnobilježničkih depozita “radi daljnje razdiobe u zajedničku protupravnu korist”.
U nekoliko slučajeva su taj novac uplaćivali i na privatne račune okrivljenika i s njima povezanih osoba i tvrtki.
Okrivljenici i s njima povezane pravne i fizičke osobe su na taj način ostvarili protupravnu imovinsku korist od najmanje 20 milijuna kuna, dok su stečajni dužnici oštećeni za najmanje 22,5 milijuna kuna, precizirao je Uskok. Tužiteljstvo je nadodalo da je na Kovačićev račun isplaćeno najmanje 1,35 milijuna kuna, dok je u korist preostalih okrivljenika i s njima povezanih osoba i tvrtki isplaćeno najmanje 18,9 milijuna kuna.
Uskok je istaknuo da je od tog iznosa preko 10 milijuna kuna isplaćeno u korist sedam društava koja su osnovana, preuzeta ili korištena kako bi se isplatama preko njihovih računa prikrilo nezakonito porijeklo novca nezakonito isplaćenog na štetu imovine stečajnih dužnika.
Taj novac, dodalo je tužiteljstvo, okrivljenici su ulagali u kupnju nekretnina koje su potom prenosili u korist povezanih pravnih osoba, a kupovali su i vozila te vrijednosnice radi ostvarenja dobiti.
Među oštećenima su ukupno 23 tvrtke u stečaju, šest dioničkih društava i 17 društava s ograničenom odgovornošću, a iz izvora bliskih istrazi doznaje se da je među ostalima riječ o tvrtkama Željezara Sisak, Kutina-Kristal, Brodoremont, Proizvodnja-Regeneracija, NIK d.o.o., Pamučna predionica Glina, Zavod za poslovna istraživanja i Slavijatrans.

Sucu zagrebačkog Trgovačkog suda Mihaelu Kovačiću određen je istražni zatvor zbog opasnosti od ponavljanja kaznenog djela u aferi fiktivnih stečajeva, a njegovih troje suradnika zatvoreno je i zbog opasnosti od utjecaja na svjedoke.
Pored Kovačića, zbog opasnosti od ponavljanja kaznenog djela i utjecaja na svjedoke istražni zatvor određen je upraviteljici Zajedničke pisarnice zagrebačkog Trgovačkog suda Aleksandri Mažić te stečajnom upravitelju Branku Petanjeku i njegovoj kćeri Ivi Petanjek, također stečajnoj upraviteljici, precizirao je za Hinu glasnogovornik zagrebačkog Županijskog suda Krešimir Devčić.
Kovačićev odvjetnik Vlado Kartelo je izjavio da je njegovom branjeniku određen istražni zatvor zbog opasnosti da bi na slobodi mogao ponoviti kazneno djelo, iako je i prije uhićenja od Državnog sudbenog vijeća (DSV) tražio razrješenje od 1. travnja.
“S obzirom da je već podnesen zahtjev za stegovno kažnjavanje, čekamo odluku DSV-a. Ako DSV odluči o privremenom udaljenju, tražit ćemo puštanje na slobodu jer neće postojati opasnost od ponavljanja kaznenog djela”, kazao je Kartelo.
Uskok tereti Kovačića, Mažić, oca i kćer Petanjek te još devetero osumnjičenika za stečajne malverzacije kojima su oštetili stečajne dužnike za više od 30 milijuna kuna. Među osumnjičenicima su i Kovačićeva supruga Ivanka, brat Jurica, sin Patrik, sestrin partner Krunoslav Haramustek, nećak sučeve supruge Ivan Prpić, ali i suprug upraviteljice sudske pisarnice Andrija Mažić, njezina majka Branka Rajković i brat Nenad Rajković.
Uskok je precizirao da je Kovačić, od svibnja 2009. do veljače 2021. kao predsjednik i sudac Trgovačkog suda u Sisku, a potom i kao sudac zagrebačkog Trgovačkog suda, zajedno sa stečajnim upraviteljima Petanjek i deset drugih okrivljenika koristio svoje ovlaštenje da odobrava isplatu novca vjerovnicima.
Pritom je Kovačić u stečajnim postupcima u kojima je bio zadužen, uz pomoć Aleksandre Mažić, sačinjavao zaključke i naloge kojima se računovodstvu trgovačkog suda odnosno javnim bilježnicima nalaže isplata novca stečajnih dužnika, prijenos novca stečajnih dužnika s računa sudskog ili javnobilježničkih depozita na njegove privatne bankovne račune kao i na račune ostalih okrivljenika, ali i na račune većeg broja s njima povezanih osoba i tvrtki uz korištenje lažnih identiteta.
Također se sumnja da su otac i kćer Petanjek kao stečajni upravitelji u većem broju stečajnih postupaka koristili svoja ovlaštenja raspolaganja novcem na bankovnim računima stečajnih dužnika, međutim ne radi isplate stvarnih vjerovnika i pokrivanja stvarnih troškova stečajnog postupka, već su taj novac doznačavali na račune javnobilježničkih depozita “radi daljnje razdiobe u zajedničku protupravnu korist”.
U nekoliko slučajeva su taj novac uplaćivali i na privatne račune okrivljenika i s njima povezanih osoba i tvrtki.
Okrivljenici i s njima povezane pravne i fizičke osobe su na taj način ostvarili protupravnu imovinsku korist od najmanje 20 milijuna kuna, dok su stečajni dužnici oštećeni za najmanje 22,5 milijuna kuna, precizirao je Uskok. Tužiteljstvo je nadodalo da je na Kovačićev račun isplaćeno najmanje 1,35 milijuna kuna, dok je u korist preostalih okrivljenika i s njima povezanih osoba i tvrtki isplaćeno najmanje 18,9 milijuna kuna.
Uskok je istaknuo da je od tog iznosa preko 10 milijuna kuna isplaćeno u korist sedam društava koja su osnovana, preuzeta ili korištena kako bi se isplatama preko njihovih računa prikrilo nezakonito porijeklo novca nezakonito isplaćenog na štetu imovine stečajnih dužnika.
Taj novac, dodalo je tužiteljstvo, okrivljenici su ulagali u kupnju nekretnina koje su potom prenosili u korist povezanih pravnih osoba, a kupovali su i vozila te vrijednosnice radi ostvarenja dobiti.
Među oštećenima su ukupno 23 tvrtke u stečaju, šest dioničkih društava i 17 društava s ograničenom odgovornošću, a iz izvora bliskih istrazi doznaje se da je među ostalima riječ o tvrtkama Željezara Sisak, Kutina-Kristal, Brodoremont, Proizvodnja-Regeneracija, NIK d.o.o., Pamučna predionica Glina, Zavod za poslovna istraživanja i Slavijatrans.
