Dvadeset i četiri godine nakon počinjenja (ne)djela zlouporabe položaja i ovlasti te četrnaest godina nakon što je Županijsko državno odvjetništvo u Splitu podiglo optužnicu za ta djela protiv Andrije Renića, bivšeg direktora splitske podružnice Croatia banke, Marka Perića, bivšeg samostalnog referenta te banke, te Mate Grljušića, nekada direktora Gradske banke, odlukom splitskog Županijskog suda okončana je ova sudska trakavica, i to tako da nitko od trojice okrivljenih nije i neće snositi nikakve sankcije.

Renić zato što je u međuvremenu preminuo, a Perić i Grljušić zato što je nastupila zastara kaznenog progona.

Kako je Slobodna Dalmacija već pisala, u rujnu 2014. godine sva su trojica proglašena krivima. Renić i Perić tada su nepravomoćno osuđeni na po tri i pol godine zatvora, a Grljušić na godinu dana zbog poticanja na zlouporabu.

Renić i Perić bili su optuženi da su tijekom prve polovine 1997. godine, protivno Zakonu o bankama i internim aktima banke u kojoj su bili zaposleni, s računa štediše Ivana S., bez njegova znanja i odobrenja, isplatili tadašnjih 36 tisuća njemačkih maraka Mati B. Budući da on nije uspio vratiti ukupno 50 tisuća DEM glavnice i kamata u dogovorenom roku, devize nisu vraćene na račun Ivana S., čime su oštećeni i on i banka za protuvrijednost od 192.500 kuna. Druga točka optužnice teretila je Renića i Perića da su tijekom prve polovine 1997. godine napravili lažni ugovor kojim isti štediša Ivan S. daje Boži Č. zajam od 30 tisuća DEM uz rok otplate od 90 dana s kamatom od 15 posto.

Naravno, ovaj nije vratio novac u dogovorenom roku pa su Renić i Perić napravili novi ugovor prema kojem njihov drugi štediša, Pero K., daje Boži zajam od 30.100 maraka uz isti rok i kamatu, sve bez znanja vlasnika deviznog računa. Tim novcem zatvorili su prvo dugovanja za račun štediše Ivana S. Međutim, kada im je Božo dao 30.000 maraka da vrate na račun Pere K., uplatili su samo manji dio, a ostatak novca u protuvrijednosti od 126.564 kune zadržali su za sebe, oštetivši Peru K. i banku.

U prosincu te iste godine, namjeravajući pribaviti novac za Matu Grljušića, odobrili su prijenos 70.000 kuna s kunskog računa Ivana S. bez njegova odobrenja. Novac je išao na račun u vlasništvu "Lavčević-inženjeringa" d.d. Split, a služio je kao dio kupoprodajne cijene za poslovni prostor u Bihaćkoj ulici na Grljušićevo ime. Taj novac nije vraćen Ivanu S.

Novac nisu vratili

Vrhovni je sud tu presudu splitskog Županijskog suda pet godina poslije, u listopadu 2019. godine, djelomično preinačio, a djelomično ukinuo, tako da je "na životu" ostala jedino treća točka optužnice u odnosu na Perića i Grljušića jer je, kako smo već spomenuli, Renić u međuvremenu preminuo.

Sudac splitskog Županijskog suda Damir Romac je, međutim, pripremajući se za zakazivanje novog suđenja, utvrdio da je nastupila zastara kaznenog progona.

- Za kazneno djelo koje se okrivljenicima Marku Periću i Mati Grljušiću stavlja na teret propisana je kazna zatvora u trajanju od jedne do deset godina. Uzevši u obzir zapriječenu kaznu, kazneni progon za kazneno djelo zlouporabe položaja i ovlasti zastarijeva nakon proteka dvadeset godina. U odnosu na kaznena djela iz točke 3. optužnice, koja su prema činjeničnom opisu počinjena tijekom prosinca 1997., zastara bi nastupila protekom prosinca 2017. Međutim, kako je u ovom postupku donesena prvostupanjska presuda 17. rujna 2014. godine, dakle prije nastupa zastare, to se zastara kaznenog progona produljuje za dvije godine, tako da je zastara za predmetna kaznena djela nastupila protekom prosinca 2019. godine. Stoga je nesporno da, u odnosu na kaznena djela zlouporabe položaja i ovlasti i poticanja na zlouporabu položaja i ovlasti, postoje smetnje za nastavak postupka - naveo je u rješenju sudac Romac.

Oštećeni Ivan S. i Croatia banka d.d. Zagreb sudskim su rješenjem upućeni da svoj novac traže u parničnom postupku.

Dvadeset i četiri godine nakon počinjenja (ne)djela zlouporabe položaja i ovlasti te četrnaest godina nakon što je Županijsko državno odvjetništvo u Splitu podiglo optužnicu za ta djela protiv Andrije Renića, bivšeg direktora splitske podružnice Croatia banke, Marka Perića, bivšeg samostalnog referenta te banke, te Mate Grljušića, nekada direktora Gradske banke, odlukom splitskog Županijskog suda okončana je ova sudska trakavica, i to tako da nitko od trojice okrivljenih nije i neće snositi nikakve sankcije.

Renić zato što je u međuvremenu preminuo, a Perić i Grljušić zato što je nastupila zastara kaznenog progona.

Kako je Slobodna Dalmacija već pisala, u rujnu 2014. godine sva su trojica proglašena krivima. Renić i Perić tada su nepravomoćno osuđeni na po tri i pol godine zatvora, a Grljušić na godinu dana zbog poticanja na zlouporabu.

Renić i Perić bili su optuženi da su tijekom prve polovine 1997. godine, protivno Zakonu o bankama i internim aktima banke u kojoj su bili zaposleni, s računa štediše Ivana S., bez njegova znanja i odobrenja, isplatili tadašnjih 36 tisuća njemačkih maraka Mati B. Budući da on nije uspio vratiti ukupno 50 tisuća DEM glavnice i kamata u dogovorenom roku, devize nisu vraćene na račun Ivana S., čime su oštećeni i on i banka za protuvrijednost od 192.500 kuna. Druga točka optužnice teretila je Renića i Perića da su tijekom prve polovine 1997. godine napravili lažni ugovor kojim isti štediša Ivan S. daje Boži Č. zajam od 30 tisuća DEM uz rok otplate od 90 dana s kamatom od 15 posto.

Naravno, ovaj nije vratio novac u dogovorenom roku pa su Renić i Perić napravili novi ugovor prema kojem njihov drugi štediša, Pero K., daje Boži zajam od 30.100 maraka uz isti rok i kamatu, sve bez znanja vlasnika deviznog računa. Tim novcem zatvorili su prvo dugovanja za račun štediše Ivana S. Međutim, kada im je Božo dao 30.000 maraka da vrate na račun Pere K., uplatili su samo manji dio, a ostatak novca u protuvrijednosti od 126.564 kune zadržali su za sebe, oštetivši Peru K. i banku.

U prosincu te iste godine, namjeravajući pribaviti novac za Matu Grljušića, odobrili su prijenos 70.000 kuna s kunskog računa Ivana S. bez njegova odobrenja. Novac je išao na račun u vlasništvu "Lavčević-inženjeringa" d.d. Split, a služio je kao dio kupoprodajne cijene za poslovni prostor u Bihaćkoj ulici na Grljušićevo ime. Taj novac nije vraćen Ivanu S.

Novac nisu vratili

Vrhovni je sud tu presudu splitskog Županijskog suda pet godina poslije, u listopadu 2019. godine, djelomično preinačio, a djelomično ukinuo, tako da je "na životu" ostala jedino treća točka optužnice u odnosu na Perića i Grljušića jer je, kako smo već spomenuli, Renić u međuvremenu preminuo.

Sudac splitskog Županijskog suda Damir Romac je, međutim, pripremajući se za zakazivanje novog suđenja, utvrdio da je nastupila zastara kaznenog progona.

- Za kazneno djelo koje se okrivljenicima Marku Periću i Mati Grljušiću stavlja na teret propisana je kazna zatvora u trajanju od jedne do deset godina. Uzevši u obzir zapriječenu kaznu, kazneni progon za kazneno djelo zlouporabe položaja i ovlasti zastarijeva nakon proteka dvadeset godina. U odnosu na kaznena djela iz točke 3. optužnice, koja su prema činjeničnom opisu počinjena tijekom prosinca 1997., zastara bi nastupila protekom prosinca 2017. Međutim, kako je u ovom postupku donesena prvostupanjska presuda 17. rujna 2014. godine, dakle prije nastupa zastare, to se zastara kaznenog progona produljuje za dvije godine, tako da je zastara za predmetna kaznena djela nastupila protekom prosinca 2019. godine. Stoga je nesporno da, u odnosu na kaznena djela zlouporabe položaja i ovlasti i poticanja na zlouporabu položaja i ovlasti, postoje smetnje za nastavak postupka - naveo je u rješenju sudac Romac.

Oštećeni Ivan S. i Croatia banka d.d. Zagreb sudskim su rješenjem upućeni da svoj novac traže u parničnom postupku.
