Na Županijskom sudu u Varaždinu donesena je pravomoćna presuda prema kojoj je ugovor za kredite u švicarskim francima proglašelen nepoštenim i ništetnim, izvijestili su iz udruge Franak.

-S velikim zadovoljstvom objavljujemo da je konačno donesena i prva pravomoćna presuda o ništetnosti CHF ugovora Županijski sud u Varaždinu je, prema javno objavljenim podacima, presudom Gž-115/2020 odbio 17. rujna 2020. žalbu Addiko banke te je potvrdio presudu Općinskog građanskog suda u Zagrebu kojom je utvrđeno kako su ništetna dva ugovora o kreditu u valuti CHF - navode u Franku.

Presudu Općinskog građanskog suda u Zagrebu potvrdilo je varaždinsko vijeće u sastavu Veljko Kučeković, Damir Ronić i Tatjana Kukić. Tužitelja je zastupao splitski odvjetnik Srđan Kalebota, koji je dobio već čitav niz pozitivnih presuda na sudovima u Splitu i Zagrebu te njemu i tužitelju čestitamo na iznimnom i važnom uspjehu za sve potrošače.

Osim utvrđene ništetnosti, sud je dosudio tužitelju i 187.000 kuna preplaćenih kamata. Naime, tužitelj nije tražio kompletan novčani iznos koji ima pravo dobiti na temelju ništetnosti ugovora, jer je tako izbjegao potencijalne velike troškove, pa će novom tužbom zatražiti ostatak novca koji mu Addiko banka mora platiti na temelju apsolutne ništetnosti cijelog ugovora, priopćio je Franak.

Temeljni razlozi za utvrđenje ništetnosti ugovora, iostiče se dalje, prema presudi Općinskog građanskog suda u Zagrebu bili su sljedeći:

  1. Ništetan je glavni predmet ugovora, a to je valuta kredita CHF.

  2. Ništetna je cijena kredita, a to je kamatna stopa koja se mijenjala samovoljnom odlukom banke.

  3. Ugovor je sagledan kao cjelina te su ta dva bitna sastojka ugovora u kombinaciji sa anuitetnom otplatom kredita uzrokovala znatnu neravnotežu prava i obveza, sve na štetu tužitelja.

Detalje ove značajne presude Županijskog suda udruga Franak namjerava objaviti u narednim danima čim je tužitelj zaprimi s varaždinskog suda koji ju je otpremio 30. rujna 2020.

U Franku vrlo značajnim smtraju i to što je u ovom predmetu primijenjeno pravo Europske unije i praksa Suda EU poglavito iz predmeta C-118/17, Dunai, gdje je Sud unije izričito i nedvojbeno naveo kako ugovori s ništetnom valutom kao glavnim predmetom tih ugovora po mišljenju Suda EU svakako jesu ništetni i ne mogu opstati na snazi. Sud unije posebno ističe interes potrošača te navodi kako se kod nepoštenosti glavnog predmeta ugovora on može održati na snazi smo ako je potrošaču u interesu da ugovor ne bude u cijelosti ništetan.

-U hrvatskome slučaju franak svim potrošačima koji su redovno otplaćivali kredite apsolutno odgovara utvrđenje ništetnosti kompletnih ugovora pogotovo ukoliko su im otkazani ugovori o kreditima i zbog toga im se provodi ovrha.

Očekujemo da se u sljedećih godinu dana konačno razriješe sva preostala pravna pitanja u slučaju franak, prije svega to je pitanje ništetnosti ugovora, kao i pitanje restitucije za konvertirane kredite.

S velikim optimizmom očekujemo nastavak sudske bitke sve do konačne pobjede, i do konačne ništetnosti CHF ugovora potvrđene na Vrhovnome sudu RH - kažu u udruzi Franak.

Na Županijskom sudu u Varaždinu donesena je pravomoćna presuda prema kojoj je ugovor za kredite u švicarskim francima proglašelen nepoštenim i ništetnim, izvijestili su iz udruge Franak.

-S velikim zadovoljstvom objavljujemo da je konačno donesena i prva pravomoćna presuda o ništetnosti CHF ugovora Županijski sud u Varaždinu je, prema javno objavljenim podacima, presudom Gž-115/2020 odbio 17. rujna 2020. žalbu Addiko banke te je potvrdio presudu Općinskog građanskog suda u Zagrebu kojom je utvrđeno kako su ništetna dva ugovora o kreditu u valuti CHF - navode u Franku.

Presudu Općinskog građanskog suda u Zagrebu potvrdilo je varaždinsko vijeće u sastavu Veljko Kučeković, Damir Ronić i Tatjana Kukić. Tužitelja je zastupao splitski odvjetnik Srđan Kalebota, koji je dobio već čitav niz pozitivnih presuda na sudovima u Splitu i Zagrebu te njemu i tužitelju čestitamo na iznimnom i važnom uspjehu za sve potrošače.

Osim utvrđene ništetnosti, sud je dosudio tužitelju i 187.000 kuna preplaćenih kamata. Naime, tužitelj nije tražio kompletan novčani iznos koji ima pravo dobiti na temelju ništetnosti ugovora, jer je tako izbjegao potencijalne velike troškove, pa će novom tužbom zatražiti ostatak novca koji mu Addiko banka mora platiti na temelju apsolutne ništetnosti cijelog ugovora, priopćio je Franak.

Temeljni razlozi za utvrđenje ništetnosti ugovora, iostiče se dalje, prema presudi Općinskog građanskog suda u Zagrebu bili su sljedeći:

  1. Ništetan je glavni predmet ugovora, a to je valuta kredita CHF.

  2. Ništetna je cijena kredita, a to je kamatna stopa koja se mijenjala samovoljnom odlukom banke.

  3. Ugovor je sagledan kao cjelina te su ta dva bitna sastojka ugovora u kombinaciji sa anuitetnom otplatom kredita uzrokovala znatnu neravnotežu prava i obveza, sve na štetu tužitelja.

Detalje ove značajne presude Županijskog suda udruga Franak namjerava objaviti u narednim danima čim je tužitelj zaprimi s varaždinskog suda koji ju je otpremio 30. rujna 2020.

U Franku vrlo značajnim smtraju i to što je u ovom predmetu primijenjeno pravo Europske unije i praksa Suda EU poglavito iz predmeta C-118/17, Dunai, gdje je Sud unije izričito i nedvojbeno naveo kako ugovori s ništetnom valutom kao glavnim predmetom tih ugovora po mišljenju Suda EU svakako jesu ništetni i ne mogu opstati na snazi. Sud unije posebno ističe interes potrošača te navodi kako se kod nepoštenosti glavnog predmeta ugovora on može održati na snazi smo ako je potrošaču u interesu da ugovor ne bude u cijelosti ništetan.

-U hrvatskome slučaju franak svim potrošačima koji su redovno otplaćivali kredite apsolutno odgovara utvrđenje ništetnosti kompletnih ugovora pogotovo ukoliko su im otkazani ugovori o kreditima i zbog toga im se provodi ovrha.

Očekujemo da se u sljedećih godinu dana konačno razriješe sva preostala pravna pitanja u slučaju franak, prije svega to je pitanje ništetnosti ugovora, kao i pitanje restitucije za konvertirane kredite.

S velikim optimizmom očekujemo nastavak sudske bitke sve do konačne pobjede, i do konačne ništetnosti CHF ugovora potvrđene na Vrhovnome sudu RH - kažu u udruzi Franak.

U Varaždinu donesena prva pravomoćna presuda o ništetnosti kredita u "švicarcima"; sud tužitelju dodijelio i 187. 000 kuna preplaćenih kamata

Na Županijskom sudu u Varaždinu donesena je pravomoćna presuda prema kojoj je ugovor za kredite u švicarskim francima proglašelen nepoštenim i ništetnim, izvijestili su iz udruge Franak.

-S velikim zadovoljstvom objavljujemo da je konačno donesena i prva pravomoćna presuda o ništetnosti CHF ugovora Županijski sud u Varaždinu je, prema javno objavljenim podacima, presudom Gž-115/2020 odbio 17. rujna 2020. žalbu Addiko banke te je potvrdio presudu Općinskog građanskog suda u Zagrebu kojom je utvrđeno kako su ništetna dva ugovora o kreditu u valuti CHF - navode u Franku.

Presudu Općinskog građanskog suda u Zagrebu potvrdilo je varaždinsko vijeće u sastavu Veljko Kučeković, Damir Ronić i Tatjana Kukić. Tužitelja je zastupao splitski odvjetnik Srđan Kalebota, koji je dobio već čitav niz pozitivnih presuda na sudovima u Splitu i Zagrebu te njemu i tužitelju čestitamo na iznimnom i važnom uspjehu za sve potrošače.

Osim utvrđene ništetnosti, sud je dosudio tužitelju i 187.000 kuna preplaćenih kamata. Naime, tužitelj nije tražio kompletan novčani iznos koji ima pravo dobiti na temelju ništetnosti ugovora, jer je tako izbjegao potencijalne velike troškove, pa će novom tužbom zatražiti ostatak novca koji mu Addiko banka mora platiti na temelju apsolutne ništetnosti cijelog ugovora, priopćio je Franak.

Temeljni razlozi za utvrđenje ništetnosti ugovora, iostiče se dalje, prema presudi Općinskog građanskog suda u Zagrebu bili su sljedeći:

  1. Ništetan je glavni predmet ugovora, a to je valuta kredita CHF.

  2. Ništetna je cijena kredita, a to je kamatna stopa koja se mijenjala samovoljnom odlukom banke.

  3. Ugovor je sagledan kao cjelina te su ta dva bitna sastojka ugovora u kombinaciji sa anuitetnom otplatom kredita uzrokovala znatnu neravnotežu prava i obveza, sve na štetu tužitelja.

Detalje ove značajne presude Županijskog suda udruga Franak namjerava objaviti u narednim danima čim je tužitelj zaprimi s varaždinskog suda koji ju je otpremio 30. rujna 2020.

U Franku vrlo značajnim smtraju i to što je u ovom predmetu primijenjeno pravo Europske unije i praksa Suda EU poglavito iz predmeta C-118/17, Dunai, gdje je Sud unije izričito i nedvojbeno naveo kako ugovori s ništetnom valutom kao glavnim predmetom tih ugovora po mišljenju Suda EU svakako jesu ništetni i ne mogu opstati na snazi. Sud unije posebno ističe interes potrošača te navodi kako se kod nepoštenosti glavnog predmeta ugovora on može održati na snazi smo ako je potrošaču u interesu da ugovor ne bude u cijelosti ništetan.

-U hrvatskome slučaju franak svim potrošačima koji su redovno otplaćivali kredite apsolutno odgovara utvrđenje ništetnosti kompletnih ugovora pogotovo ukoliko su im otkazani ugovori o kreditima i zbog toga im se provodi ovrha.

Očekujemo da se u sljedećih godinu dana konačno razriješe sva preostala pravna pitanja u slučaju franak, prije svega to je pitanje ništetnosti ugovora, kao i pitanje restitucije za konvertirane kredite.

S velikim optimizmom očekujemo nastavak sudske bitke sve do konačne pobjede, i do konačne ništetnosti CHF ugovora potvrđene na Vrhovnome sudu RH - kažu u udruzi Franak.
