Zbog  kaznenog djela lažnog prikazivanja činjenica i dovođenja druge osobe u zabludu, turistički tehničar N.K. (34) iz Krapinskih toplica, nepravomoćnom je presudom Općinskog suda u Dubrovniku osuđen na devet mjeseci zatvora, a osuda je preinačena u uvjetnu s rokom kušnje od tri godine.

Zagorac je dobro i prošao jer je dokaznim postupkom utvrđeno kako je još tijekom studenog 2016. godine u namjeri da stekne nepripadnu imovinsku korist, vlasniku Facebook stranice Online zalagaonica Dubrovnik A.K. lažno predočio da je upravo on vlasnik dva stana u Ulici Andrije Hebranga. Iako je tu bio u statusu podstanara, lažno je tvrdio kako je upravo on "vlasnik i svih stvari u stanovima osim televizora" te da je pravi vlasnik naš sugrađanin V.M.

Tako je vlasniku spomenute FB stranice ponudio na prodaju dvije perilice za rublje, jedan televizor, dva klima uređaja, kauč na rasklapanje, dvije kompletne kuhinje, stol i tri stolice te jednu komodu i dva ormara, sve za samo 12 tisuća kuna. Vlasnik FB-stranice mu je povjerovao te mu je 25. studenog 2016. godine u jednom caffe baru na Putu Iva Vojnovića isplatio traženi iznos, nakon čega mu je Zagorac dao ključeve stanova kako bi mogao preuzeti prodane stvari iz njih.

Nešto kasnije, istog dana mu je ponudio prodaju i dva mobitela marke "iPhone 7" za 5 tisuća kuna. Međutim, N.K. je i ovaj put lažno rekao kako ih A.K., koristeći pečat njegovog trgovačkog društva, može preuzeti kada dođe u T-com centar, ali mu nije rekao kako ima dug od čak 20 tisuća kuna prema tom teleoperateru i da mu nikakvi mobiteli neće biti isporučeni.

Ipak, slatkorječivi Zagorac je uspio uvjeriti vlasnik FB stranice koji mu je isplatio 5 tisuća kuna. Dan kasnije, ohrabren povoljnim tijekom 'pregovora', Krapinac je SMS- porukom kupcu ponudio još dva mobitela, ovaj put marke Samsung za 4.000 kuna, pri čemu je našeg sugrađanina lažima uspio uvjeriti kako će mu ih predati sutradan njegovom prijatelju u Zagrebu.

A.K. mu je i to povjerovao te je na račun njegove izvanbračne supruge L.P. uplatio 4.000 kuna, ali mu Zagorac nije predao dogovorene mobitele. Štoviše, vlasnik FB zalagaonice nije preuzeo ni plaćene stvari iz stanova jer je doznao kako one uopće nisu vlasništvo osobe koja mu ih je prodala, nikad mu ne vrativši novac.

Okrivljeni je na sudskoj raspravi izjavio kako se smatra krivim te da je suglasan s predloženom kaznom i postavljenim imovinsko- pravnim zahtjevom oštećenika za povrat 19 tisuća kuna. No, zamolio je dulji rok za naknadu nastale štete jer ima troje malodobne djece, od kojih je jedno novorođenče. Iznoseći obranu, na samom početku dokaznog postupka u cijelosti je priznao počinjenje kaznenog djela te izjavio da mu je žao zbog svega što je učinio.

Zbog  kaznenog djela lažnog prikazivanja činjenica i dovođenja druge osobe u zabludu, turistički tehničar N.K. (34) iz Krapinskih toplica, nepravomoćnom je presudom Općinskog suda u Dubrovniku osuđen na devet mjeseci zatvora, a osuda je preinačena u uvjetnu s rokom kušnje od tri godine.

Zagorac je dobro i prošao jer je dokaznim postupkom utvrđeno kako je još tijekom studenog 2016. godine u namjeri da stekne nepripadnu imovinsku korist, vlasniku Facebook stranice Online zalagaonica Dubrovnik A.K. lažno predočio da je upravo on vlasnik dva stana u Ulici Andrije Hebranga. Iako je tu bio u statusu podstanara, lažno je tvrdio kako je upravo on "vlasnik i svih stvari u stanovima osim televizora" te da je pravi vlasnik naš sugrađanin V.M.

Tako je vlasniku spomenute FB stranice ponudio na prodaju dvije perilice za rublje, jedan televizor, dva klima uređaja, kauč na rasklapanje, dvije kompletne kuhinje, stol i tri stolice te jednu komodu i dva ormara, sve za samo 12 tisuća kuna. Vlasnik FB-stranice mu je povjerovao te mu je 25. studenog 2016. godine u jednom caffe baru na Putu Iva Vojnovića isplatio traženi iznos, nakon čega mu je Zagorac dao ključeve stanova kako bi mogao preuzeti prodane stvari iz njih.

Nešto kasnije, istog dana mu je ponudio prodaju i dva mobitela marke "iPhone 7" za 5 tisuća kuna. Međutim, N.K. je i ovaj put lažno rekao kako ih A.K., koristeći pečat njegovog trgovačkog društva, može preuzeti kada dođe u T-com centar, ali mu nije rekao kako ima dug od čak 20 tisuća kuna prema tom teleoperateru i da mu nikakvi mobiteli neće biti isporučeni.

Ipak, slatkorječivi Zagorac je uspio uvjeriti vlasnik FB stranice koji mu je isplatio 5 tisuća kuna. Dan kasnije, ohrabren povoljnim tijekom 'pregovora', Krapinac je SMS- porukom kupcu ponudio još dva mobitela, ovaj put marke Samsung za 4.000 kuna, pri čemu je našeg sugrađanina lažima uspio uvjeriti kako će mu ih predati sutradan njegovom prijatelju u Zagrebu.

A.K. mu je i to povjerovao te je na račun njegove izvanbračne supruge L.P. uplatio 4.000 kuna, ali mu Zagorac nije predao dogovorene mobitele. Štoviše, vlasnik FB zalagaonice nije preuzeo ni plaćene stvari iz stanova jer je doznao kako one uopće nisu vlasništvo osobe koja mu ih je prodala, nikad mu ne vrativši novac.

Okrivljeni je na sudskoj raspravi izjavio kako se smatra krivim te da je suglasan s predloženom kaznom i postavljenim imovinsko- pravnim zahtjevom oštećenika za povrat 19 tisuća kuna. No, zamolio je dulji rok za naknadu nastale štete jer ima troje malodobne djece, od kojih je jedno novorođenče. Iznoseći obranu, na samom početku dokaznog postupka u cijelosti je priznao počinjenje kaznenog djela te izjavio da mu je žao zbog svega što je učinio.
