Šezdesetdvogodišnjakinja iz Pertha izborila je pravo na "vađenje" sperme iz tijela svoga preminulog supruga. No spermom neće moći učiniti ništa jer je posthumna oplodnja zabranjena u Zapadnoj Australiji - piše Iva Badnjak za Jutarnji list. 

Žena je, naime, podnijela hitni zahtjev sudu nakon smrti svoga 61-godišnjeg supruga krajem prošle godine, nakon što bolnica nije odmah stavila na raspolaganje "imenovanog službenika" koji bi obradio zahtjev da se sperma ukloni iz tijela njezina muža i pohrani.

Par je bio u braku više od 40 godina, a posljednje četiri godine proveli su intenzivno planirajući još jedno dijete nakon što je njihovo dvoje djece tragično umrlo. Njihova 29-godišnja kći utopila se u rijeci 2013., a šest godina poslije u prometnoj nesreći poginuo im je 35-godišnji sin. Par je nakon sinovljeve smrti posjetio kliniku za liječenje neplodnosti u nadi da će začeti još jedno dijete.

Testiranje je pokazalo da žena ne može imati djecu zbog svoje dobi, no sperma njezina supruga bila je "prikladna za začeće". Uporni u svojem naumu da imaju dijete, krenuli su u potragu za surogat-majkom. Kako je ispričala udovica tijekom hitnog saslušanja 18. prosinca, njezina 20-godišnja rođakinja na Filipinima je pristala biti surogat-majka.

Par je vjerovao da filipinski zakoni zahtijevaju da oni neko vrijeme žive u zemlji. No, njihovo preseljenje u zemlju jugoistočne Azije neprestano je odgađano. Prvo zbog pandemije, a zatim zbog radnih obveza i smrti svekrve.

Nakon što je čula tragičnu ispovijest i pokušaj para da začne dijete, sutkinja Vrhovnog suda Zapadne Australije Fiona Seaward odobrila je ženi dopuštenje za vađenje sperme. "Nalog je ograničen na dopuštanje uklanjanja spermija i ne predstavlja dopuštenje da podnositelj zahtjeva koristi spermatozoide ni na koji način", stoji u presudi. Žena će morati zatražiti poseban sudski nalog kako bi mogla koristiti suprugovu spermu.

Profesor reproduktivne medicine pri Sveučilištu Zapadne Australije Roger Hart rekao je za The Australian da je ovaj slučaj pokrenuo nekoliko etičkih razmatranja. "Tu postoji niz etičkih izazova. S medicinske točke gledišta, sve je to izvedivo, ali ponekad se moramo zapitati je li to prava stvar. Upitno je kakva je kvaliteta posthumne sperme. Nema jamstva da će sperma biti održiva ili prikladna za oplodnju", izjavio je profesor Hart za australske novine, dodajući da djeca začeta spermom starijih muškaraca imaju veći rizik za razvoj autizma, shizofrenije i manične depresije.

Posthumna izvantjelesna oplodnja zakonom je dopuštena u Portugalu, Belgiji, Danskoj, Češkoj i Španjolskoj. U Francuskoj, Njemačkoj i Austriji nije dopuštena, ali postoje primjeri sudskih presuda u korist žena.

U novije vrijeme najpoznatiji je slučaj udovice Alexa Pullina, preminulog australskog olimpijca. Ellidy Pullin začela je postupkom medicinski potpomognute oplodnje posthumnim uzimanjem sperme supruga. Rodila je zdravu djevojčicu 15 mjeseci nakon smrti olimpijca - piše Jutarnji list.

Šezdesetdvogodišnjakinja iz Pertha izborila je pravo na "vađenje" sperme iz tijela svoga preminulog supruga. No spermom neće moći učiniti ništa jer je posthumna oplodnja zabranjena u Zapadnoj Australiji - piše Iva Badnjak za Jutarnji list. 

Žena je, naime, podnijela hitni zahtjev sudu nakon smrti svoga 61-godišnjeg supruga krajem prošle godine, nakon što bolnica nije odmah stavila na raspolaganje "imenovanog službenika" koji bi obradio zahtjev da se sperma ukloni iz tijela njezina muža i pohrani.

Par je bio u braku više od 40 godina, a posljednje četiri godine proveli su intenzivno planirajući još jedno dijete nakon što je njihovo dvoje djece tragično umrlo. Njihova 29-godišnja kći utopila se u rijeci 2013., a šest godina poslije u prometnoj nesreći poginuo im je 35-godišnji sin. Par je nakon sinovljeve smrti posjetio kliniku za liječenje neplodnosti u nadi da će začeti još jedno dijete.

Testiranje je pokazalo da žena ne može imati djecu zbog svoje dobi, no sperma njezina supruga bila je "prikladna za začeće". Uporni u svojem naumu da imaju dijete, krenuli su u potragu za surogat-majkom. Kako je ispričala udovica tijekom hitnog saslušanja 18. prosinca, njezina 20-godišnja rođakinja na Filipinima je pristala biti surogat-majka.

Par je vjerovao da filipinski zakoni zahtijevaju da oni neko vrijeme žive u zemlji. No, njihovo preseljenje u zemlju jugoistočne Azije neprestano je odgađano. Prvo zbog pandemije, a zatim zbog radnih obveza i smrti svekrve.

Nakon što je čula tragičnu ispovijest i pokušaj para da začne dijete, sutkinja Vrhovnog suda Zapadne Australije Fiona Seaward odobrila je ženi dopuštenje za vađenje sperme. "Nalog je ograničen na dopuštanje uklanjanja spermija i ne predstavlja dopuštenje da podnositelj zahtjeva koristi spermatozoide ni na koji način", stoji u presudi. Žena će morati zatražiti poseban sudski nalog kako bi mogla koristiti suprugovu spermu.

Profesor reproduktivne medicine pri Sveučilištu Zapadne Australije Roger Hart rekao je za The Australian da je ovaj slučaj pokrenuo nekoliko etičkih razmatranja. "Tu postoji niz etičkih izazova. S medicinske točke gledišta, sve je to izvedivo, ali ponekad se moramo zapitati je li to prava stvar. Upitno je kakva je kvaliteta posthumne sperme. Nema jamstva da će sperma biti održiva ili prikladna za oplodnju", izjavio je profesor Hart za australske novine, dodajući da djeca začeta spermom starijih muškaraca imaju veći rizik za razvoj autizma, shizofrenije i manične depresije.

Posthumna izvantjelesna oplodnja zakonom je dopuštena u Portugalu, Belgiji, Danskoj, Češkoj i Španjolskoj. U Francuskoj, Njemačkoj i Austriji nije dopuštena, ali postoje primjeri sudskih presuda u korist žena.

U novije vrijeme najpoznatiji je slučaj udovice Alexa Pullina, preminulog australskog olimpijca. Ellidy Pullin začela je postupkom medicinski potpomognute oplodnje posthumnim uzimanjem sperme supruga. Rodila je zdravu djevojčicu 15 mjeseci nakon smrti olimpijca - piše Jutarnji list.

Šezdesetdvogodišnjakinja iz Pertha izborila je pravo na "vađenje" sperme iz tijela svoga preminulog supruga. No spermom neće moći učiniti ništa jer je posthumna oplodnja zabranjena u Zapadnoj Australiji - piše Iva Badnjak za Jutarnji list. 

Žena je, naime, podnijela hitni zahtjev sudu nakon smrti svoga 61-godišnjeg supruga krajem prošle godine, nakon što bolnica nije odmah stavila na raspolaganje "imenovanog službenika" koji bi obradio zahtjev da se sperma ukloni iz tijela njezina muža i pohrani.

Par je bio u braku više od 40 godina, a posljednje četiri godine proveli su intenzivno planirajući još jedno dijete nakon što je njihovo dvoje djece tragično umrlo. Njihova 29-godišnja kći utopila se u rijeci 2013., a šest godina poslije u prometnoj nesreći poginuo im je 35-godišnji sin.
