Nakon što je talijanska tvrtka NiVi, u ime tamošnjeg koncesionara autocesta, Autostrade per l’Italia, samo u prošloj godini poslala čak 3.996 zahtjeva za plaćanjem kazni zbog navodnog neplaćanja cestarina na adrese hrvatskih građana, o čemu je Novi list već izvještavao, čitatelji su im se počeli javljati redom navodeći kako su cestarine uredno platili. Problematizirali su i to kako je uopće tvrtka NiVi došla do njihovih osobnih podataka i adrese na koju su im poslani zahtjevi za plaćanjem kazni.

Zahtjevi se odnose na, kako tvrde iz tvrtke NiVi, navodno neplaćene cestarine prilikom vožnji talijanskom mrežom autocesta i to za razdoblje od zadnjih deset godina, pa su neki od građana dobili zahtjeve za plaćanjem cestarina, uvećane za višestruko veći iznos kazni, za vožnje otprije sedam-osam godina za koje, jasno je, više nemaju sačuvane potvrde o plaćanju cestarine, a iznosi sežu, ovisno o duljini dionice koju je pojedino vozilo prešlo, od dvadesetak, do više od stotinu eura.

Tako je, piše Novi list, i jedna od čitateljica dobila zahtjev za plaćanjem 23 eura, zbog navodno neplaćene cestarine u iznosu od svega 1,70 eura, i to još iz 2015. godine.

– Prije par dana dobila sam pismo od tvrtke Nivi radi cestarine na autocesti Milano Nord koju navodno nisam platila 2015. godine. Kategorički tvrdim da sam ju platila, jer je nemoguće da sam prošla kroz rampu ne plativši cestarinu. Treba istražiti kako je Nivi došao do adresa u Hrvatskoj i tko, koja institucija, kod nas razmjenjuje podatke s Italijom.

Nemaju li i oni neku obavezu posumnjati u sustav naplate cestarina, uz ovoliki broj poslanih kazni. Naravno, nakon osam godina nemam dokaz o plaćenoj cestarini od 1,70 eura, a kako mi je poslana kazna od 23 eura platila sam ju, znajući da ne mogu dokazati suprotno.

Vjerojatno sam toga dana platila cestarinu gotovinom, jer bi u suprotnom imala dokaz o kartičnoj transakciji na računu. Moguće je i da sam platila karticom, ali da zbog greške u njihovom sustavu novac nije skinut s mog računa, no u oba sluačaja ne bi smjeli naplaćivati kaznu koja je više nego desetorostruko veća od iznosa cestarine - kazala im je čitateljica.

Tko šalje podatke?

O tome tko šalje podatke talijanskim autocestama, odnosno tvrtki koja ih po pitanju naplate nevjerojatnog broja neplaćenih cestarina zastupa, upit su poslali ministarstvima unutarnjih i vanjskih poslova, kao i Ministarstvu mora, prometa i infrastrukture.

Odgovor su dobili iz MUP-a, iz kojega kažu kako je slanje podataka u slučaju neplaćanja autocesta dio obaveza ugrađenih u hrvatske zakone, temeljem direktiva Europske unije.

"Odredbama Zakona o cestama (‘’Narodne novine’’ broj 84/11, 22/13, 54/13, 148/13, 92/14, 110/19, 144/21, 114/22, 114/22 i 04/23), prenesena je Direktiva (EU) 2019/520 Europskog parlamenta i Vijeća od 19. ožujka 2019. o interoperabilnosti elektroničkih sustava za naplatu cestarine i olakšavanju prekogranične razmjene informacija o neplaćanju cestarina u Uniji (preinaka) – Tekst od značaja za EGP (SL L 91 od 29. ožujka 2019.)

U članku 15. navedenog Zakona propisano je između ostalog da se, a kako bi se omogućila identifikacija vozila i vlasnika vozila odnosno osobe koja na temelju ugovora ima pravo na upotrebu vozila za koje je utvrđeno neplaćanje cestarine, odobrava nacionalnim kontaktnim točkama drugih država članica Europske unije pristup sljedećim podacima iz registra vozila Republike Hrvatske, s ovlašću da obavlja automatizirana pretraživanja o podacima o vozilima i podacima o vlasnicima, odnosno osobama koje na temelju ugovora imaju pravo na upotrebu vozila.

Razmjena informacija između kontaktne točke Republike Hrvatske i nacionalnih kontaktnih točaka drugih država članica Europske unije provodi se upotrebom računalne aplikacije Europskog informacijskog sustava za prometne i vozačke dozvole (Eucaris) i izmijenjenih verzija tog računalnog sustava, u skladu s propisima kojima se uređuje prekogranična razmjena informacija o prometnim prekršajima.

Nositelj navedenog propisa je Ministarstvo mora, prometa i infrastrukture Republike Hrvatske, koje ujedno izrađuje sveobuhvatno izvješće o broju automatiziranih pretraživanja koja je provelo ministarstvo nadležno za unutarnje poslove preko nacionalnih kontaktnih točki država članica Europske unije u kojima su registrirana vozila za koja nije plaćena cestarina te o broju neispunjenih zahtjeva", stoji u odgovoru MUP-a.

Pitanje ogromnog broja kazni za navodno neplaćanja cestarina u Italiji Europskoj komisiji, kao i Ministarsvu prometa te hrvatskom veleposlanstvu u Italiji te koncesionaru talijanskih autocesta postavio je hrvatski europarlamentarac Valter Flego, no iz odgovora koje je dobio sa svih strana izvjesno je da hrvatski državljani koji su takve kazne dobili imaju izbor platiti kaznu ili ići u individualno dokazivanje da su cestarinu platili.

U većini slučajeva to je potpuno nemoguće, jer je riječ o cestarinama za vožnje od prije više godina pa vozači više nemaju potvrde o plaćenoj cestarini, posebno ako su platili gotovinom, piše Novi list.

Nakon što je talijanska tvrtka NiVi, u ime tamošnjeg koncesionara autocesta, Autostrade per l’Italia, samo u prošloj godini poslala čak 3.996 zahtjeva za plaćanjem kazni zbog navodnog neplaćanja cestarina na adrese hrvatskih građana, o čemu je Novi list već izvještavao, čitatelji su im se počeli javljati redom navodeći kako su cestarine uredno platili. Problematizirali su i to kako je uopće tvrtka NiVi došla do njihovih osobnih podataka i adrese na koju su im poslani zahtjevi za plaćanjem kazni.

Zahtjevi se odnose na, kako tvrde iz tvrtke NiVi, navodno neplaćene cestarine prilikom vožnji talijanskom mrežom autocesta i to za razdoblje od zadnjih deset godina, pa su neki od građana dobili zahtjeve za plaćanjem cestarina, uvećane za višestruko veći iznos kazni, za vožnje otprije sedam-osam godina za koje, jasno je, više nemaju sačuvane potvrde o plaćanju cestarine, a iznosi sežu, ovisno o duljini dionice koju je pojedino vozilo prešlo, od dvadesetak, do više od stotinu eura.

Tako je, piše Novi list, i jedna od čitateljica dobila zahtjev za plaćanjem 23 eura, zbog navodno neplaćene cestarine u iznosu od svega 1,70 eura, i to još iz 2015. godine.

– Prije par dana dobila sam pismo od tvrtke Nivi radi cestarine na autocesti Milano Nord koju navodno nisam platila 2015. godine. Kategorički tvrdim da sam ju platila, jer je nemoguće da sam prošla kroz rampu ne plativši cestarinu. Treba istražiti kako je Nivi došao do adresa u Hrvatskoj i tko, koja institucija, kod nas razmjenjuje podatke s Italijom.

Nemaju li i oni neku obavezu posumnjati u sustav naplate cestarina, uz ovoliki broj poslanih kazni. Naravno, nakon osam godina nemam dokaz o plaćenoj cestarini od 1,70 eura, a kako mi je poslana kazna od 23 eura platila sam ju, znajući da ne mogu dokazati suprotno.

Vjerojatno sam toga dana platila cestarinu gotovinom, jer bi u suprotnom imala dokaz o kartičnoj transakciji na računu. Moguće je i da sam platila karticom, ali da zbog greške u njihovom sustavu novac nije skinut s mog računa, no u oba sluačaja ne bi smjeli naplaćivati kaznu koja je više nego desetorostruko veća od iznosa cestarine - kazala im je čitateljica.

Tko šalje podatke?

O tome tko šalje podatke talijanskim autocestama, odnosno tvrtki koja ih po pitanju naplate nevjerojatnog broja neplaćenih cestarina zastupa, upit su poslali ministarstvima unutarnjih i vanjskih poslova, kao i Ministarstvu mora, prometa i infrastrukture.

Odgovor su dobili iz MUP-a, iz kojega kažu kako je slanje podataka u slučaju neplaćanja autocesta dio obaveza ugrađenih u hrvatske zakone, temeljem direktiva Europske unije.

"Odredbama Zakona o cestama (‘’Narodne novine’’ broj 84/11, 22/13, 54/13, 148/13, 92/14, 110/19, 144/21, 114/22, 114/22 i 04/23), prenesena je Direktiva (EU) 2019/520 Europskog parlamenta i Vijeća od 19. ožujka 2019. o interoperabilnosti elektroničkih sustava za naplatu cestarine i olakšavanju prekogranične razmjene informacija o neplaćanju cestarina u Uniji (preinaka) – Tekst od značaja za EGP (SL L 91 od 29. ožujka 2019.)

U članku 15. navedenog Zakona propisano je između ostalog da se, a kako bi se omogućila identifikacija vozila i vlasnika vozila odnosno osobe koja na temelju ugovora ima pravo na upotrebu vozila za koje je utvrđeno neplaćanje cestarine, odobrava nacionalnim kontaktnim točkama drugih država članica Europske unije pristup sljedećim podacima iz registra vozila Republike Hrvatske, s ovlašću da obavlja automatizirana pretraživanja o podacima o vozilima i podacima o vlasnicima, odnosno osobama koje na temelju ugovora imaju pravo na upotrebu vozila.

Razmjena informacija između kontaktne točke Republike Hrvatske i nacionalnih kontaktnih točaka drugih država članica Europske unije provodi se upotrebom računalne aplikacije Europskog informacijskog sustava za prometne i vozačke dozvole (Eucaris) i izmijenjenih verzija tog računalnog sustava, u skladu s propisima kojima se uređuje prekogranična razmjena informacija o prometnim prekršajima.

Nositelj navedenog propisa je Ministarstvo mora, prometa i infrastrukture Republike Hrvatske, koje ujedno izrađuje sveobuhvatno izvješće o broju automatiziranih pretraživanja koja je provelo ministarstvo nadležno za unutarnje poslove preko nacionalnih kontaktnih točki država članica Europske unije u kojima su registrirana vozila za koja nije plaćena cestarina te o broju neispunjenih zahtjeva", stoji u odgovoru MUP-a.

Pitanje ogromnog broja kazni za navodno neplaćanja cestarina u Italiji Europskoj komisiji, kao i Ministarsvu prometa te hrvatskom veleposlanstvu u Italiji te koncesionaru talijanskih autocesta postavio je hrvatski europarlamentarac Valter Flego, no iz odgovora koje je dobio sa svih strana izvjesno je da hrvatski državljani koji su takve kazne dobili imaju izbor platiti kaznu ili ići u individualno dokazivanje da su cestarinu platili.

U većini slučajeva to je potpuno nemoguće, jer je riječ o cestarinama za vožnje od prije više godina pa vozači više nemaju potvrde o plaćenoj cestarini, posebno ako su platili gotovinom, piše Novi list.
