Tužitelj Međunarodnog kaznenog suda (ICC) zaprimio je zajednički zahtjev pet zemalja da istraži situaciju na palestinskim teritorijima u petak, a istoga dana primio je i obitelji izraelskih žrtava koje su takav zahtjev podnijele prije dva tjedna, prenose agencije. 

Zahtjev su uputili Južnoafrička Republika, Bangladeš, Bolivija, Komori i Džibuti, rekao je tužitelj Karim Kahn, navodi se u priopćenju. Južnoafrička Republika rekla je da je zahtjev upućen "kako bi se osiguralo da ICC hitno obrati pozornost na tešku situaciju u Palestini", javlja Reuters.

Pošto je istraga već u tijeku, zajednički zahtjev imat će ograničen učinak u praksi. 

ICC već provodi istragu o "situaciji u državi Palestini" za navodne ratne zločine počinjene od 13. lipnja 2014. Tužitelj Kahn je u listopadu rekao da njegov ured ima jurisdikciju i nad Hamasovim napadom na Izrael 7. listopada i svim zločinima počinjenima u izraelskom odgovoru, što uključuje bombaške napade u Pojasu Gaze. Glavni tužitelj primio je u petak obitelji izraelskih žrtava koje traže sudski progon Hamasa za ratne zločine i genocid te da ICC izda međunarodne tjeralice za Hamasove vođe, prenosi agencija AFP.  

U Izraelu je ubijeno 1.200 ljudi 7. listopada, uglavnom civila u pokolju koju je izveo Hamas, a više od 240 ljudi uzeo je kao taoce. Izrael je na Hamasova zvjerstva odgovorio masovnom ofenzivom odmazde u kojoj je ubijeno 12.000 ljudi, prema podacima Hamasova ministarstva zdravstva.

Ured tužitelja priopćio je da je "prikupio znatnu količinu informacija i dokaza" o zločinima na palestinskom teritoriju, kao i onih koje su počinili Palestinci. Svatko može podnijeti tužbu pri ICC-u i zatražiti istragu no sud sa sjedištem u Den Haagu nije obvezan prihvatiti je. ICC može istraživati ​​državljane država nečlanica u određenim okolnostima, primjerice kad se sumnja da su zločini počinjeni na teritorijima država članica. Palestinska područja su među članovima ICC-a od 2015. godine.

Pravni stručnjaci rekli su za agenciju AFP da bi obje strane mogle biti optužene za ratne zločine. 

Osnovan 2002. za procesuiranje najtežih zločina u svijetu, ICC je 2021. otvorio istragu o navodnim ratnim zločinima na palestinskim područjima koje su počinile izraelske snage, Hamas i druge palestinske oružane skupine. Khan je rekao da se njegov mandat primjenjuje i na zločine počinjene tijekom aktualnog rata, ali njegovi ljudi nemaju sada pristup ni Gazi ni Izraelu.

Država Izrael nije članica ICC-a i ne priznaje njegovu jurisdikciju.  

"Imamo Izraelce koji vjeruju ovom sudu i i njegovu tužitelju i profesionalizmu njegove ekipe (...) To će pomoći da im se potvrdi da je sud sposoban donijeti pravdu za zločine koje su pretrpjeli. Koje su njihovi članovi obitelji pretrpjeli", rekao je za AFP odvjetnik François Zimeray koji zastupa izraelske obitelji.

Tužitelj Međunarodnog kaznenog suda (ICC) zaprimio je zajednički zahtjev pet zemalja da istraži situaciju na palestinskim teritorijima u petak, a istoga dana primio je i obitelji izraelskih žrtava koje su takav zahtjev podnijele prije dva tjedna, prenose agencije. 

Zahtjev su uputili Južnoafrička Republika, Bangladeš, Bolivija, Komori i Džibuti, rekao je tužitelj Karim Kahn, navodi se u priopćenju. Južnoafrička Republika rekla je da je zahtjev upućen "kako bi se osiguralo da ICC hitno obrati pozornost na tešku situaciju u Palestini", javlja Reuters.

Pošto je istraga već u tijeku, zajednički zahtjev imat će ograničen učinak u praksi. 

ICC već provodi istragu o "situaciji u državi Palestini" za navodne ratne zločine počinjene od 13. lipnja 2014. Tužitelj Kahn je u listopadu rekao da njegov ured ima jurisdikciju i nad Hamasovim napadom na Izrael 7. listopada i svim zločinima počinjenima u izraelskom odgovoru, što uključuje bombaške napade u Pojasu Gaze. Glavni tužitelj primio je u petak obitelji izraelskih žrtava koje traže sudski progon Hamasa za ratne zločine i genocid te da ICC izda međunarodne tjeralice za Hamasove vođe, prenosi agencija AFP.  

U Izraelu je ubijeno 1.200 ljudi 7. listopada, uglavnom civila u pokolju koju je izveo Hamas, a više od 240 ljudi uzeo je kao taoce. Izrael je na Hamasova zvjerstva odgovorio masovnom ofenzivom odmazde u kojoj je ubijeno 12.000 ljudi, prema podacima Hamasova ministarstva zdravstva.

Ured tužitelja priopćio je da je "prikupio znatnu količinu informacija i dokaza" o zločinima na palestinskom teritoriju, kao i onih koje su počinili Palestinci. Svatko može podnijeti tužbu pri ICC-u i zatražiti istragu no sud sa sjedištem u Den Haagu nije obvezan prihvatiti je. ICC može istraživati ​​državljane država nečlanica u određenim okolnostima, primjerice kad se sumnja da su zločini počinjeni na teritorijima država članica. Palestinska područja su među članovima ICC-a od 2015. godine.

Pravni stručnjaci rekli su za agenciju AFP da bi obje strane mogle biti optužene za ratne zločine. 

Osnovan 2002. za procesuiranje najtežih zločina u svijetu, ICC je 2021. otvorio istragu o navodnim ratnim zločinima na palestinskim područjima koje su počinile izraelske snage, Hamas i druge palestinske oružane skupine. Khan je rekao da se njegov mandat primjenjuje i na zločine počinjene tijekom aktualnog rata, ali njegovi ljudi nemaju sada pristup ni Gazi ni Izraelu.

Država Izrael nije članica ICC-a i ne priznaje njegovu jurisdikciju.  

"Imamo Izraelce koji vjeruju ovom sudu i i njegovu tužitelju i profesionalizmu njegove ekipe (...) To će pomoći da im se potvrdi da je sud sposoban donijeti pravdu za zločine koje su pretrpjeli. Koje su njihovi članovi obitelji pretrpjeli", rekao je za AFP odvjetnik François Zimeray koji zastupa izraelske obitelji.
