Vlada Crne Gore odbila je priznati tužbeni zahtjev u postupku posredovanja i vratiti 28 kilograma poludragog kamenja - opala, koji su prije više od 10 godina zaplijenjeni na aerodromu Podgorica, navodi se u izvješću Zaštitnika imovinsko-pravnih odnosa.

Postupak je u tijeku pred Osnovnim sudom u Kotoru, a vrijednost spora je 300 milijuna eura. Sud je zabranio državi rješavanje ovih predmeta do pravomoćnog okončanja spora, prenosi Radio-televizija Crne Gore, piše klix.ba.

Postupak je pokrenut na zahtjev Roberta Fanjeka i Antonija Strelenskog, nakon što su zaplijenjeni opali proglašeni državnom imovinom i stavljeni u trezor Centralne banke Crne Gore.

Traže da im se poludrago kamenje vrati i u tužbi navode da je vrijedan 300 milijuna eura, kao i odštetu za njegovu štetu i nestanak pet kilograma jer se sada u trezoru nalazi 28 kilograma Centralna banka, izgubljena dobit za proteklo razdoblje i zatezne kamate.

U izvješću Zaštitnika imovinsko-pravnih odnosa navedeno je da su stvari unesene u Crnu Goru, a da prethodno nisu prijavljene carini na aerodromu Podgorica.

Ovaj put postupak je pokrenut pred Osnovnim sudom u Kotoru, dok je prethodno tužba povučena pred Osnovnim sudom u Nikšiću.

"Osnovni sud u Kotoru donio je prijedlog za određivanje privremene mjere i zabranio državi rješavanje ovih predmeta do pravomoćnog okončanja spora. Postupak je u toku, a Vlada Crne Gore odbila je priznati tužbeni zahtjev posredovanje i vratiti opale", stoji u izvješću.

Kotorski sud spriječio je izvršnu vlast u prodaji dragulja.

Zbirku opala su u srpnju 2011. iz zračne luke u Zürichu u zračnu luku Podgorica donijeli južnoafrički državljani Fenjek i Strelenski.

Njih dvojica su 2012. prijavili policiji vlasnika hotela "Belvi" u Budvi Branka Ćupića, kojeg su optužili da im je, kako su rekli, "na prijevaru uzeo dragulje". Policiji su ispričali da ih je Ćupić 2011. godine sačekao na podgoričkom aerodromu, gdje su "zaobišli carinu" i odveli ih u hotel kao svoje goste, a dragulje su ostavili u hotelskom sefu.

Kad im je Ćupić godinu dana kasnije, prema njihovim tvrdnjama, odbio vratiti dragulje, prijavili su ga policiji.

Policija je nakon prijave oduzela dragulje, a Osnovni sud u Podgorici ih je u rujnu 2012. trajno oduzeo jer su, kako stoji u rješenju, uvezeni mimo carinskih propisa, što je kazneno djelo.

S obzirom na obilježje kaznenog djela pri uvozu, granate su postale državno vlasništvo i završile u sefu Centralne banke Crne Gore.

Mjerenjem je utvrđeno da je najviše vatrenog, bijelog i crnog opala. Samo jedan kamen težak je četiri kilograma i 400 grama. Zbirka sadrži i 14 figurica u obliku životinja teških nešto više od kilograma, piše klix.ba.

Vlada Crne Gore odbila je priznati tužbeni zahtjev u postupku posredovanja i vratiti 28 kilograma poludragog kamenja - opala, koji su prije više od 10 godina zaplijenjeni na aerodromu Podgorica, navodi se u izvješću Zaštitnika imovinsko-pravnih odnosa.

Postupak je u tijeku pred Osnovnim sudom u Kotoru, a vrijednost spora je 300 milijuna eura. Sud je zabranio državi rješavanje ovih predmeta do pravomoćnog okončanja spora, prenosi Radio-televizija Crne Gore, piše klix.ba.

Postupak je pokrenut na zahtjev Roberta Fanjeka i Antonija Strelenskog, nakon što su zaplijenjeni opali proglašeni državnom imovinom i stavljeni u trezor Centralne banke Crne Gore.

Traže da im se poludrago kamenje vrati i u tužbi navode da je vrijedan 300 milijuna eura, kao i odštetu za njegovu štetu i nestanak pet kilograma jer se sada u trezoru nalazi 28 kilograma Centralna banka, izgubljena dobit za proteklo razdoblje i zatezne kamate.

U izvješću Zaštitnika imovinsko-pravnih odnosa navedeno je da su stvari unesene u Crnu Goru, a da prethodno nisu prijavljene carini na aerodromu Podgorica.

Ovaj put postupak je pokrenut pred Osnovnim sudom u Kotoru, dok je prethodno tužba povučena pred Osnovnim sudom u Nikšiću.

"Osnovni sud u Kotoru donio je prijedlog za određivanje privremene mjere i zabranio državi rješavanje ovih predmeta do pravomoćnog okončanja spora. Postupak je u toku, a Vlada Crne Gore odbila je priznati tužbeni zahtjev posredovanje i vratiti opale", stoji u izvješću.

Kotorski sud spriječio je izvršnu vlast u prodaji dragulja.

Zbirku opala su u srpnju 2011. iz zračne luke u Zürichu u zračnu luku Podgorica donijeli južnoafrički državljani Fenjek i Strelenski.

Njih dvojica su 2012. prijavili policiji vlasnika hotela "Belvi" u Budvi Branka Ćupića, kojeg su optužili da im je, kako su rekli, "na prijevaru uzeo dragulje". Policiji su ispričali da ih je Ćupić 2011. godine sačekao na podgoričkom aerodromu, gdje su "zaobišli carinu" i odveli ih u hotel kao svoje goste, a dragulje su ostavili u hotelskom sefu.

Kad im je Ćupić godinu dana kasnije, prema njihovim tvrdnjama, odbio vratiti dragulje, prijavili su ga policiji.

Policija je nakon prijave oduzela dragulje, a Osnovni sud u Podgorici ih je u rujnu 2012. trajno oduzeo jer su, kako stoji u rješenju, uvezeni mimo carinskih propisa, što je kazneno djelo.

S obzirom na obilježje kaznenog djela pri uvozu, granate su postale državno vlasništvo i završile u sefu Centralne banke Crne Gore.

Mjerenjem je utvrđeno da je najviše vatrenog, bijelog i crnog opala. Samo jedan kamen težak je četiri kilograma i 400 grama. Zbirka sadrži i 14 figurica u obliku životinja teških nešto više od kilograma, piše klix.ba.

Vlada Crne Gore odbila je priznati tužbeni zahtjev u postupku posredovanja i vratiti 28 kilograma poludragog kamenja - opala, koji su prije više od 10 godina zaplijenjeni na aerodromu Podgorica, navodi se u izvješću Zaštitnika imovinsko-pravnih odnosa.

Postupak je u tijeku pred Osnovnim sudom u Kotoru, a vrijednost spora je 300 milijuna eura. Sud je zabranio državi rješavanje ovih predmeta do pravomoćnog okončanja spora, prenosi Radio-televizija Crne Gore, piše klix.ba.

Postupak je pokrenut na zahtjev Roberta Fanjeka i Antonija Strelenskog, nakon što su zaplijenjeni opali proglašeni državnom imovinom i stavljeni u trezor Centralne banke Crne Gore.

Traže da im se poludrago kamenje vrati i u tužbi navode da je vrijedan 300 milijuna eura, kao i odštetu za njegovu štetu i nestanak pet kilograma jer se sada u trezoru nalazi 28 kilograma Centralna banka, izgubljena dobit za proteklo razdoblje i zatezne kamate.

U izvješću Zaštitnika imovinsko-pravnih odnosa navedeno je da su stvari unesene u Crnu Goru, a da prethodno nisu prijavljene carini na aerodromu Podgorica.
