Kada je izrečena presuda od sedam godina zatvora, očekivalo se da će Branimira Glavaša nakon objave odvesti u istražni zatvor. Naime, Zakon o kaznenom postupku određuje da se, ako je kazna viša od pet godina, optuženiku obavezno određuje istražni zatvor, točnije, odmah se s lisicama na rukama izvodi iz suda i prebacuje u Remetinec.

U slučaju Glavaš to se nije dogodilo i to je na izvjestan način i pravni presedan, piše Jutarnji list.

U odluci Ustavnog suda iz 2015. godine sudac Dražen Kevrić pronašao je uporište da Glavaša ne pošalje u zatvor, za što će napisati posebno rješenje na koje će se tužiteljstvo moći žaliti.

Prema toj odluci "određivanje istražnog zatvora podnositelju nije smjelo biti a priori određeno do pravomoćnog okončanja kaznenog postupka, ali ne dulje od kazne na koju je optuženi Branimir Glavaš nepravomoćno osuđen. Određivanje trajanja obligatornog istražnog zatvora moralo je biti utemeljeno i ovisiti o provedenom testu razmjernosti, koji je u postupku pred Vrhovnim sudom, unatoč specifičnim okolnostima ovog pravnog slučaja, izostao", navodi se u obrazloženju te odluke.

U obrazloženju je pisalo i da je Glavašev slučaj atipičan i jedinstven u dosadašnjoj praksi jer se ne može podvesti ni pod jednu od uobičajenih situacija. Druga je specifičnost Glavaševa slučaja to što je obligatorni istražni zatvor određen nakon što je podnositelj odslužio gotovo dvije trećine kazne zatvora (pet i pol godina od osam na koliko je ranije bio osuđen) koja mu je bila određena ukinutom drugostupanjskom presudom Vrhovnog suda.

I sam Filip Glavaš bio je iznenađen ovom odlukom jer je očekivao da će sudac Kevrić odrediti istražni zatvor njegovu ocu, a i odvjetnici ostalih okrivljenika komentirali su kako je ovo situacija s kojom se dosad nisu susretali u praksi i kako zakon o kaznenom postupku ne poznaje neodređivanje istražnog zatvora. Međutim, ova odluka još nije konačna jer će tek za nekoliko dana biti poznato šire obrazloženje ove odluke, nakon koje može uslijediti žalba tužitelja.

Ako se to dogodi, moglo bi se dogoditi da se Glavašu odredi istražni zatvor. Ako bi takva odluka postala pravomoćna, onda bi ga policija mogla po nalogu suda privesti, naravno ukoliko se ne bi sam javio u istražni zatvor. Glavaš nam je rekao kako to sam ne namjerava učiniti, nego će čekati odluku, piše Jutarnji list.

Kada je izrečena presuda od sedam godina zatvora, očekivalo se da će Branimira Glavaša nakon objave odvesti u istražni zatvor. Naime, Zakon o kaznenom postupku određuje da se, ako je kazna viša od pet godina, optuženiku obavezno određuje istražni zatvor, točnije, odmah se s lisicama na rukama izvodi iz suda i prebacuje u Remetinec.

U slučaju Glavaš to se nije dogodilo i to je na izvjestan način i pravni presedan, piše Jutarnji list.

U odluci Ustavnog suda iz 2015. godine sudac Dražen Kevrić pronašao je uporište da Glavaša ne pošalje u zatvor, za što će napisati posebno rješenje na koje će se tužiteljstvo moći žaliti.

Prema toj odluci "određivanje istražnog zatvora podnositelju nije smjelo biti a priori određeno do pravomoćnog okončanja kaznenog postupka, ali ne dulje od kazne na koju je optuženi Branimir Glavaš nepravomoćno osuđen. Određivanje trajanja obligatornog istražnog zatvora moralo je biti utemeljeno i ovisiti o provedenom testu razmjernosti, koji je u postupku pred Vrhovnim sudom, unatoč specifičnim okolnostima ovog pravnog slučaja, izostao", navodi se u obrazloženju te odluke.

U obrazloženju je pisalo i da je Glavašev slučaj atipičan i jedinstven u dosadašnjoj praksi jer se ne može podvesti ni pod jednu od uobičajenih situacija. Druga je specifičnost Glavaševa slučaja to što je obligatorni istražni zatvor određen nakon što je podnositelj odslužio gotovo dvije trećine kazne zatvora (pet i pol godina od osam na koliko je ranije bio osuđen) koja mu je bila određena ukinutom drugostupanjskom presudom Vrhovnog suda.

I sam Filip Glavaš bio je iznenađen ovom odlukom jer je očekivao da će sudac Kevrić odrediti istražni zatvor njegovu ocu, a i odvjetnici ostalih okrivljenika komentirali su kako je ovo situacija s kojom se dosad nisu susretali u praksi i kako zakon o kaznenom postupku ne poznaje neodređivanje istražnog zatvora. Međutim, ova odluka još nije konačna jer će tek za nekoliko dana biti poznato šire obrazloženje ove odluke, nakon koje može uslijediti žalba tužitelja.

Ako se to dogodi, moglo bi se dogoditi da se Glavašu odredi istražni zatvor. Ako bi takva odluka postala pravomoćna, onda bi ga policija mogla po nalogu suda privesti, naravno ukoliko se ne bi sam javio u istražni zatvor. Glavaš nam je rekao kako to sam ne namjerava učiniti, nego će čekati odluku, piše Jutarnji list.
