Sud EU donio je iznimno važnu presudu po predmetu C-269/19 kojom je odlučio kako nacionalni sud treba postupati u slučaju kada je ugovorom o kreditu ugovorena neodrediva promjenjiva kamatna stopa, izvijestila je u srijedu udruga Franak.

Sud EU je utvrdio sljedeće:

Ništetnu odredbu o formiranju kamatne stope nacionalni sud ne može zamijeniti drugom odredbom, a to znači da ona ne može biti zamijenjena niti početnom kamatnom stopom u fiksnom iznosu.

Ništetna odredba o promjeni kamatne stope može biti zamijenjena odredbom nacionalnog prava kojom je propisano koja se kamatna stopa u tome slučaju primjenjuje.

Ako po uklanjanju ništetne odredbe o formiranju kamatne stope ugovor može opstati bez te odredbe, on će vrijediti bez te odredbe.

Ako zbog nedostatka ništetne odredbe ugovor više ne može opstati, potrebno je provjeriti je li to štetno za potrošača.

Ako bi ništetnost ugovora bila štetna za potrošača, nacionalni sud može uputiti banku i potrošača na pregovore o kamatnoj stopi, ali pod uvjetom da sud utvrdi okvire za te pregovore.

-Zaključujemo na temelju takve presude još jednom da ugovori o kreditu s ništetnom valutom, i ništetnom kamatnom stopom ne mogu opstati, i da takvi ugovori moraju biti na sudovima utvrđeni ništetnima. Budući da su potrošači sa CHF ugovorima platili daleko više novca nego što su ga primili, onda ništetnost tih ugovora ne uzrokuje nikakvu štetu za potrošače, nego dapače uzrokuje pravičnu restituciju zbog ugovaranja takvih nepoštenih odredaba - ističu u udruzi Franak.

Nadalje, kod euro i kunskih kredita tumače da bi se mogla primijeniti kamatna stope propisana člankom 26. stavkom 3. Zakona o obveznim odnosima, gdje je propisano da se u slučaju ako nije ugovorena kamatna stopa primjenjuje 1/4 zakonske zatezne kamate za obračun anuiteta.

-Nažalost, mi ne možemo znati kako će na našim sudovima biti tumačena nova presuda Suda EU, mada je ona potpuno jasna, razgovijetna i ne ostavlja puno dvojbi o tome kako bi sudovi u Hrvatskoj trebali postupati - zaključuju u udruzi Franak.

Sud EU donio je iznimno važnu presudu po predmetu C-269/19 kojom je odlučio kako nacionalni sud treba postupati u slučaju kada je ugovorom o kreditu ugovorena neodrediva promjenjiva kamatna stopa, izvijestila je u srijedu udruga Franak.

Sud EU je utvrdio sljedeće:

Ništetnu odredbu o formiranju kamatne stope nacionalni sud ne može zamijeniti drugom odredbom, a to znači da ona ne može biti zamijenjena niti početnom kamatnom stopom u fiksnom iznosu.

Ništetna odredba o promjeni kamatne stope može biti zamijenjena odredbom nacionalnog prava kojom je propisano koja se kamatna stopa u tome slučaju primjenjuje.

Ako po uklanjanju ništetne odredbe o formiranju kamatne stope ugovor može opstati bez te odredbe, on će vrijediti bez te odredbe.

Ako zbog nedostatka ništetne odredbe ugovor više ne može opstati, potrebno je provjeriti je li to štetno za potrošača.

Ako bi ništetnost ugovora bila štetna za potrošača, nacionalni sud može uputiti banku i potrošača na pregovore o kamatnoj stopi, ali pod uvjetom da sud utvrdi okvire za te pregovore.

-Zaključujemo na temelju takve presude još jednom da ugovori o kreditu s ništetnom valutom, i ništetnom kamatnom stopom ne mogu opstati, i da takvi ugovori moraju biti na sudovima utvrđeni ništetnima. Budući da su potrošači sa CHF ugovorima platili daleko više novca nego što su ga primili, onda ništetnost tih ugovora ne uzrokuje nikakvu štetu za potrošače, nego dapače uzrokuje pravičnu restituciju zbog ugovaranja takvih nepoštenih odredaba - ističu u udruzi Franak.

Nadalje, kod euro i kunskih kredita tumače da bi se mogla primijeniti kamatna stope propisana člankom 26. stavkom 3. Zakona o obveznim odnosima, gdje je propisano da se u slučaju ako nije ugovorena kamatna stopa primjenjuje 1/4 zakonske zatezne kamate za obračun anuiteta.

-Nažalost, mi ne možemo znati kako će na našim sudovima biti tumačena nova presuda Suda EU, mada je ona potpuno jasna, razgovijetna i ne ostavlja puno dvojbi o tome kako bi sudovi u Hrvatskoj trebali postupati - zaključuju u udruzi Franak.

Sud EU donio važnu presudu: nacionalni sud ne smije mijenjati ništetnu ugovornu odredbu o kamatnoj stopi zamjenskom arbitrarnom odredbom!

Sud EU donio je iznimno važnu presudu po predmetu C-269/19 kojom je odlučio kako nacionalni sud treba postupati u slučaju kada je ugovorom o kreditu ugovorena neodrediva promjenjiva kamatna stopa, izvijestila je u srijedu udruga Franak.

Sud EU je utvrdio sljedeće:

Ništetnu odredbu o formiranju kamatne stope nacionalni sud ne može zamijeniti drugom odredbom, a to znači da ona ne može biti zamijenjena niti početnom kamatnom stopom u fiksnom iznosu.

Ništetna odredba o promjeni kamatne stope može biti zamijenjena odredbom nacionalnog prava kojom je propisano koja se kamatna stopa u tome slučaju primjenjuje.

Ako po uklanjanju ništetne odredbe o formiranju kamatne stope ugovor može opstati bez te odredbe, on će vrijediti bez te odredbe.
