Novinari Nove TV razgovarali su s profesorom Viktorom Gotovcem s katedre za radno pravo koji im je otkrio može li pravno 'proći' plan ministra da bez COVID potvrde nema odlaska na radno mjesto što bi moglo rezultirati i manjom plaćom.
- Pomalo pitijski odgovor je i da i ne. Da, zbog toga što je do sada Ustavni sud održao i podržao ustavnost odluka stožera. To je slijedom zakonskog uređenja kojim je dano stožeru da u slučajevima ovakve epidemijske opasnosti donosi, po određenoj proceduri, odluke. I u tom pogledu za očekivati je da Ustavni sud, kao i do sada, zapravo odlukama stožera da jedno takvo pravno značenje koje bi ga učinile ustanim i zakonitim, kazao je pravni stručnjak te dodao kako je "malo ne" vezano da diskusiju koju su predsjednik i neki znanstvenici vodili prije godinu i pol o tome je li ovo izvanredno stanje ili nije.
- U tom pogledu danas se pokazuje da su u tom smislu bili u pravu, jer da smo za ovakve stvari donijeli konkretan zakon, da smo na konkretan način uredili određena pitanja, tada bismo svi znali i ne bismo imali dileme je li to ustavno, istaknuo je te dodao kako ne vjeruje da će se to pokazati problematičnim na Ustavnom sudu.
Mnogi djelatnici boje se otkaza u slučaju da odbiju test nakon čega ih se neće pustiti na radno mjesto.
- Temelj svega je strah, i od cjepiva i od svega što se događa", kaže pravnik koji smatra da je previše strahova prisutno, a jedan od strahova koji svakako djeluju na ljude je strah od mogućnosti otkaza. "Odnosno sankcioniranja u radnom odnosu. Radi se o specifičnim strukama kod kojih postoji povećana opasnost za njihove korisnike, za pacijente u zdravstvu i za korisnike socijalne skrbi u sustavu socijalne skrbi. U tom pogledu mislim da doista moramo razmišljati to tim ljudima.
Mislim da bi bilo dobro da onda o tome razmišljaju i oni koji tu uslugu i pružaju. Slijedom te povećane odgovornosti, mislim da bi se zapravo vrlo lako moglo dogoditi da bi nepoštivanje ovih odluka, kada se utvrdi, moglo voditi do sankcija koje bi, između ostalog, mogle biti i otkaz", rekao je. "Nadam se da se ovakve odluke ne donose bez razmišljanja o sankcijama za one koji ih krše, ističe pravni stručnjak.
- Prva žrtva COVID krize je pravni sustav. Činjenica da zakone ne poštujemo, što je bio slučaj kod rada na izdvojenom mjestu rada. Ili da nemamo sankcije za eklatantno nepoštivanje zakonskih odredbi je nešto što narušava povjerenje u vladavinu prava i u pravnu državu, govori.
Neki djelatnici ne libe se ni tužbi.
- Ovisi o vrsti sankcije. Uvijek u sporu postoje dvije strane i uvijek misle da su u pravu, istaknuo je stručnjak i dodao kako se može očekivati da će tužiti i da će neki možda i uspjeti u tužbama, ali stvar bi trebala biti pravno razmjerno čista.
Novinarka ga je upitala i je li Stožer civilne zaštite trebao razmišljati unaprijed pa mijenjati neke zakone poput zakona o radu.
- Sigurno. Da li samo taj, ili druge kojima su uređeni odnosi. To bi bila puno čišća situacija i to bi bilo nešto što bi pomoglo našem pravnom sustavu da na adekvatan način odgovara na probleme i da možemo reći da smo, ne samo u formi, nego u sadržaju, prava država u kojoj se vrednuje vladavina prava. Država koja svojim građanima jamči temeljna prava i oni vjeruju da ih država štiti, rekao je.

Novinari Nove TV razgovarali su s profesorom Viktorom Gotovcem s katedre za radno pravo koji im je otkrio može li pravno 'proći' plan ministra da bez COVID potvrde nema odlaska na radno mjesto što bi moglo rezultirati i manjom plaćom.
- Pomalo pitijski odgovor je i da i ne. Da, zbog toga što je do sada Ustavni sud održao i podržao ustavnost odluka stožera. To je slijedom zakonskog uređenja kojim je dano stožeru da u slučajevima ovakve epidemijske opasnosti donosi, po određenoj proceduri, odluke. I u tom pogledu za očekivati je da Ustavni sud, kao i do sada, zapravo odlukama stožera da jedno takvo pravno značenje koje bi ga učinile ustanim i zakonitim, kazao je pravni stručnjak te dodao kako je "malo ne" vezano da diskusiju koju su predsjednik i neki znanstvenici vodili prije godinu i pol o tome je li ovo izvanredno stanje ili nije.
- U tom pogledu danas se pokazuje da su u tom smislu bili u pravu, jer da smo za ovakve stvari donijeli konkretan zakon, da smo na konkretan način uredili određena pitanja, tada bismo svi znali i ne bismo imali dileme je li to ustavno, istaknuo je te dodao kako ne vjeruje da će se to pokazati problematičnim na Ustavnom sudu.
Mnogi djelatnici boje se otkaza u slučaju da odbiju test nakon čega ih se neće pustiti na radno mjesto.
- Temelj svega je strah, i od cjepiva i od svega što se događa", kaže pravnik koji smatra da je previše strahova prisutno, a jedan od strahova koji svakako djeluju na ljude je strah od mogućnosti otkaza. "Odnosno sankcioniranja u radnom odnosu. Radi se o specifičnim strukama kod kojih postoji povećana opasnost za njihove korisnike, za pacijente u zdravstvu i za korisnike socijalne skrbi u sustavu socijalne skrbi. U tom pogledu mislim da doista moramo razmišljati to tim ljudima.
Mislim da bi bilo dobro da onda o tome razmišljaju i oni koji tu uslugu i pružaju. Slijedom te povećane odgovornosti, mislim da bi se zapravo vrlo lako moglo dogoditi da bi nepoštivanje ovih odluka, kada se utvrdi, moglo voditi do sankcija koje bi, između ostalog, mogle biti i otkaz", rekao je. "Nadam se da se ovakve odluke ne donose bez razmišljanja o sankcijama za one koji ih krše, ističe pravni stručnjak.
- Prva žrtva COVID krize je pravni sustav. Činjenica da zakone ne poštujemo, što je bio slučaj kod rada na izdvojenom mjestu rada. Ili da nemamo sankcije za eklatantno nepoštivanje zakonskih odredbi je nešto što narušava povjerenje u vladavinu prava i u pravnu državu, govori.
Neki djelatnici ne libe se ni tužbi.
- Ovisi o vrsti sankcije. Uvijek u sporu postoje dvije strane i uvijek misle da su u pravu, istaknuo je stručnjak i dodao kako se može očekivati da će tužiti i da će neki možda i uspjeti u tužbama, ali stvar bi trebala biti pravno razmjerno čista.
Novinarka ga je upitala i je li Stožer civilne zaštite trebao razmišljati unaprijed pa mijenjati neke zakone poput zakona o radu.
- Sigurno. Da li samo taj, ili druge kojima su uređeni odnosi. To bi bila puno čišća situacija i to bi bilo nešto što bi pomoglo našem pravnom sustavu da na adekvatan način odgovara na probleme i da možemo reći da smo, ne samo u formi, nego u sadržaju, prava država u kojoj se vrednuje vladavina prava. Država koja svojim građanima jamči temeljna prava i oni vjeruju da ih država štiti, rekao je.
