Županijski sud u Osijeku dosudio je 19. studenog 2020. presudom Gž-1516/2019 ništetnost odredbe o izlaznoj naknadi za prijevremeno vraćanje kredita te je naložio vraćanje naplaćene naknade u iznosu 3.800 eura odnosno oko 29.000 kuna uz pripadajuće zatezne kamate i 4.700,00 kuna sudskih troškova. Tu odredbu ugovorila je Addiko banka u kreditu s valutnom klauzulom u eurima s potrošačem koji je tužbom zatražio naplaćenu naknadu natrag.
Izvijestili su to iz udruge Franak poručujući kako je sudska praksa za utvrđivanje ništetnosti izlaznih naknada i vraćanje naplaćenih naknada već prilično stabilna s nekoliko pravomoćnih presuda na različitim sudovima.
U presudi iz Osijeka utvrđeno je sljedeće:
Izlazna naknada unaprijed je formulirana u ugovoru, a potrošač na nju nije mogao imati utjecaj.
Takva ugovorna odredba uzrokuje znatnu neravnotežu u pravima i obvezama na štetu potrošača.
U vrijeme ugovaranja čak se nije utvrdila niti visina te naknade, zbog čega je ona i neodrediva.
Addiko nije pretrpio dodatne troškove uslijed prijevremene otplate, u smislu administrativnih troškova ili troškova osoblja.
Kamate nakon prijevremene otplate ne smiju se zaračunavati, pa se ne smije buduća izmakla dobit iz kamata uračunavati kao nekakva izlazna naknada za prijevremenu otplatu.
- Čestitamo tužitelju i njegovu odvjetniku Srđanu Kaleboti koji je zasad jedini odvjetnik koji je svojem klijentu Ivi Soli izvojevao pravomoćnu sudsku presudu za ništetnost dvaju CHF ugovora, na temelju koje više nema niti hipoteku na svojoj nekretnini - poručuju iz udruge Franak.
Ujedno su ponovili što je sve utuživo u hrvatskim kreditima, a radi se o slučajevima za koje postoje pravomoćne presude. Saželi su to u četiri točke: ništetna valutna klauzula CHF, ništetna promjenjiva kamatna stopa koja se mijenja odlukom banke u svim valutama kredita, ništetna izlazna naknada za prijevremenu otplatu kredita i ništetan ugovor s valutnom klauzulom CHF.
Naglašavaju kako za potonje dvije točke još uvijek nemaju potvrdu Vrhovnoga suda RH, pa je to sljedeće što nestrpljivo očekuju.
- Potencijalno će se stvoriti i sudska praksa za naplaćene ulazne naknade za obradu kredita, jer su te naknade jednako netransparentne kao i izlazne naknade, i nisu utemeljene na troškovima koje banke imaju zbog ugovaranja kredita, nego je to unaprijed formulirana ugovorna odredba koja stvara neravnotežu na štetu potrošača, kao što je to presudio i Sud EU već u dvama presudama, C-84/19 i C-224/19. Banke su ugovarale od 1% do 3% iznosa kredita kao ulaznu naknadu, i to su onda naplaćivale iz samoga kredita, a prema Sudu EU takve naknade su ništetne - ističu u udruzi Franak pozivajući sve potrošače koji su otplatili kredite prije konverzije da pokrenu sudske postupke protiv banaka.

Županijski sud u Osijeku dosudio je 19. studenog 2020. presudom Gž-1516/2019 ništetnost odredbe o izlaznoj naknadi za prijevremeno vraćanje kredita te je naložio vraćanje naplaćene naknade u iznosu 3.800 eura odnosno oko 29.000 kuna uz pripadajuće zatezne kamate i 4.700,00 kuna sudskih troškova. Tu odredbu ugovorila je Addiko banka u kreditu s valutnom klauzulom u eurima s potrošačem koji je tužbom zatražio naplaćenu naknadu natrag.
Izvijestili su to iz udruge Franak poručujući kako je sudska praksa za utvrđivanje ništetnosti izlaznih naknada i vraćanje naplaćenih naknada već prilično stabilna s nekoliko pravomoćnih presuda na različitim sudovima.
U presudi iz Osijeka utvrđeno je sljedeće:
Izlazna naknada unaprijed je formulirana u ugovoru, a potrošač na nju nije mogao imati utjecaj.
Takva ugovorna odredba uzrokuje znatnu neravnotežu u pravima i obvezama na štetu potrošača.
U vrijeme ugovaranja čak se nije utvrdila niti visina te naknade, zbog čega je ona i neodrediva.
Addiko nije pretrpio dodatne troškove uslijed prijevremene otplate, u smislu administrativnih troškova ili troškova osoblja.
Kamate nakon prijevremene otplate ne smiju se zaračunavati, pa se ne smije buduća izmakla dobit iz kamata uračunavati kao nekakva izlazna naknada za prijevremenu otplatu.
- Čestitamo tužitelju i njegovu odvjetniku Srđanu Kaleboti koji je zasad jedini odvjetnik koji je svojem klijentu Ivi Soli izvojevao pravomoćnu sudsku presudu za ništetnost dvaju CHF ugovora, na temelju koje više nema niti hipoteku na svojoj nekretnini - poručuju iz udruge Franak.
Ujedno su ponovili što je sve utuživo u hrvatskim kreditima, a radi se o slučajevima za koje postoje pravomoćne presude. Saželi su to u četiri točke: ništetna valutna klauzula CHF, ništetna promjenjiva kamatna stopa koja se mijenja odlukom banke u svim valutama kredita, ništetna izlazna naknada za prijevremenu otplatu kredita i ništetan ugovor s valutnom klauzulom CHF.
Naglašavaju kako za potonje dvije točke još uvijek nemaju potvrdu Vrhovnoga suda RH, pa je to sljedeće što nestrpljivo očekuju.
- Potencijalno će se stvoriti i sudska praksa za naplaćene ulazne naknade za obradu kredita, jer su te naknade jednako netransparentne kao i izlazne naknade, i nisu utemeljene na troškovima koje banke imaju zbog ugovaranja kredita, nego je to unaprijed formulirana ugovorna odredba koja stvara neravnotežu na štetu potrošača, kao što je to presudio i Sud EU već u dvama presudama, C-84/19 i C-224/19. Banke su ugovarale od 1% do 3% iznosa kredita kao ulaznu naknadu, i to su onda naplaćivale iz samoga kredita, a prema Sudu EU takve naknade su ništetne - ističu u udruzi Franak pozivajući sve potrošače koji su otplatili kredite prije konverzije da pokrenu sudske postupke protiv banaka.
