Nakon što je Ustavni sud ukinuo pravomoćnu presudu kojom je poznati ugostitelj iz Zatona Obrovačkog Mile Minja Anić osuđen zbog klevetanja načelnika Općine Jasenice Martina Baričevića, u ponovljenom suđenju na Općinskom sudu u Zadru dogodio se obrat – Anić kriv nije! Oslobađajuću presudu potvrdio je Županijski sud u Vukovaru, donosi Jutarnji list.
A sve je krenulo nakon medijskih napisao u kojima je Anić prozvao Baričevića da mu besplatno hrani općinsku svitu.
Sud je zaključio da “Anić nije imao namjeru klevetati Martina Baričevića i Općinu Jasenice već da je samo iznio svoje mišljenje te uputio kritiku kako mu kao ugostitelju nisu izmireni računi na ime izvršenih usluga hrane i pića, a koje su troškove tužitelji, njihovi gosti i djelatnici Općine ostvarili u Anićevoj 'Aniti' kroz duže vremensko razdoblje”, pa da je stoga ugostitelj “istupio u sredstvima informiranja kako bi pokušao naplatiti ostvarena potraživanja na ime izvršenih ugostiteljskih usluga.”
Točnije sve je počelo davne 2013. kada je Anić, između ostaloga, izjavio da su načelnik Baričević i njegovi općinski suradnici kod njega u gostionici Anita jeli i pili te da nisu platili račune. A računica je bila oko 185 tisuća kuna što, preračunato u tadašnju cijenu janjetine, je pokrivalo stado od stotinjak janjaca. Osim janjetine, načelnik i njegova svita jeli su i tuke, pivce, priloge, salate...
- Sve je neplaćeno i nema mi druge nego na sudu tražiti naplatu. Slali smo račune poštom, s povratnicom, no nije bilo ni odgovora ni plaćanja. Ništa, kao da nisu ništa pojili i popili. A evo računa, to je potpis konobara s jedne strane i načelnika ili nekog od općinara s druge strane", pojadao se tada medijima Anić, otkrivši i kako se jedan od nepodmirenih računa na 7500 kuna odnosio na troškove zadušnice nakon sprovoda načelnikova brata.
No, umjesto da plati račun, načelnik Baričević se zbog Anićeve javne ispovijesti smatrao oklevetan jer su medijski napisi eksplodirali. “Načelniče, plati račun, izija si stado janjaca. Obračun u Jasenicama. Gostioničaru Minji Aniću dodijalo besplatno hraniti općinsku svitu" objavila je u veljači 2013. Slobodna Dalmacija. "Načelnik pojeo stado ovaca, a nije platio račun", verzija je iz Večernjeg lista dok se Zadarski list pitao "Hoće li M. B. platiti pojedene janjce".
U gostionicu je načelnik Baričević redovito u društvu prijatelja i suradnika dolazio na ručkove i večere, a s ugostiteljem je sklopio dogovor da mu račune šalje nešto kasnije, kad se nakupe. Na sudu je, pak, načelnik tvrdio da su dugovi nastali između 2006. i 2010. te da su mu 2013. dostavljeni u Općinu ispisani na paragon-bloku. Tvrdio je i da računi ne dosežu iznos od 185 tisuća kuna, pa je u drugom sudskom postupku uspio smanjiti potraživanje za 13 tisuća kuna.
Ustavni sud je, međutim, ocijenio da osporene odluke sudova u konkretnom slučaju, o utvrđivanju odgovornosti i kažnjavanju Anića za kazneno djelo klevete, predstavljaju miješanje države u podnositeljevu slobodu izražavanja. Utvrđuju da su granice dopuštene kritike, kad je riječ o tijelima javne vlasti, mnogo šire nego što je to slučaj s privatnim osobama, a šire su čak i u odnosu na kritiku političara i dužnosnika.
Prema mišljenju Ustavnog suda redovni sudovi nisu uvjerljivo utvrdili postojanje prijeke društvene potrebe koja bi zahtijevala da se pravu privatnih tužitelja na zaštitu njihovog ugleda da prednost pred pravom podnositelja na slobodu izražavanja. Razlozi koje su sudovi naveli ne pokazuju da je početna kaznena osuda Anića, s obzirom na konkretne okolnosti, bila nužna u demokratskom društvu.

Nakon što je Ustavni sud ukinuo pravomoćnu presudu kojom je poznati ugostitelj iz Zatona Obrovačkog Mile Minja Anić osuđen zbog klevetanja načelnika Općine Jasenice Martina Baričevića, u ponovljenom suđenju na Općinskom sudu u Zadru dogodio se obrat – Anić kriv nije! Oslobađajuću presudu potvrdio je Županijski sud u Vukovaru, donosi Jutarnji list.
A sve je krenulo nakon medijskih napisao u kojima je Anić prozvao Baričevića da mu besplatno hrani općinsku svitu.
Sud je zaključio da “Anić nije imao namjeru klevetati Martina Baričevića i Općinu Jasenice već da je samo iznio svoje mišljenje te uputio kritiku kako mu kao ugostitelju nisu izmireni računi na ime izvršenih usluga hrane i pića, a koje su troškove tužitelji, njihovi gosti i djelatnici Općine ostvarili u Anićevoj 'Aniti' kroz duže vremensko razdoblje”, pa da je stoga ugostitelj “istupio u sredstvima informiranja kako bi pokušao naplatiti ostvarena potraživanja na ime izvršenih ugostiteljskih usluga.”
Točnije sve je počelo davne 2013. kada je Anić, između ostaloga, izjavio da su načelnik Baričević i njegovi općinski suradnici kod njega u gostionici Anita jeli i pili te da nisu platili račune. A računica je bila oko 185 tisuća kuna što, preračunato u tadašnju cijenu janjetine, je pokrivalo stado od stotinjak janjaca. Osim janjetine, načelnik i njegova svita jeli su i tuke, pivce, priloge, salate...
- Sve je neplaćeno i nema mi druge nego na sudu tražiti naplatu. Slali smo račune poštom, s povratnicom, no nije bilo ni odgovora ni plaćanja. Ništa, kao da nisu ništa pojili i popili. A evo računa, to je potpis konobara s jedne strane i načelnika ili nekog od općinara s druge strane", pojadao se tada medijima Anić, otkrivši i kako se jedan od nepodmirenih računa na 7500 kuna odnosio na troškove zadušnice nakon sprovoda načelnikova brata.
No, umjesto da plati račun, načelnik Baričević se zbog Anićeve javne ispovijesti smatrao oklevetan jer su medijski napisi eksplodirali. “Načelniče, plati račun, izija si stado janjaca. Obračun u Jasenicama. Gostioničaru Minji Aniću dodijalo besplatno hraniti općinsku svitu" objavila je u veljači 2013. Slobodna Dalmacija. "Načelnik pojeo stado ovaca, a nije platio račun", verzija je iz Večernjeg lista dok se Zadarski list pitao "Hoće li M. B. platiti pojedene janjce".
U gostionicu je načelnik Baričević redovito u društvu prijatelja i suradnika dolazio na ručkove i večere, a s ugostiteljem je sklopio dogovor da mu račune šalje nešto kasnije, kad se nakupe. Na sudu je, pak, načelnik tvrdio da su dugovi nastali između 2006. i 2010. te da su mu 2013. dostavljeni u Općinu ispisani na paragon-bloku. Tvrdio je i da računi ne dosežu iznos od 185 tisuća kuna, pa je u drugom sudskom postupku uspio smanjiti potraživanje za 13 tisuća kuna.
Ustavni sud je, međutim, ocijenio da osporene odluke sudova u konkretnom slučaju, o utvrđivanju odgovornosti i kažnjavanju Anića za kazneno djelo klevete, predstavljaju miješanje države u podnositeljevu slobodu izražavanja. Utvrđuju da su granice dopuštene kritike, kad je riječ o tijelima javne vlasti, mnogo šire nego što je to slučaj s privatnim osobama, a šire su čak i u odnosu na kritiku političara i dužnosnika.
Prema mišljenju Ustavnog suda redovni sudovi nisu uvjerljivo utvrdili postojanje prijeke društvene potrebe koja bi zahtijevala da se pravu privatnih tužitelja na zaštitu njihovog ugleda da prednost pred pravom podnositelja na slobodu izražavanja. Razlozi koje su sudovi naveli ne pokazuju da je početna kaznena osuda Anića, s obzirom na konkretne okolnosti, bila nužna u demokratskom društvu.
