Odjel za javni red i mir Visokog prekršajnog suda sutra će održati sjednicu na kojoj će zauzeti pravno stajalište o tome krši li Marko Perković Thompson zakon kad na početku “Bojne Čavoglave” uzvikuje “Za dom spremni”.

Potvrdila nam je to glasnogovornica tog suda Gordana Korotaj. Tom bi se sjednicom trebala razriješiti pravna drama koja već treći mjesec traje na tom sudu, a vezana je uz oslobađajuću presudu Perkoviću Thompsonu koju je tročlano vijeće tog suda jednoglasno donijelo u studenome prošle godine, piše Jutarnji list.

Suprotno mišljenje

Podsjetimo, tročlano vijeće u sastavu Ivanka Mašić i Mirjan Margetić, članice, te Anđa Ćorluka, predsjednica potvrdilo je prvostupanjsku presudu Prekršajnog suda u Šibeniku, kojom je Thompson oslobođen krivnje zbog izvikivanja pokliča “Za dom spremni” na početku budnice “Bojna Čavoglave” na koncertima održanim 5. kolovoza 2015., 5. kolovoza 2016. te 27. kolovoza 2017. godine.

Suprotno uvriježenom mišljenju da se policija u takvim slučajevima nikad ne žali, PU šibensko-kninska nije odustajala pa je uložila žalbu Visokom prekršajnom sudu, ali je Visoki prekršajni sud žalbu odbio.

Međutim, presuda spomenutog sudskog vijeća nije otpravljena s Visokog prekršajnog suda jer je “zapela” u evidenciji sudske prakse. Riječ je o sudskom odjelu kroz koji prolazi svaka novodonesena presuda kako bi se utvrdilo je li sukladna utvrđenoj sudskoj praksi, odnosno već donesenim presudama u istim pravnim pitanjima.

Kako je Visoki prekršajni sud izrekao već nekoliko osuđujućih pravomoćnih presuda vezanih uz pozdrav “Za dom spremni”, a posljednju u nizu donio je u ljeto prošle godine kad je makarskog pjevača Marija Rosu osudio na novčanu kaznu upravo zbog uzvikivanja pokliča “Za dom spremni” na početku izvođenja Thompsonova hita “Bojna Čavoglave”, evidencija sudske prakse ustanovila je da je oslobađajuća presuda u slučaju Thompsona suprotna već ustanovljenoj sudskoj praksi tog suda.

U takvim slučajevima presuda ne odlazi sa suda, nego je Odjel evidencije sudske prakse s vrlo jasnim primjedbama vraća sudskom vijeću koje ju je donijelo na ponovno razmatranje. Međutim, ovo je sudsko vijeće odbacilo primjedbe i jednoglasno ostalo pri prijašnjoj presudi.

Obvezujuća odluka

U takvim slučajevima, koji u sudskoj praksi nisu česti, saziva se sjednica sudskog odjela. Sutra će, dakle, devet sudaca, među kojima su i tri spomenute sutkinje, raspravljati i većinom glasova odlučiti je li Thompsonov poklič “Za dom spremni” protuzakonit. Njihovo stajalište obvezujuće je za sve suce. Ako većina sudaca u Odjelu za javni red i mir odluči da Thompson tim pokličem na početku svog hita krši zakon, sudsko vijeće morat će promijeniti presudu i Thompsonu izreći prekršajnu kaznu.

U obrazloženju presude Mariju Rosi, uz ostalo, stoji: “Činjenica da je navedeni pozdrav dio autorskog umjetničkog djela ne mijenja činjenicu da simbolizira mržnju prema ljudima drugačije vjerske i etničke pripadnosti, manifestaciju rasističke ideologije kao i podcjenjivanje žrtava zločina protiv čovječnosti te da je protivna Ustavu.”

Zanimljivo je također da je sutkinja Anđa Ćorluka u prosincu 2015. predsjedala sudskim vijećem koje je pravomoćno kaznilo bivšeg predsjednika HČSP-a Josipa Miljka zbog izvikivanja pozdrava “Za dom spremni”.

Odjel za javni red i mir Visokog prekršajnog suda sutra će održati sjednicu na kojoj će zauzeti pravno stajalište o tome krši li Marko Perković Thompson zakon kad na početku “Bojne Čavoglave” uzvikuje “Za dom spremni”.

Potvrdila nam je to glasnogovornica tog suda Gordana Korotaj. Tom bi se sjednicom trebala razriješiti pravna drama koja već treći mjesec traje na tom sudu, a vezana je uz oslobađajuću presudu Perkoviću Thompsonu koju je tročlano vijeće tog suda jednoglasno donijelo u studenome prošle godine, piše Jutarnji list.

Suprotno mišljenje

Podsjetimo, tročlano vijeće u sastavu Ivanka Mašić i Mirjan Margetić, članice, te Anđa Ćorluka, predsjednica potvrdilo je prvostupanjsku presudu Prekršajnog suda u Šibeniku, kojom je Thompson oslobođen krivnje zbog izvikivanja pokliča “Za dom spremni” na početku budnice “Bojna Čavoglave” na koncertima održanim 5. kolovoza 2015., 5. kolovoza 2016. te 27. kolovoza 2017. godine.

Suprotno uvriježenom mišljenju da se policija u takvim slučajevima nikad ne žali, PU šibensko-kninska nije odustajala pa je uložila žalbu Visokom prekršajnom sudu, ali je Visoki prekršajni sud žalbu odbio.

Međutim, presuda spomenutog sudskog vijeća nije otpravljena s Visokog prekršajnog suda jer je “zapela” u evidenciji sudske prakse. Riječ je o sudskom odjelu kroz koji prolazi svaka novodonesena presuda kako bi se utvrdilo je li sukladna utvrđenoj sudskoj praksi, odnosno već donesenim presudama u istim pravnim pitanjima.

Kako je Visoki prekršajni sud izrekao već nekoliko osuđujućih pravomoćnih presuda vezanih uz pozdrav “Za dom spremni”, a posljednju u nizu donio je u ljeto prošle godine kad je makarskog pjevača Marija Rosu osudio na novčanu kaznu upravo zbog uzvikivanja pokliča “Za dom spremni” na početku izvođenja Thompsonova hita “Bojna Čavoglave”, evidencija sudske prakse ustanovila je da je oslobađajuća presuda u slučaju Thompsona suprotna već ustanovljenoj sudskoj praksi tog suda.

U takvim slučajevima presuda ne odlazi sa suda, nego je Odjel evidencije sudske prakse s vrlo jasnim primjedbama vraća sudskom vijeću koje ju je donijelo na ponovno razmatranje. Međutim, ovo je sudsko vijeće odbacilo primjedbe i jednoglasno ostalo pri prijašnjoj presudi.

Obvezujuća odluka

U takvim slučajevima, koji u sudskoj praksi nisu česti, saziva se sjednica sudskog odjela. Sutra će, dakle, devet sudaca, među kojima su i tri spomenute sutkinje, raspravljati i većinom glasova odlučiti je li Thompsonov poklič “Za dom spremni” protuzakonit. Njihovo stajalište obvezujuće je za sve suce. Ako većina sudaca u Odjelu za javni red i mir odluči da Thompson tim pokličem na početku svog hita krši zakon, sudsko vijeće morat će promijeniti presudu i Thompsonu izreći prekršajnu kaznu.

U obrazloženju presude Mariju Rosi, uz ostalo, stoji: “Činjenica da je navedeni pozdrav dio autorskog umjetničkog djela ne mijenja činjenicu da simbolizira mržnju prema ljudima drugačije vjerske i etničke pripadnosti, manifestaciju rasističke ideologije kao i podcjenjivanje žrtava zločina protiv čovječnosti te da je protivna Ustavu.”

Zanimljivo je također da je sutkinja Anđa Ćorluka u prosincu 2015. predsjedala sudskim vijećem koje je pravomoćno kaznilo bivšeg predsjednika HČSP-a Josipa Miljka zbog izvikivanja pozdrava “Za dom spremni”.

Odjel za javni red i mir Visokog prekršajnog suda sutra će održati sjednicu na kojoj će zauzeti pravno stajalište o tome krši li Marko Perković Thompson zakon kad na početku “Bojne Čavoglave” uzvikuje “Za dom spremni”.

Potvrdila nam je to glasnogovornica tog suda Gordana Korotaj. Tom bi se sjednicom trebala razriješiti pravna drama koja već treći mjesec traje na tom sudu, a vezana je uz oslobađajuću presudu Perkoviću Thompsonu koju je tročlano vijeće tog suda jednoglasno donijelo u studenome prošle godine, piše Jutarnji list.

Podsjetimo, tročlano vijeće u sastavu Ivanka Mašić i Mirjan Margetić, članice, te Anđa Ćorluka, predsjednica potvrdilo je prvostupanjsku presudu Prekršajnog suda u Šibeniku, kojom je Thompson oslobođen krivnje zbo...
