Ni 40 dana otkako su u sjedište DORH-a čelnici Antifašističke lige Hrvatske predali inicijativu za zaštitu zakonitosti zbog presude Visokog prekršajnog suda kojom je Marko Perković Thompson pravomoćno oslobođen za izvikivanje pokliča "Za dom spremni", DORH još nije odlučio hoće li pred Vrhovnim sudom pokrenuti postupak ili ne, piše Jutarnji list.

Inicijativu za zaštitu zakonitosti povodom neke presude može podnijeti svatko, ali DORH je jedini ovlašten razmotriti tu inicijativu i odlučiti hoće li pred Vrhovnim sudom pokrenuti postupak za zaštitu zakonitosti ili ne. Iz DORH-a su nam ovih dana odgovorili kako o inicijativi Antifašističke lige nisu odlučili jer čekaju očitovanje Općinskog državnog odvjetništva u Šibeniku.

Ni Policijska uprava šibensko-kninska čija je glasnogovornica Marica Košta prije mjesec i pol dana za Jutarnji list najavila da će iskoristiti sve izvanredne pravne lijekove koji im još stoje na raspolaganju kako bi osporili pravomoćnu oslobađajuću presudu Visokog prekršajnog suda u slučaju Thompson, usprkos zvučnim najavama, nije poduzela ništa.

Naime, PU šibensko-kninska je u prekršajnom postupku vođenom protiv Marka Perkovića Thompsona bila stranka u postupku.

Upravo su njezini policajci prijavili Thompsona za tri prekršaja protiv javnog reda i mira počinjena javnim izvikivanjem pokliča "Za dom spremni".

Riječ je o Thompsonovim koncertima održanim 5. kolovoza 2015. u Kninu, zatim 5. kolovoza 2016. također u Kninu i na koncertu održanom 26. kolovoza 2016. u diskoteci Hacienda u Vodicama. Kao stranka u postupku PU šibensko-kninska po zakonu je ovlaštena uputiti DORH-u inicijativu za pokretanje postupka preispitivanja zakonitosti oslobađajuće pravomoćne presude. Međutim, jedina ovlaštena institucija koja Vrhovnom sudu može predložiti pokretanje toga postupka je DORH.

Iz šibenskog Općinskog državnog odvjetništva su nam odgovorili da nisu primili nikakvu inicijativu PU šibensko-kninske vezanu za osporavanje Thompsonove presude te da je jedina inicijativa koju još uvijek razmatraju stigla od Antifašističke lige.

ODO Šibenik će nakon razmatranja o svom stajalištu o inicijativi AFL-a izvijestiti glavnu državnu odvjetnicu Zlatu Hrvoj Šipek, a ona će u konačnici odlučiti hoće li pred Vrhovnim sudom pokrenuti postupak zaštite zakonitosti povodom oslobađajuće presude Thompsonu.

A sve da DORH, kojemu se očito u ovom slučaju ne žuri, i uvaži inicijativu Antifašističke lige i uputi Vrhovnom sudu zahtjev za ocjenu zakonitosti presude, i da ga Vrhovni sud prihvati, odluka Vrhovnog suda više ne bi imala učinak na oslobađajuću presudu Visokog prekršajnog suda u slučaju Thompson.

Naime, za jedan od tri prekršaja za koje je policija prijavila Thompsona, već je nastupila zastara, a za preostala dva nastupit će za manje od mjesec dana.

Međutim, u slučaju da DORH pokrene postupak za zaštitu zakonitosti vezan za oslobađajuću presudu Marku Perkoviću Thompsonu, a Vrhovni sud usvoji taj zahtjev, odluka Vrhovnog suda imala bi obvezujući učinak na sve buduće sudske presude vezane uz poklič "Za dom spremni". Stajalište Vrhovnog suda obvezujuće je za sve suce nižih sudova, piše Jutarnji.

Ni 40 dana otkako su u sjedište DORH-a čelnici Antifašističke lige Hrvatske predali inicijativu za zaštitu zakonitosti zbog presude Visokog prekršajnog suda kojom je Marko Perković Thompson pravomoćno oslobođen za izvikivanje pokliča "Za dom spremni", DORH još nije odlučio hoće li pred Vrhovnim sudom pokrenuti postupak ili ne, piše Jutarnji list.

Inicijativu za zaštitu zakonitosti povodom neke presude može podnijeti svatko, ali DORH je jedini ovlašten razmotriti tu inicijativu i odlučiti hoće li pred Vrhovnim sudom pokrenuti postupak za zaštitu zakonitosti ili ne. Iz DORH-a su nam ovih dana odgovorili kako o inicijativi Antifašističke lige nisu odlučili jer čekaju očitovanje Općinskog državnog odvjetništva u Šibeniku.

Ni Policijska uprava šibensko-kninska čija je glasnogovornica Marica Košta prije mjesec i pol dana za Jutarnji list najavila da će iskoristiti sve izvanredne pravne lijekove koji im još stoje na raspolaganju kako bi osporili pravomoćnu oslobađajuću presudu Visokog prekršajnog suda u slučaju Thompson, usprkos zvučnim najavama, nije poduzela ništa.

Naime, PU šibensko-kninska je u prekršajnom postupku vođenom protiv Marka Perkovića Thompsona bila stranka u postupku.

Upravo su njezini policajci prijavili Thompsona za tri prekršaja protiv javnog reda i mira počinjena javnim izvikivanjem pokliča "Za dom spremni".

Riječ je o Thompsonovim koncertima održanim 5. kolovoza 2015. u Kninu, zatim 5. kolovoza 2016. također u Kninu i na koncertu održanom 26. kolovoza 2016. u diskoteci Hacienda u Vodicama. Kao stranka u postupku PU šibensko-kninska po zakonu je ovlaštena uputiti DORH-u inicijativu za pokretanje postupka preispitivanja zakonitosti oslobađajuće pravomoćne presude. Međutim, jedina ovlaštena institucija koja Vrhovnom sudu može predložiti pokretanje toga postupka je DORH.

Iz šibenskog Općinskog državnog odvjetništva su nam odgovorili da nisu primili nikakvu inicijativu PU šibensko-kninske vezanu za osporavanje Thompsonove presude te da je jedina inicijativa koju još uvijek razmatraju stigla od Antifašističke lige.

ODO Šibenik će nakon razmatranja o svom stajalištu o inicijativi AFL-a izvijestiti glavnu državnu odvjetnicu Zlatu Hrvoj Šipek, a ona će u konačnici odlučiti hoće li pred Vrhovnim sudom pokrenuti postupak zaštite zakonitosti povodom oslobađajuće presude Thompsonu.

A sve da DORH, kojemu se očito u ovom slučaju ne žuri, i uvaži inicijativu Antifašističke lige i uputi Vrhovnom sudu zahtjev za ocjenu zakonitosti presude, i da ga Vrhovni sud prihvati, odluka Vrhovnog suda više ne bi imala učinak na oslobađajuću presudu Visokog prekršajnog suda u slučaju Thompson.

Naime, za jedan od tri prekršaja za koje je policija prijavila Thompsona, već je nastupila zastara, a za preostala dva nastupit će za manje od mjesec dana.

Međutim, u slučaju da DORH pokrene postupak za zaštitu zakonitosti vezan za oslobađajuću presudu Marku Perkoviću Thompsonu, a Vrhovni sud usvoji taj zahtjev, odluka Vrhovnog suda imala bi obvezujući učinak na sve buduće sudske presude vezane uz poklič "Za dom spremni". Stajalište Vrhovnog suda obvezujuće je za sve suce nižih sudova, piše Jutarnji.

Ni 40 dana otkako su u sjedište DORH-a čelnici Antifašističke lige Hrvatske predali inicijativu za zaštitu zakonitosti zbog presude Visokog prekršajnog suda kojom je Marko Perković Thompson pravomoćno oslobođen za izvikivanje pokliča "Za dom spremni", DORH još nije odlučio hoće li pred Vrhovnim sudom pokrenuti postupak ili ne, piše Jutarnji list.

Inicijativu za zaštitu zakonitosti povodom neke presude može podnijeti svatko, ali DORH je jedini ovlašten razmotriti tu inicijativu i odlučiti hoće li pred Vrhovnim sudom pokrenuti postupak za zaštitu zakonitosti ili ne. Iz DORH-a su nam ovih dana odgovorili kako o inicijativi Antifašističke lige nisu odlučili jer čekaju očitovanje Općinskog državnog odvjetništva u Šibeniku.
