Slučaj ubojstva teško bolesne kćeri uzburkao je i jednim dijelom podijelio javnost u mišljenju treba li i kako kazniti optuženog oca. Naš zakon ne poznaje kazneno djelo ubojstva iz milosrđa ili eutanaziju tako da se Joso Grgurić iz Siska može osuditi samo za tzv. obično ubojstvo za koje je zapriječena kazna od 5 do 15 godina zatvora. S obzirom na specifične okolnosti slučaja, mnogi se pitaju je li moguće osloboditi ga kazne.

- Prema zakonu kod kaznenih djela kojima je najniža zapriječena kazna 5 godina, donja granica ublažavanja je dvije godine. Sud, prilikom odlučivanja o kazni, ne može ići ispod te granice, međutim, ako se državno odvjetništvo sporazumi s optuženim, postoji mogućnost da se ide na pola od te najniže kazne što znači godinu dana. Ali, ponavljam, jedino uz odobrenje tužitelja - kazao nam je odvjetnik mr. sc. Željko Gulišija.

Zakon predviđa i mogućnost oslobođenja od kazne, ali samo kod kaznenih djela počinjenih iz nehaja, a kako se u slučaju iz Siska radi o namjeri, ta odredba nije primjenjiva.

– Oslobađanje od kazni u slučajevima gdje roditelj skrivi smrt djeteta je najčešće prilikom prometnih nesreća. Ako roditelj izazove prometnu nesreću u kojoj mu pogine dijete, tužiteljstvo ide u kazneni progon i traži osuđujuću presudu, ali

i oslobađanje od kazne zbog teških posljedica po počinitelja - pojašnjavaju nam na državnom odvjetništvu. U slučaju da optuženog oca iz Siska psihijatri budu proglasili neubrojivim, što nije vjerojatno, sudilo bi mu se po Zakonu o zaštiti osoba s duševnim smetnjama prema kojem se osoba proglasi krivom, ali umjesto u zatvor, ide na liječenje ili u zatvorenu ustanovu, ovisi o kazni.

Vjerojatnije je kako će po stručnjacima biti proglašen smanjeno ubrojiv zbog bolesti kćerke i njene patnje što u konačnici kod osuđujuće presude znači olakotnu okolnost tj. nižu kaznu, ali nikako ispod zakonskog praga.

Slučaj ubojstva teško bolesne kćeri uzburkao je i jednim dijelom podijelio javnost u mišljenju treba li i kako kazniti optuženog oca. Naš zakon ne poznaje kazneno djelo ubojstva iz milosrđa ili eutanaziju tako da se Joso Grgurić iz Siska može osuditi samo za tzv. obično ubojstvo za koje je zapriječena kazna od 5 do 15 godina zatvora. S obzirom na specifične okolnosti slučaja, mnogi se pitaju je li moguće osloboditi ga kazne.

- Prema zakonu kod kaznenih djela kojima je najniža zapriječena kazna 5 godina, donja granica ublažavanja je dvije godine. Sud, prilikom odlučivanja o kazni, ne može ići ispod te granice, međutim, ako se državno odvjetništvo sporazumi s optuženim, postoji mogućnost da se ide na pola od te najniže kazne što znači godinu dana. Ali, ponavljam, jedino uz odobrenje tužitelja - kazao nam je odvjetnik mr. sc. Željko Gulišija.

Zakon predviđa i mogućnost oslobođenja od kazne, ali samo kod kaznenih djela počinjenih iz nehaja, a kako se u slučaju iz Siska radi o namjeri, ta odredba nije primjenjiva.

– Oslobađanje od kazni u slučajevima gdje roditelj skrivi smrt djeteta je najčešće prilikom prometnih nesreća. Ako roditelj izazove prometnu nesreću u kojoj mu pogine dijete, tužiteljstvo ide u kazneni progon i traži osuđujuću presudu, ali

i oslobađanje od kazne zbog teških posljedica po počinitelja - pojašnjavaju nam na državnom odvjetništvu. U slučaju da optuženog oca iz Siska psihijatri budu proglasili neubrojivim, što nije vjerojatno, sudilo bi mu se po Zakonu o zaštiti osoba s duševnim smetnjama prema kojem se osoba proglasi krivom, ali umjesto u zatvor, ide na liječenje ili u zatvorenu ustanovu, ovisi o kazni.

Vjerojatnije je kako će po stručnjacima biti proglašen smanjeno ubrojiv zbog bolesti kćerke i njene patnje što u konačnici kod osuđujuće presude znači olakotnu okolnost tj. nižu kaznu, ali nikako ispod zakonskog praga.
