Vrhovni sud u petak je poništio nepravomoćnu presudu Županijskog suda u Splitu kojom je Ivica Mladineo (67), nekadašnji direktor Brodarske zadruge „Zora“ iz Splita, u svibnju prošle godine osuđen na šest godina zatvora zbog havarije broda „Nautika 64“ u kojoj su 5. siječnja 2001. godine, na 35 nautičkih milja od talijanske Ancone, život izgubila četvorica pomoraca.
Kako doznajemo, mlađi brat Vinka Mladinea, bivšeg čelnika Fonda za zaštitu okoliša i energetsku učinkovitost, pušten je iz zatvora na splitskim Bilicama, a Županijski sud morat će organizirati proces pred novim sudskim vijećem. Brodarska zadruga u listopadu prošle godine skončala je u stečaju.
Tragedija posade „Nautike 64“ jedna je od najvećih u novijoj hrvatskoj pomorskoj povijesti. Podsjetimo, brod je 4. siječnja 2001. isplovio iz Splita prema Italiji s teretom od 155 tona kamenih blokova ukrcanih na pristaništu „Jadrankamenova“ kamenoloma kod Pučišća na Braču.
U stravičnoj nesreći koja se dogodila u ranim jutarnjim satima idućeg dana poginuli su kap. Petar Jašić (63), zapovjednik broda, Duško Vuković (27), kormilar, Siniša Madunić (40), upravitelj stroja, te mornar Marko Mijatović. Spasio se samo danas 48-godišnji Geni Vuković, koji se nakon sat i pol plivanja hladnim Jadranom domogao platforme u talijanskom teritorijalnome moru i (p)ostao jedini svjedok nesreće.
Povjerenstvo za utvrđivanje uzroka havarije odmah je ustvrdilo da je „brod bio tehnički ispravan i imao sve svjedodžbe, ali uz ograničenje prema kojem nije smio ploviti dalje od 20 milja od najbližeg kopna ili otoka“.
- To znači da je „Nautika 64“ imala dopuštenje za plovidbu smjerom Splitska vrata-Hvar-Korčula-Lastovo-Palagruža, pa uz talijansku obalu do odredišta, a ne otvorenim morem između Dugog otoka i Ancone – izjavili su istražitelji prije više od 12 godina.
Iako takve tvrdnje nisu ostavljale puno dvojbi oko daljnjeg raspleta situacije, dokazni postupak ipak je već na samom startu bio otežan, jer je brod potonuo tijekom pokušaja tegljenja prema hrvatskom dijelu Jadrana, pa nikada nisu obavljeni očevid i pregled trupa koji bi dali odgovore na brojna ključna pitanja za kasniji pravosudni postupak.
- Stid me je što sam dio pravosudnog sustava koji 11 godina nije donio presudu u ovom predmetu – kazala je sutkinja Katija Blaće na kraju lanjskog suđenja Mladineu. Kako je tada izvijestila naša novinarka Katarina Marić Banje, optužnica za slučaj „Nautika 64“ podignuta je u listopadu 2004. godine, a postala je pravomoćna dvije godine kasnije. Glavna rasprava počela je u veljači 2008., ali je u međuvremenu spis dodijeljen drugom sucu, pa je sve krenulo ispočetka. Tek je treći sudac izrekao presudu.GORDAN ZUBČIĆ

Vrhovni sud u petak je poništio nepravomoćnu presudu Županijskog suda u Splitu kojom je Ivica Mladineo (67), nekadašnji direktor Brodarske zadruge „Zora“ iz Splita, u svibnju prošle godine osuđen na šest godina zatvora zbog havarije broda „Nautika 64“ u kojoj su 5. siječnja 2001. godine, na 35 nautičkih milja od talijanske Ancone, život izgubila četvorica pomoraca.
Kako doznajemo, mlađi brat Vinka Mladinea, bivšeg čelnika Fonda za zaštitu okoliša i energetsku učinkovitost, pušten je iz zatvora na splitskim Bilicama, a Županijski sud morat će organizirati proces pred novim sudskim vijećem. Brodarska zadruga u listopadu prošle godine skončala je u stečaju.
Tragedija posade „Nautike 64“ jedna je od najvećih u novijoj hrvatskoj pomorskoj povijesti. Podsjetimo, brod je 4. siječnja 2001. isplovio iz Splita prema Italiji s teretom od 155 tona kamenih blokova ukrcanih na pristaništu „Jadrankamenova“ kamenoloma kod Pučišća na Braču.
U stravičnoj nesreći koja se dogodila u ranim jutarnjim satima idućeg dana poginuli su kap. Petar Jašić (63), zapovjednik broda, Duško Vuković (27), kormilar, Siniša Madunić (40), upravitelj stroja, te mornar Marko Mijatović. Spasio se samo danas 48-godišnji Geni Vuković, koji se nakon sat i pol plivanja hladnim Jadranom domogao platforme u talijanskom teritorijalnome moru i (p)ostao jedini svjedok nesreće.
Povjerenstvo za utvrđivanje uzroka havarije odmah je ustvrdilo da je „brod bio tehnički ispravan i imao sve svjedodžbe, ali uz ograničenje prema kojem nije smio ploviti dalje od 20 milja od najbližeg kopna ili otoka“.
- To znači da je „Nautika 64“ imala dopuštenje za plovidbu smjerom Splitska vrata-Hvar-Korčula-Lastovo-Palagruža, pa uz talijansku obalu do odredišta, a ne otvorenim morem između Dugog otoka i Ancone – izjavili su istražitelji prije više od 12 godina.
Iako takve tvrdnje nisu ostavljale puno dvojbi oko daljnjeg raspleta situacije, dokazni postupak ipak je već na samom startu bio otežan, jer je brod potonuo tijekom pokušaja tegljenja prema hrvatskom dijelu Jadrana, pa nikada nisu obavljeni očevid i pregled trupa koji bi dali odgovore na brojna ključna pitanja za kasniji pravosudni postupak.
- Stid me je što sam dio pravosudnog sustava koji 11 godina nije donio presudu u ovom predmetu – kazala je sutkinja Katija Blaće na kraju lanjskog suđenja Mladineu. Kako je tada izvijestila naša novinarka Katarina Marić Banje, optužnica za slučaj „Nautika 64“ podignuta je u listopadu 2004. godine, a postala je pravomoćna dvije godine kasnije. Glavna rasprava počela je u veljači 2008., ali je u međuvremenu spis dodijeljen drugom sucu, pa je sve krenulo ispočetka. Tek je treći sudac izrekao presudu.GORDAN ZUBČIĆ
