stdClass Object ( [id] => 225698 [title] => DORH predao žalbu: traže da se Slavici opet sudi za Kornate [alias] => dorh-predao-zalbu-traze-da-se-slavici-opet-sudi-za-kornate [catid] => 243 [published] => 1 [introtext] => [fulltext] => Županijsko državno odvjetništvo u Šibeniku je podnijelo Vrhovnom sudu Republike Hrvatske žalbu na presudu Županijskog suda u Zadru kojom je šibenski vatrogasni zapovjednik Dražen Slavica oslobođen optužbe zbog počinjenja teškog kaznenog djela protiv opće sigurnosti iz čl. 271. st. 2. Kaznenog zakona koje je 30. kolovoza 2007. godine rezultiralo smrću 12-orice vatrogasaca JVP Šibenik, DVD Tisno i DVD Vodice, te teškim ozljedama Frane Lučića koji je jedini preživio tragičnu vatrogasnu ekpediciju. Žalba je predana u petak, a ŽDO je u ponedjeljak o tome obavijestilo javnost, prenose 24 sata.

- Žalba je podnijeta zbog pogrešno i nepotpuno utvrđenog činjeničnog stanja te zbog bitnih povreda odredaba kaznenog postupka. Naime, ocijenjeno je da je sud iz izvedenih dokaza donio pogrešan zaključak o činjenicama bitnim za presuđivanje te da nije izveo sve dokaze predložene od državnog odvjetništva, a pored toga počinjeno je više bitnih povreda odredaba kaznenog postupka. U žalbi je predloženo da presuda bude ukinuta i vraćena na ponovni postupak i odluku - stoji u priopćenju Županijskog državnog odvjetništva u Šibeniku.

Kaznenog zakona koje je 30. kolovoza 2007. godine rezultiralo smrću 12-orice vatrogasaca JVP Šibenik, DVD Tisno i DVD Vodice, te teškim ozljedama Frane Lučića koji je jedini preživio tragičnu vatrogasnu ekpediciju. Žalba je predana u petak, a ŽDO je u ponedjeljak o tome obavijestilo javnost, prenose 24 sata.

- Žalba je podnijeta zbog pogrešno i nepotpuno utvrđenog činjeničnog stanja te zbog bitnih povreda odredaba kaznenog postupka. Naime, ocijenjeno je da je sud iz izvedenih dokaza donio pogrešan zaključak o činjenicama bitnim za presuđivanje te da nije izveo sve dokaze predložene od državnog odvjetništva, a pored toga počinjeno je više bitnih povreda odredaba kaznenog postupka. U žalbi je predloženo da presuda bude ukinuta i vraćena na ponovni postupak i odluku - stoji u priopćenju Županijskog državnog odvjetništva u Šibeniku.
