Čim je postalo pravomoćno rješenje Trgovačkog suda u Splitu kojim se odbija prijedlog trgovačkog lanca “Victa” za stečajem tvrtke “Atrium Spalatum” – investitora poslovno-stambenog objekta Lazarica na Firulama – zbog milijun i pol eura duga, “Victa” je sudu podnijela novi prijedlog za stečajem te tvrtke. Na Trgovačkom sudu kažu da će prvo taj novi prijedlog usporediti s prijašnjim predmetom, odnosno vidjeti postoje li nove okolnosti.

Dug se odnosi na pozajmicu koju je “Victa” dala da se objekt Lazarica dovede do dobivanja uporabne dozvole, a nakon čega su se uselili stanari i otvorili poslovni prostori.

Sud je odbio prijašnji prijedlog za stečajem “Atrium Spalatuma” jer “Victa” kao razlučni vjerovnik, uz dokaz da postoji razlog za otvaranje stečaja, nije učinila vjerojatnim da tražbinu neće moći potpuno namiriti iz vrijednosti velikog poslovnog prostora u Lazarici u vlasništvu “Atrium Spalatuma” (koji je u najmu “dm-a”) i kuće u Pirovcu (koja nije u vlasništvu tvrtke, nego kćeri njezina direktora i vlasnika Tomislava Bausa), na koje nekretnine taj trgovački lanac ima upisana založna prava kao sredstvo osiguranja naplate svoje tražbine.

Dva nova vještačenja

U tom ranijem predmetu prošle je godine bilo održano ispitno ročište na kojem je tadašnja privremena stečajna upraviteljica Meri Šitić kazala da je tvrtka “Atrium Spalatum” prezadužena i nelikvidna i da će stečajni postupak, ako bude otvoren, biti nemilosrdan i težak jer se radi o sudbinama 58 obitelji koje su u Lazarici kupile stanove.

Jere Matić, odvjetnik “Victe”, kaže da je sudu uz novi prijedlog za stečajem dostavio dva nova vještačenja po kojima je vrijednost založenog poslovnog prostora 950 tisuća eura, a iznos duga s kamatom 1,8 milijuna eura.

– To znači da je dug milijun eura veći od vrijednosti založene nekretnine, a Visoki trgovački sud prihvatio je moju žalbu u dijelu da se privatna kuća u Pirovcu, koja nije na “Atrium Spalatumu”, ne može koristiti u smislu razlučnog prava – rekao je odvjetnik Matić.

Tomislav Baus kaže da ga “Victa” ucjenjuje. Ucjenom smatra i prijedlog “Victe” da će, među ostalim, povući ovrhu s računa “Atrium Spalatuma” ako ta tvrtka prizna osnivanja prava služnosti parkiranja vozila u garaži u Lazarici u korist trgovine, prizna tužbene zahtjeve radi isplate 306 tisuća, 1,5 milijuna, te 323 tisuće kuna, ako joj u vlasništvo prenese poslovni prostor u kojem je “dm”, ali i povuče tužbu pred Upravnim sudom kojim želi dokazati da trgovina nema minimalne tehničke uvjete.

Tomislav Baus tvrdi da “Victa” u Lazarici ne ispunjava minimalne tehničke uvjete jer nema svoja garažna mjesta i agregat.

Čim je postalo pravomoćno rješenje Trgovačkog suda u Splitu kojim se odbija prijedlog trgovačkog lanca “Victa” za stečajem tvrtke “Atrium Spalatum” – investitora poslovno-stambenog objekta Lazarica na Firulama – zbog milijun i pol eura duga, “Victa” je sudu podnijela novi prijedlog za stečajem te tvrtke. Na Trgovačkom sudu kažu da će prvo taj novi prijedlog usporediti s prijašnjim predmetom, odnosno vidjeti postoje li nove okolnosti.

Dug se odnosi na pozajmicu koju je “Victa” dala da se objekt Lazarica dovede do dobivanja uporabne dozvole, a nakon čega su se uselili stanari i otvorili poslovni prostori.

Sud je odbio prijašnji prijedlog za stečajem “Atrium Spalatuma” jer “Victa” kao razlučni vjerovnik, uz dokaz da postoji razlog za otvaranje stečaja, nije učinila vjerojatnim da tražbinu neće moći potpuno namiriti iz vrijednosti velikog poslovnog prostora u Lazarici u vlasništvu “Atrium Spalatuma” (koji je u najmu “dm-a”) i kuće u Pirovcu (koja nije u vlasništvu tvrtke, nego kćeri njezina direktora i vlasnika Tomislava Bausa), na koje nekretnine taj trgovački lanac ima upisana založna prava kao sredstvo osiguranja naplate svoje tražbine.

Dva nova vještačenja

U tom ranijem predmetu prošle je godine bilo održano ispitno ročište na kojem je tadašnja privremena stečajna upraviteljica Meri Šitić kazala da je tvrtka “Atrium Spalatum” prezadužena i nelikvidna i da će stečajni postupak, ako bude otvoren, biti nemilosrdan i težak jer se radi o sudbinama 58 obitelji koje su u Lazarici kupile stanove.

Jere Matić, odvjetnik “Victe”, kaže da je sudu uz novi prijedlog za stečajem dostavio dva nova vještačenja po kojima je vrijednost založenog poslovnog prostora 950 tisuća eura, a iznos duga s kamatom 1,8 milijuna eura.

– To znači da je dug milijun eura veći od vrijednosti založene nekretnine, a Visoki trgovački sud prihvatio je moju žalbu u dijelu da se privatna kuća u Pirovcu, koja nije na “Atrium Spalatumu”, ne može koristiti u smislu razlučnog prava – rekao je odvjetnik Matić.

Tomislav Baus kaže da ga “Victa” ucjenjuje. Ucjenom smatra i prijedlog “Victe” da će, među ostalim, povući ovrhu s računa “Atrium Spalatuma” ako ta tvrtka prizna osnivanja prava služnosti parkiranja vozila u garaži u Lazarici u korist trgovine, prizna tužbene zahtjeve radi isplate 306 tisuća, 1,5 milijuna, te 323 tisuće kuna, ako joj u vlasništvo prenese poslovni prostor u kojem je “dm”, ali i povuče tužbu pred Upravnim sudom kojim želi dokazati da trgovina nema minimalne tehničke uvjete.

Tomislav Baus tvrdi da “Victa” u Lazarici ne ispunjava minimalne tehničke uvjete jer nema svoja garažna mjesta i agregat.
