Udruga Franak je objavila kako je još jedna presuda otišla u njihovu korist. Doduše, prvostupanjska. Njihov status prenosimo u cijelosti:

"U SPLITU PRVOSTUPANJSKA PRESUDA ZA NIŠTETNOST CHF UGOVORA KOJI JE KONVERTIRAN!

Predbožićno raspoloženje dodatno nam je popravio splitski sudac Dragan Ramljak koji je u četvrtak 23.12.21. dosudio ništetnost KONVERTIRANOG CHF ugovora o kreditu uz isplatu preplaćenih anuiteta i pripadajućih zateznih kamata.

Tužitelja je zastupao poznati splitski odvjetnik Srđan Kalebota koji je upravo prvi odvjetnik koji se izborio za pravomoćnost ništetnosti dvaju CHF ugovora o kreditu, i čija će pravomoćna presuda biti temelj i za konačno revizijsko utvrđenje ništetnosti CHF ugovora na Vrhovnom sudu RH, o čemu smo nedavno izvijestili javnost.

Tužitelj je zatražio od PBZ-a samo 163.000 kuna preplaćenih anuiteta uz obračun zateznih kamata, dok će ostatak novca na koji ima pravo zatražiti novom tužbom po pravomoćnosti ove presude iz koje objavljujemo najvažnije izvatke.

Na temelju utvrđene ništetnosti ugovora tužitelj ima pravo na vraćanje svih uplata koje je uplatio banci i pripadajuće zatezne kamate. Banka će zacijelo pritom tražiti prebijanje tih iznosa iznosom kredita koji je isplatila tužitelju, no to će se sve utvrđivati vještačenjem u postupku koji će biti tek pokrenut po pravomoćnosti ove presude.

Razlog zašto tužitelj nije odmah tražio sav iznos na koji ima pravo jest rizik od gubitka glavnog zahtjeva, zbog čega bi na kraju morao platiti sav trošak svojeg odvjetnika koji bi bio jako velik u slučaju velikog iznosa koji se traži tužbenim zahtjevom.

Sada želimo ukazati na najvažnije detalje prvostupanjske presude:

1. Ugovor je ništetan, jer su ništetni bitni sastojci ugovora, a to su promjenjiva kamatna stopa (cijena kredita) i glavni predmet kredita (valuta kredita odnosno obveza u francima).

2. Vrhovni sud je već i prije u reviziji Rev-907/02 utvrdio da ništetnost cijene uzrokuje ništetnost ugovora.

3. Vrhovni sud je već i prije u reviziji Rev-3740/17 utvrdio da su kamata i način vraćanja kredita u anuitetima vezanim uz valutnu klauzulu bitni sastojci ugovora, koji su u konkretnom kreditu ništetni.

4. Županijski sudovi u Varaždinu (Stalna služba u Koprivnici) i Vukovaru također su već pravomoćno utvrdili ništetnost ugovora o kreditu s valutnom klauzulom CHF.

5. Usklađena su stajališta Suda EU, županijskih sudova i Vrhovnog suda RH da ugovor s ništetnom cijenom i ništetnim predmetom ne može opstati.

6. Konverzijom nije izvršeno obeštećenje, niti je zakonom tako nešto bilo predviđeno. Tužitelj po provedenoj konverziji ima pravo na obeštećenje.

7. Budući da je ništetan temeljni ugovor, ništetni su i svi dodaci ugovora, pa je tako ništetan i dodatak kojim je provedena konverzija valute CHF u valutu EURO.

8. U kolektivnom postupku utvrđeno je da su ugovorne odredbe o kamati i valuti ništetne zbog nesavjesnosti i nepoštenja tuženika, pa zbog toga tužitelj ima pravo na zatezne kamate od dana stjecanja tuženika, a ne od dana pravomoćnosti presude.

Tužitelja je zastupao poznati splitski odvjetnik Srđan Kalebota koji je upravo prvi odvjetnik koji se izborio za pravomoćnost ništetnosti dvaju CHF ugovora o kreditu, i čija će pravomoćna presuda biti temelj i za konačno revizijsko utvrđenje ništetnosti CHF ugovora na Vrhovnom sudu RH, o čemu smo nedavno izvijestili javnost.

Tužitelj je zatražio od PBZ-a samo 163.000 kuna preplaćenih anuiteta uz obračun zateznih kamata, dok će ostatak novca na koji ima pravo zatražiti novom tužbom po pravomoćnosti ove presude iz koje objavljujemo najvažnije izvatke.

Na temelju utvrđene ništetnosti ugovora tužitelj ima pravo na vraćanje svih uplata koje je uplatio banci i pripadajuće zatezne kamate. Banka će zacijelo pritom tražiti prebijanje tih iznosa iznosom kredita koji je isplatila tužitelju, no to će se sve utvrđivati vještačenjem u postupku koji će biti tek pokrenut po pravomoćnosti ove presude.

Razlog zašto tužitelj nije odmah tražio sav iznos na koji ima pravo jest rizik od gubitka glavnog zahtjeva, zbog čega bi na kraju morao platiti sav trošak svojeg odvjetnika koji bi bio jako velik u slučaju velikog iznosa koji se traži tužbenim zahtjevom.

Sada želimo ukazati na najvažnije detalje prvostupanjske presude:

1. Ugovor je ništetan, jer su ništetni bitni sastojci ugovora, a to su promjenjiva kamatna stopa (cijena kredita) i glavni predmet kredita (valuta kredita odnosno obveza u francima).

2. Vrhovni sud je već i prije u reviziji Rev-907/02 utvrdio da ništetnost cijene uzrokuje ništetnost ugovora.

3. Vrhovni sud je već i prije u reviziji Rev-3740/17 utvrdio da su kamata i način vraćanja kredita u anuitetima vezanim uz valutnu klauzulu bitni sastojci ugovora, koji su u konkretnom kreditu ništetni.

4. Županijski sudovi u Varaždinu (Stalna služba u Koprivnici) i Vukovaru također su već pravomoćno utvrdili ništetnost ugovora o kreditu s valutnom klauzulom CHF.

5. Usklađena su stajališta Suda EU, županijskih sudova i Vrhovnog suda RH da ugovor s ništetnom cijenom i ništetnim predmetom ne može opstati.

6. Konverzijom nije izvršeno obeštećenje, niti je zakonom tako nešto bilo predviđeno. Tužitelj po provedenoj konverziji ima pravo na obeštećenje.

7. Budući da je ništetan temeljni ugovor, ništetni su i svi dodaci ugovora, pa je tako ništetan i dodatak kojim je provedena konverzija valute CHF u valutu EURO.

8. U kolektivnom postupku utvrđeno je da su ugovorne odredbe o kamati i valuti ništetne zbog nesavjesnosti i nepoštenja tuženika, pa zbog toga tužitelj ima pravo na zatezne kamate od dana stjecanja tuženika, a ne od dana pravomoćnosti presude.

Čestitamo sucu Draganu Ramljaku, odvjetniku Srđanu Kaleboti i tužitelju na izvrsnoj presudi, za koju vjerujemo da će postati pravomoćnom. Nadamo se da županijski sud koji dobije predmet neće odugovlačiti s pravomoćnom odlukom!", navela je Udruga.
