Zainteresirani vjerovnici "Konstruktor-Inženjeringa" krajem veljače će treći put pratiti ročište koje se zakazuje da bi Trgovački sud mogao utvrditi postoje li uvjeti, kako to tvrdi Fina, za otvaranje stečajnog postupka nad tom tvrtkom.
Prvi put je to ročište bilo zakazano krajem listopada prošle godine, no na njega se nije odazvao Željko Žderić, direktor nekadašnjega građevinskog diva, niti je dostavio dokumentaciju koju je sud od njega tražio - izvješće o gospodarskom stanju u tvrtki, te popis njezine imovine i obveza, sve potpisano od odgovorne osobe u poduzeću koja pod kaznenom odgovornošću mora jamčiti za istinitost podataka.
Da bi sud ipak mogao utvrditi postoje li uvjeti za otvaranje stečaja nad "Konstruktorom", imenovao je privremenog stečajnog upravitelja Franu Krištu. Njegov zadatak je i da zaštiti interese vjerovnika, pa bez njegova dopuštenja tvrtka ne može prodavati svoju imovinu.
Iz poduzeća su se odmah žalili na takvo imenovanje, želeći uvjeriti Visoki trgovački sud (VTS) kako sud u Splitu uopće nije naveo razloge zbog čega mu postavlja privremenog upravitelja. U tome, naravno, nije uspio.
VTS je žalbu odbio i građevinskoj tvrtki obrazložio kako joj je Trgovački sud naveo da se nije očitovala o svojoj imovini od koje bi se namirili vjerovnici u slučaju otvaranja stečaja, te da je sud morao osigurati da ne dođe do smanjenja imovine jer bi to bilo nepovoljno za te iste vjerovnike.
U međuvremenu se u prosincu drugi put pokušalo utvrditi postoje li uvjeti za otvaranje stečaja nad "Konstruktorom", no tada je Tomislav Krka, odvjetnik tvrtke, zatražio izuzeće sutkinje koja vodi predmet.
Zbog toga je ona morala ponovno odgoditi ročište, dok o njezinu izuzeću ne odluči Franka Buzov, predsjednica suda. Kasnije je Žderić povukao svoj zahtjev, pa uskoro očekujemo daljnji razvoj događaja "Konstruktor-Inženjeringa".

Zainteresirani vjerovnici "Konstruktor-Inženjeringa" krajem veljače će treći put pratiti ročište koje se zakazuje da bi Trgovački sud mogao utvrditi postoje li uvjeti, kako to tvrdi Fina, za otvaranje stečajnog postupka nad tom tvrtkom.
Prvi put je to ročište bilo zakazano krajem listopada prošle godine, no na njega se nije odazvao Željko Žderić, direktor nekadašnjega građevinskog diva, niti je dostavio dokumentaciju koju je sud od njega tražio - izvješće o gospodarskom stanju u tvrtki, te popis njezine imovine i obveza, sve potpisano od odgovorne osobe u poduzeću koja pod kaznenom odgovornošću mora jamčiti za istinitost podataka.
Da bi sud ipak mogao utvrditi postoje li uvjeti za otvaranje stečaja nad "Konstruktorom", imenovao je privremenog stečajnog upravitelja Franu Krištu. Njegov zadatak je i da zaštiti interese vjerovnika, pa bez njegova dopuštenja tvrtka ne može prodavati svoju imovinu.
Iz poduzeća su se odmah žalili na takvo imenovanje, želeći uvjeriti Visoki trgovački sud (VTS) kako sud u Splitu uopće nije naveo razloge zbog čega mu postavlja privremenog upravitelja. U tome, naravno, nije uspio.
VTS je žalbu odbio i građevinskoj tvrtki obrazložio kako joj je Trgovački sud naveo da se nije očitovala o svojoj imovini od koje bi se namirili vjerovnici u slučaju otvaranja stečaja, te da je sud morao osigurati da ne dođe do smanjenja imovine jer bi to bilo nepovoljno za te iste vjerovnike.
U međuvremenu se u prosincu drugi put pokušalo utvrditi postoje li uvjeti za otvaranje stečaja nad "Konstruktorom", no tada je Tomislav Krka, odvjetnik tvrtke, zatražio izuzeće sutkinje koja vodi predmet.
Zbog toga je ona morala ponovno odgoditi ročište, dok o njezinu izuzeću ne odluči Franka Buzov, predsjednica suda. Kasnije je Žderić povukao svoj zahtjev, pa uskoro očekujemo daljnji razvoj događaja "Konstruktor-Inženjeringa".
