Splitsko Županijsko državno odvjetništvo pokrenulo je izvide u vezi s građevinskim i financijskim vještvom koje je još prije četiri godine zatražio, dobio i vjerovnicima prezentirao Zoran Miletić, tadašnji stečajni upravitelj tvrtke "Adriatic" koja je donedavno upravljala hotelom "Marjan".

Slobodna Dalmacija još je u lipnju 2016. godine pisala o rezultatima tih vještava prema kojima je razlika između procjene građevinskog vještaka o obavljenim radovima na hotelu "Marjan" i ispostavljenih računa gotovo 12 milijuna eura, odnosno 90 milijuna i 629 tisuća kuna.

- U odnosu na upit od 22. rujna 2020. godine, iz sadržaja kojeg proizlazi da tražite informaciju o postupanju Županijskog državnog odvjetništva u Splitu povodom provedenih vještačenja u stečajnom postupku tvrtke "Adriatic" d.d. ističem da ŽDO u Splitu u suradnji s policijskim službenicima PU splitsko-dalmatinske provodi izvide. Odredbom članka 206. točka f. Zakona o kaznenom postupku određeno je da je postupanje tijekom izvida tajno, a tijelo koje provodi izvide može, kada to nalaže interes javnosti, o tijeku izvida izvijestiti javnost na način propisan posebnim zakonom - izvijestila nas je u četvrtak Rene Laura, glasnogovornica Županijskog državnog odvjetništva.

Sumnje

Nije nam mogla službeno odgovoriti, naravno, zbog tajnosti, kad su ti izvidi pokrenuti. Ipak, iz pouzdanih izvora doznajemo da je zamjenica županijskog državnog odvjetnika koja je zadužila predmet, naložila policiji provođenje izvida tek nakon što je Slobodna Dalmacija postavila upit, dakle prije dva dana! Pa što se radilo četiri godine?!

Podsjetimo, tadašnji stečajni upravitelj Miletić je još u srpnju 2015. godine naručio građevinsko i financijsko vještvo i to po odluci Skupštine vjerovnika. Vladimir Krklec, stalni sudski vještak za knjigovodstveno-financijske poslove u veljači 2016. godine dovršio je posao i, među ostalim, utvrdio i neke "sumnjive" zaključke koji su se ticali tvrtke "Sapor" (tada u vlasništvu Kerumova nećaka Igora Sapunara) koja se nekad zvala "Kerum Ing" i koja je bila glavni izvođač radova na hotelu.

Financijski vještak utvrdio je da "prema nalazu vještaka građevinske struke i usporedbe s ispostavljenim i ovjerenim situacijama, vrijednost izvedenih radova ne odgovara vrijednosti založenih prava na nekretnini hotel Marjan".

Prema ispostavljenim računima evidentiranim u poslovnim knjigama "Sapora", s "Adriaticom" je ostvaren promet od 262 milijuna kuna od čega se na PDV odnosi gotovo 48 milijuna, a vrijednost izvedenih radova iznosi 28 milijuna i 121 tisuću eura, odnosno 214 milijuna i 284 tisuće kuna.

No, prema vještaku građevinske struke, vrijednost izvedenih radova je 16 milijuna i 227 tisuća eura, odnosno 123 milijuna i 655 tisuća kuna. Dakle, razlika između procjene građevinskog vještaka o vrijednosti stvarno izvedenih radova i ispostavljenih računa je gotovo 12 milijuna eura, odnosno 90 milijuna i 629 tisuća kuna.

Navedeno je vještvo tada bilo priloženo u spis Trgovačkog suda, no ŽDO Split ga tada, dakle u lipnju, kada je objavljen članak u SD, službeno još nije dobilo.

Naime, ŽDO je u ovom stečajnom postupku zastupalo državu koja je vjerovnik u prvom isplatnom redu za 3.531.856,51 kn (obveze iz zdravstvenog i mirovinskog osiguranja) te u općem isplatnom redu za 825.095,72 kn (PDV).
Iz ŽDO-a su nam tada odgovorili da je "činjenica da je Trgovački sud u Splitu donio rješenje o skupštini vjerovnika za dan 14. srpnja 2016. na kojoj će se vjerovnici upoznati s nalazom i mišljenjem građevinskog i financijsko-računovodstvenog vještaka koji će biti objavljen na e-oglasnoj ploči suda".

Stečaj

Dakle, država, odnosno ŽDO već je u srpnju te godine, kao jedan od vjerovnika, nakon Skupštine bilo upoznato s vještvom. I umjesto da se hitno krene provjeravati osnovanost ovakvih zaključaka i da se utvrdi jesu li se stvarno "napumpale" cijene radova i na taj način izvlačili milijuni eura, država je odlučila "hibernirati" i ne petljati se u to po principu "kad se stiša medijska buka, sve će se zaboraviti".

U međuvremenu je tvrtka "Sapor" d.o.o. otišla u stečaj, a njegovu tražbinu, kredit u Kreditnoj banci Zagreb (50 milijuna kuna odobreno 2009. godine tvrtki "Sapor" d.o.o. uz to što je založen hotel "Marjan", a sudužnici su bili "Adriatic" d.d. i Kerum te jamac Igor Sapunar), preuzela je tvrtka "Adria Resort", u vlasništvu "Adris grupe". Upravo su oni postali novi vlasnici nekadašnjeg Kerumova ponosa.

Spomenimo i da su nedavno mediji pisali da je grupa radnika tvrtke "Adriatic" d.d. u stečaju u svibnju nove godine podnijela USKOK-u kaznenu prijavu u kojoj, među ostalim, kao jedan od dokaza namjernog uništavanja firme navode i gore navedena Miletićeva izvješća i naručena vještva.

Splitsko Županijsko državno odvjetništvo pokrenulo je izvide u vezi s građevinskim i financijskim vještvom koje je još prije četiri godine zatražio, dobio i vjerovnicima prezentirao Zoran Miletić, tadašnji stečajni upravitelj tvrtke "Adriatic" koja je donedavno upravljala hotelom "Marjan".

Slobodna Dalmacija još je u lipnju 2016. godine pisala o rezultatima tih vještava prema kojima je razlika između procjene građevinskog vještaka o obavljenim radovima na hotelu "Marjan" i ispostavljenih računa gotovo 12 milijuna eura, odnosno 90 milijuna i 629 tisuća kuna.

- U odnosu na upit od 22. rujna 2020. godine, iz sadržaja kojeg proizlazi da tražite informaciju o postupanju Županijskog državnog odvjetništva u Splitu povodom provedenih vještačenja u stečajnom postupku tvrtke "Adriatic" d.d. ističem da ŽDO u Splitu u suradnji s policijskim službenicima PU splitsko-dalmatinske provodi izvide. Odredbom članka 206. točka f. Zakona o kaznenom postupku određeno je da je postupanje tijekom izvida tajno, a tijelo koje provodi izvide može, kada to nalaže interes javnosti, o tijeku izvida izvijestiti javnost na način propisan posebnim zakonom - izvijestila nas je u četvrtak Rene Laura, glasnogovornica Županijskog državnog odvjetništva.

Sumnje

Nije nam mogla službeno odgovoriti, naravno, zbog tajnosti, kad su ti izvidi pokrenuti. Ipak, iz pouzdanih izvora doznajemo da je zamjenica županijskog državnog odvjetnika koja je zadužila predmet, naložila policiji provođenje izvida tek nakon što je Slobodna Dalmacija postavila upit, dakle prije dva dana! Pa što se radilo četiri godine?!

Podsjetimo, tadašnji stečajni upravitelj Miletić je još u srpnju 2015. godine naručio građevinsko i financijsko vještvo i to po odluci Skupštine vjerovnika. Vladimir Krklec, stalni sudski vještak za knjigovodstveno-financijske poslove u veljači 2016. godine dovršio je posao i, među ostalim, utvrdio i neke "sumnjive" zaključke koji su se ticali tvrtke "Sapor" (tada u vlasništvu Kerumova nećaka Igora Sapunara) koja se nekad zvala "Kerum Ing" i koja je bila glavni izvođač radova na hotelu.

Financijski vještak utvrdio je da "prema nalazu vještaka građevinske struke i usporedbe s ispostavljenim i ovjerenim situacijama, vrijednost izvedenih radova ne odgovara vrijednosti založenih prava na nekretnini hotel Marjan".

Prema ispostavljenim računima evidentiranim u poslovnim knjigama "Sapora", s "Adriaticom" je ostvaren promet od 262 milijuna kuna od čega se na PDV odnosi gotovo 48 milijuna, a vrijednost izvedenih radova iznosi 28 milijuna i 121 tisuću eura, odnosno 214 milijuna i 284 tisuće kuna.

No, prema vještaku građevinske struke, vrijednost izvedenih radova je 16 milijuna i 227 tisuća eura, odnosno 123 milijuna i 655 tisuća kuna. Dakle, razlika između procjene građevinskog vještaka o vrijednosti stvarno izvedenih radova i ispostavljenih računa je gotovo 12 milijuna eura, odnosno 90 milijuna i 629 tisuća kuna.

Navedeno je vještvo tada bilo priloženo u spis Trgovačkog suda, no ŽDO Split ga tada, dakle u lipnju, kada je objavljen članak u SD, službeno još nije dobilo.

Naime, ŽDO je u ovom stečajnom postupku zastupalo državu koja je vjerovnik u prvom isplatnom redu za 3.531.856,51 kn (obveze iz zdravstvenog i mirovinskog osiguranja) te u općem isplatnom redu za 825.095,72 kn (PDV).
Iz ŽDO-a su nam tada odgovorili da je "činjenica da je Trgovački sud u Splitu donio rješenje o skupštini vjerovnika za dan 14. srpnja 2016. na kojoj će se vjerovnici upoznati s nalazom i mišljenjem građevinskog i financijsko-računovodstvenog vještaka koji će biti objavljen na e-oglasnoj ploči suda".

Stečaj

Dakle, država, odnosno ŽDO već je u srpnju te godine, kao jedan od vjerovnika, nakon Skupštine bilo upoznato s vještvom. I umjesto da se hitno krene provjeravati osnovanost ovakvih zaključaka i da se utvrdi jesu li se stvarno "napumpale" cijene radova i na taj način izvlačili milijuni eura, država je odlučila "hibernirati" i ne petljati se u to po principu "kad se stiša medijska buka, sve će se zaboraviti".

U međuvremenu je tvrtka "Sapor" d.o.o. otišla u stečaj, a njegovu tražbinu, kredit u Kreditnoj banci Zagreb (50 milijuna kuna odobreno 2009. godine tvrtki "Sapor" d.o.o. uz to što je založen hotel "Marjan", a sudužnici su bili "Adriatic" d.d. i Kerum te jamac Igor Sapunar), preuzela je tvrtka "Adria Resort", u vlasništvu "Adris grupe". Upravo su oni postali novi vlasnici nekadašnjeg Kerumova ponosa.

Spomenimo i da su nedavno mediji pisali da je grupa radnika tvrtke "Adriatic" d.d. u stečaju u svibnju nove godine podnijela USKOK-u kaznenu prijavu u kojoj, među ostalim, kao jedan od dokaza namjernog uništavanja firme navode i gore navedena Miletićeva izvješća i naručena vještva.
