Dopisnik "Slobodne Dalmacije" Mate Primorac oslobođen je optužbe da oklevetao Davora Andabaka, policajca iz Vrgorca. Rad izvršne vlasti, a time i osoba kojima je povjereno obavljanje poslova iz domene vlasti, mora biti podložan pomnom ispitivanju ne samo od strane zakonodavne i sudske vlasti, nego i od strane medija i javnog mišljenja, navedeno je u presudi kojom je novinar iz Vrgorca oslobođen krivnje.

Sudsko vijeće Županijskog suda u Varaždinu, pod presjedanjem suca Rajka Kipeka, te članovima vijeća Igora Pavlica i Ljiljane Kolenko, odbilo je žalbu vrgoračkog policajca Davora Andabaka. Policajac je njome osporavao prvostupanjsku presudu suca Maria Franetovića s Općinskog suda u Splitu kojom je Mate Primorac, dopisnik "Slobodne Dalmacije“, iz Vrgorca, oslobođen krivnje za počinjenje kaznenog dijela protiv časti i ugleda, klevete.

Time je okončan sedam godina dugi sudski spor, koji je krenuo nakon tekstova dopisnika "Slobodne“ o problemima lokalnog stanovništva uz granicu s policijom, nakon ulaska Hrvatske u Europsku uniju. Naime, Andabak je protiv Primorca podigao privatnu tužbu da ga je oklevetao u dva teksta.

No, u obrazloženju presude između ostalog stoji, da Primorac nije pisao o temi, koja je tangirala isključivo Andabaka, već je to bila tema od javnog interesa za mjesno stanovništvo u pograničnom području, a to su potvrdili i ispitani svjedoci. Prvostupanjski sud u Splitu, procijenio je višu sud, pravilno je zaključio da u konkretnom slučaju nije dokazano da bi Primorac počinio kazneno djelo za koje se tereti u ovom postupku.

Dopisnika "Slobodne“, u ovom sudskom sporu, branili su splitski odvjetnici Vinko Ljubičić i Joško Mikulić.  Istom odlukom policajac Davor Andabak, obvezan je podmiriti troškove kaznenog postupka.

Upitali smo kolegu Primorca da komentira presudu:

- Ovo je moja osobna satisfakcija da sam kao novinar na dobrom putu i da otvaram teme. Ovo je poruka malim ljudima za koje se borim u svojim tekstovima da ništa nije nemoguće i da se ne trebaju nikoga bojati. Konkretno, u spornim testovima sam pisao o njihovim svakodnevnim problemima nakon ulaska Hrvatske u EU i drakonskim kaznama kojima su bili izloženi kada bi išli na svoje njive ili u šumu ili u crkvu preko granice.

Nedostajalo je senzibiliteta kod policijskih službenika koji su do tada dijelili sudbinu s tim ljudima. To su u svojim izjavama potvrdili kao moji svjedoci interventni policajac, bivši načelnik Policijske postaje Vrgorac i načelnik Odjela za nezakonite migracije Policijske uprave splitsko-dalmatinske.

Apsurd je da ljudi moraju kružiti 70 kilometara do svojih imanja ili moraju biti izloženi kaznama od 2.000 do 10.000 kuna za ilegalni prelazak državne granice kada idu na svoju zemlju.

A s druge strane imamo situaciju da je nedavno bila jedna od najvećih akcija USKOK-a za krijumčarenje marihuane preko graničnog prijelaza Orah-Orahovlje. Osim toga, svi se pitaju kuda u posljednje vrijeme idu biftek i cigarete iz BiH prema Hrvatskoj? To neka vide nadležni u Splitu i Zagrebu - kazao nam je.

Zanimljivo je istaknuti, da je to bila jedina tužba protiv Mate Primorca dosad u njegovom novinarskom radu od 2007. godine kad je počeo pisati za našu medijsku kuću, a radio je na mnogim izazovnim i osjetljivim temama.

Rad izvršne vlasti, a time i osoba kojima je povjereno obavljanje poslova iz domene vlasti, mora biti podložan pomnom ispitivanju ne samo od strane zakonodavne i sudske vlasti, nego i od strane medija i javnog mišljenja, navedeno je u presudi kojom je novinar iz Vrgorca oslobođen krivnje.

Sudsko vijeće Županijskog suda u Varaždinu, pod presjedanjem suca Rajka Kipeka, te članovima vijeća Igora Pavlica i Ljiljane Kolenko, odbilo je žalbu vrgoračkog policajca Davora Andabaka. Policajac je njome osporavao prvostupanjsku presudu suca Maria Franetovića s Općinskog suda u Splitu kojom je Mate Primorac, dopisnik "Slobodne Dalmacije“, iz Vrgorca, oslobođen krivnje za počinjenje kaznenog dijela protiv časti i ugleda, klevete.

Time je okončan sedam godina dugi sudski spor, koji je krenuo nakon tekstova dopisnika "Slobodne“ o problemima lokalnog stanovništva uz granicu s policijom, nakon ulaska Hrvatske u Europsku uniju. Naime, Andabak je protiv Primorca podigao privatnu tužbu da ga je oklevetao u dva teksta.

No, u obrazloženju presude između ostalog stoji, da Primorac nije pisao o temi, koja je tangirala isključivo Andabaka, već je to bila tema od javnog interesa za mjesno stanovništvo u pograničnom području, a to su potvrdili i ispitani svjedoci. Prvostupanjski sud u Splitu, procijenio je višu sud, pravilno je zaključio da u konkretnom slučaju nije dokazano da bi Primorac počinio kazneno djelo za koje se tereti u ovom postupku.

Dopisnika "Slobodne“, u ovom sudskom sporu, branili su splitski odvjetnici Vinko Ljubičić i Joško Mikulić.  Istom odlukom policajac Davor Andabak, obvezan je podmiriti troškove kaznenog postupka.

Upitali smo kolegu Primorca da komentira presudu:

- Ovo je moja osobna satisfakcija da sam kao novinar na dobrom putu i da otvaram teme. Ovo je poruka malim ljudima za koje se borim u svojim tekstovima da ništa nije nemoguće i da se ne trebaju nikoga bojati. Konkretno, u spornim testovima sam pisao o njihovim svakodnevnim problemima nakon ulaska Hrvatske u EU i drakonskim kaznama kojima su bili izloženi kada bi išli na svoje njive ili u šumu ili u crkvu preko granice.

Nedostajalo je senzibiliteta kod policijskih službenika koji su do tada dijelili sudbinu s tim ljudima. To su u svojim izjavama potvrdili kao moji svjedoci interventni policajac, bivši načelnik Policijske postaje Vrgorac i načelnik Odjela za nezakonite migracije Policijske uprave splitsko-dalmatinske.

Apsurd je da ljudi moraju kružiti 70 kilometara do svojih imanja ili moraju biti izloženi kaznama od 2.000 do 10.000 kuna za ilegalni prelazak državne granice kada idu na svoju zemlju.

A s druge strane imamo situaciju da je nedavno bila jedna od najvećih akcija USKOK-a za krijumčarenje marihuane preko graničnog prijelaza Orah-Orahovlje. Osim toga, svi se pitaju kuda u posljednje vrijeme idu biftek i cigarete iz BiH prema Hrvatskoj? To neka vide nadležni u Splitu i Zagrebu - kazao nam je.

Zanimljivo je istaknuti, da je to bila jedina tužba protiv Mate Primorca dosad u njegovom novinarskom radu od 2007. godine kad je počeo pisati za našu medijsku kuću, a radio je na mnogim izazovnim i osjetljivim temama.
