Rečenica je to kojom završava odgovor pročelnice županijskog Upravnog odjela za turizam i pomorstvo Matee Dorčić na naš upit zašto Županija splitsko-dalmatinska nije postupila po pravomoćnoj presudi Upravnog suda u Splitu iz 2018. i kad će to učiniti.

Slučaj koji je HDZ-ova župana Ževrnju koštao političke ‘smrti‘ dobio žestok epilog koji vlast (pre)dugo oteže: ‘Županija mora izabranom privatniku dati koncesiju za upravljanje Zlatnim ratom!‘

Sudeći, međutim, po reakciji Općine Bol, navod iz citirane rečenice nije točan. Stoga prozvani općinari ne prihvaćaju nametnutu im odgovornost, imaju svoje prijedloge za rješenje problema i pritom očekuju da Županija odradi svoj dio posla.

Sve je počelo, podsjetimo, 2017. godine, kad je Županijska skupština donijela odluku o dodjeli koncesije za Zlatni rat zagrebačkoj tvrtki "Sport B". Odluka, doduše, nije ni napisana ni objavljena jer je nekoliko dana kasnije rješenjem Ministarstva mora poništena, a postupak dodjele koncesije obustavljen.

"Produljen rok"

U međuvremenu je "Sport B" pokrenuo i dobio sudski spor te od Županije zatražio da okonča 2017. započeti postupak dodjele koncesije ovoj tvrtki.

Skupština je pak u prosincu 2017. (prije presude Upravnog suda od 30. srpnja 2018.) donijela Odluku o povjeravanju ovlaštenja za davanje koncesije Općini Bol.

---– Županija od tada smatra da više nije nadležna za dodjelu predmetne koncesije – kazala nam je bolska načelnica Katarina Marčić, dodajući da je Stručno povjerenstvo Ministarstva zaključilo da su istovremeno na snazi dvije suprotstavljene Odluke Skupštine, ona o davanju koncesije iz travnja 2017. i Odluka o povjeravanju ovlaštenja Općini Bol za davanje koncesije od prosinca iste godine.

Prema riječima načelnice Marčić, u veljači 2020. odlukom županijske Skupštine produljuje se rok povjeravanja ovlaštenja Općini Bol s napomenom da mora poništiti jednu od dvije odluke. Ovlaštenje je bilo ograničeno rokom do 31. prosinca 2020. godine.

– Prošli saziv Vijeća Općine Bol u danom roku nije poništio jednu od te dvije odluke, smatrajući da pravno nije utemeljeno da tijelo nižeg reda poništi odluku tijela višeg reda, odnosno županijske Skupštine, a donošenjem takve odluke slučaj bi se dodatno pravno zakomplicirao – obrazlaže Marčić, za načelnicu izabrana na zadnjim lokalnim izborima na kojima je pobijedila dugogodišnjeg načelnika, SDP-ova Tihomira Marinkovića.

– S obzirom na to da je navedeno ovlaštenje isteklo krajem 2020., u lipnju 2021. podnijela sam zahtjev županu Blaženku Bobanu i Skupštini za ponovno davanje ovlaštenja Općini Bol, no ovaj put s produljenim rokom do kraja 2025. godine – navodi naša sugovornica.

Zahtjev je, kaže, obrazložila nužnim stvaranjem preduvjeta za raspisivanje dugoročne koncesije kako bi cijeli postupak bio zakonit i jasan ponuditeljima.

Odgovor je bio da Općina treba detaljno obrazložiti planirane aktivnosti kako bi se na temelju njih dao prijedlog o novom roku.

Načelnica, međutim, upozorava na to da je za donošenje studije prihvatnog kapaciteta i plana upravljanja nadležna Javna ustanova "More i Krš". Općina bi temeljem onoga što odredi "More i Krš" donijela prostorni plan i idejno rješenje uređenja.

Dakle, sumirajmo, Općina zahtjev nije ispunila, ovlast za dodjelu koncesije nije produžena, znači da ni odgovor Županijskog odjela nije istinit. Općina Bol ne može nikome dodjeljivati koncesiju.

Nezadovoljstvo Boljana

– U međuvremenu sam na ovu temu održala sastanke s nadležnima u Županijskom odjelu za pomorstvo, zatim i s ravnateljicom u Ministarstvu mora, na kraju i sa županom Bobanom. Predložila sam da odluku o davanju koncesije iz 2017. godine poništi Skupština, tijelo koje je odluku i donijelo. To je prethodno pitanje koje se mora riješiti prije svih daljnjih koraka, a dok se ne riješi, Općina će nastaviti upravljati plažom preko koncesijskih odobrenja – rezolutna je Marčić, koja nije propustila podsjetiti na nezadovoljstvo Boljana dodjelom koncesije tvrtki "Sport B", te iznijeti osobni stav:

– Smatram da upravljanje plažom i cjelokupnim pomorskim dobrom mora biti u isključivoj nadležnosti lokalne samouprave na čijem području se ono nalazi. Opravdano je dugoročno koncesioniranje neuređenih plaža i pomorskog dobra koje zahtijeva velika ulaganja. Plaža Zlatni rat to sigurno nije i dugoročna koncesija uopće nije potrebna, dapače, to bi bio udarac na lokalni proračun kojem bi pripala tek trećinu prihoda od koncesije. Oštećeni bi bili i lokalni poduzetnici, kao i općinsko poduzeće, jer bi u tom slučaju sve prihode ubirao jedan koncesionar, bez ikakve garancije kvalitetnijeg upravljanja – za kraj će Katarina Marčić.

"Cjelokupno postupanje po predmetima koji se odnose na područje Zlatni Rat povjereno je Općini Bol".

Rečenica je to kojom završava odgovor pročelnice županijskog Upravnog odjela za turizam i pomorstvo Matee Dorčić na naš upit zašto Županija splitsko-dalmatinska nije postupila po pravomoćnoj presudi Upravnog suda u Splitu iz 2018. i kad će to učiniti.

Slučaj koji je HDZ-ova župana Ževrnju koštao političke ‘smrti‘ dobio žestok epilog koji vlast (pre)dugo oteže: ‘Županija mora izabranom privatniku dati koncesiju za upravljanje Zlatnim ratom!‘

Sudeći, međutim, po reakciji Općine Bol, navod iz citirane rečenice nije točan. Stoga prozvani općinari ne prihvaćaju nametnutu im odgovornost, imaju svoje prijedloge za rješenje problema i pritom očekuju da Županija odradi svoj dio posla.

Sve je počelo, podsjetimo, 2017. godine, kad je Županijska skupština donijela odluku o dodjeli koncesije za Zlatni rat zagrebačkoj tvrtki "Sport B". Odluka, doduše, nije ni napisana ni objavljena jer je nekoliko dana kasnije rješenjem Ministarstva mora poništena, a postupak dodjele koncesije obustavljen.

"Produljen rok"

U međuvremenu je "Sport B" pokrenuo i dobio sudski spor te od Županije zatražio da okonča 2017. započeti postupak dodjele koncesije ovoj tvrtki.

Skupština je pak u prosincu 2017. (prije presude Upravnog suda od 30. srpnja 2018.) donijela Odluku o povjeravanju ovlaštenja za davanje koncesije Općini Bol.

---– Županija od tada smatra da više nije nadležna za dodjelu predmetne koncesije – kazala nam je bolska načelnica Katarina Marčić, dodajući da je Stručno povjerenstvo Ministarstva zaključilo da su istovremeno na snazi dvije suprotstavljene Odluke Skupštine, ona o davanju koncesije iz travnja 2017. i Odluka o povjeravanju ovlaštenja Općini Bol za davanje koncesije od prosinca iste godine.

Prema riječima načelnice Marčić, u veljači 2020. odlukom županijske Skupštine produljuje se rok povjeravanja ovlaštenja Općini Bol s napomenom da mora poništiti jednu od dvije odluke. Ovlaštenje je bilo ograničeno rokom do 31. prosinca 2020. godine.

– Prošli saziv Vijeća Općine Bol u danom roku nije poništio jednu od te dvije odluke, smatrajući da pravno nije utemeljeno da tijelo nižeg reda poništi odluku tijela višeg reda, odnosno županijske Skupštine, a donošenjem takve odluke slučaj bi se dodatno pravno zakomplicirao – obrazlaže Marčić, za načelnicu izabrana na zadnjim lokalnim izborima na kojima je pobijedila dugogodišnjeg načelnika, SDP-ova Tihomira Marinkovića.

– S obzirom na to da je navedeno ovlaštenje isteklo krajem 2020., u lipnju 2021. podnijela sam zahtjev županu Blaženku Bobanu i Skupštini za ponovno davanje ovlaštenja Općini Bol, no ovaj put s produljenim rokom do kraja 2025. godine – navodi naša sugovornica.

Zahtjev je, kaže, obrazložila nužnim stvaranjem preduvjeta za raspisivanje dugoročne koncesije kako bi cijeli postupak bio zakonit i jasan ponuditeljima.

Odgovor je bio da Općina treba detaljno obrazložiti planirane aktivnosti kako bi se na temelju njih dao prijedlog o novom roku.

Načelnica, međutim, upozorava na to da je za donošenje studije prihvatnog kapaciteta i plana upravljanja nadležna Javna ustanova "More i Krš". Općina bi temeljem onoga što odredi "More i Krš" donijela prostorni plan i idejno rješenje uređenja.

Dakle, sumirajmo, Općina zahtjev nije ispunila, ovlast za dodjelu koncesije nije produžena, znači da ni odgovor Županijskog odjela nije istinit. Općina Bol ne može nikome dodjeljivati koncesiju.

Nezadovoljstvo Boljana

– U međuvremenu sam na ovu temu održala sastanke s nadležnima u Županijskom odjelu za pomorstvo, zatim i s ravnateljicom u Ministarstvu mora, na kraju i sa županom Bobanom. Predložila sam da odluku o davanju koncesije iz 2017. godine poništi Skupština, tijelo koje je odluku i donijelo. To je prethodno pitanje koje se mora riješiti prije svih daljnjih koraka, a dok se ne riješi, Općina će nastaviti upravljati plažom preko koncesijskih odobrenja – rezolutna je Marčić, koja nije propustila podsjetiti na nezadovoljstvo Boljana dodjelom koncesije tvrtki "Sport B", te iznijeti osobni stav:

– Smatram da upravljanje plažom i cjelokupnim pomorskim dobrom mora biti u isključivoj nadležnosti lokalne samouprave na čijem području se ono nalazi. Opravdano je dugoročno koncesioniranje neuređenih plaža i pomorskog dobra koje zahtijeva velika ulaganja. Plaža Zlatni rat to sigurno nije i dugoročna koncesija uopće nije potrebna, dapače, to bi bio udarac na lokalni proračun kojem bi pripala tek trećinu prihoda od koncesije. Oštećeni bi bili i lokalni poduzetnici, kao i općinsko poduzeće, jer bi u tom slučaju sve prihode ubirao jedan koncesionar, bez ikakve garancije kvalitetnijeg upravljanja – za kraj će Katarina Marčić.
