Zahtjev za ispravak članaka objavljenih u Slobodnoj Dalmaciji naslova “Mještani izgubili posjede i - milijune” “načelnik je mještanima ovršio posjede, a svoj je uknjižio i prodao Norvežanima” objavljenih u SD, 28. 5. 2022. godine u tiskanom i internetskom izdanju, kao i naslova “Općina Sućuraj svjesno prepušta naše stoljetne posjede Norvežanima” objavljenog u tiskanom i internetskom izdanju SD 7. 6. 2022. godine.

Pogrešne teze/navodi koji se provlače kroz tekstove ispravljamo na način kako slijedi:

- Prioritetno je navesti da je Općina temeljem pravomoćne odluke Visokog trgovačkog suda dužna cca 14 milijuna kuna “Norvežanima” koji su podnijeli prijedlog za ovrhu i doneseno je Rješenje o ovrsi na nekretninama koje su upisane na Općinu Sućuraj. Općina je ovršenik u tom postupku, a ne onaj koji ovršava “mještane”.

- U tom ovršnom postupku nakon višemjesečnih pregovora s “Norvežanima” usuglašen je tekst Ugovora o neposrednoj prodaji nekretnina, temeljem procjene vrijednosti nekretnina od strane sudskog vještaka. Nitko od gore spomenutih ne spominje Ugovor ili namjerno manipulira prijedlozima ugovora koji su tijekom pregovora dostavljani od strane “Norvežana”, a koji nisu prihvaćeni od strane Općinskog vijeća (OV). Odvjetnik Bašura je krivi Ugovor dostavio i u sudski predmet P-1512/22. Treba napomenuti da je “Norvežanima” u pregovorima ponuđeno da se naplate “preko nekretnina” za koje Visoki trgovački sud u jednom postupku zaključuje da ih Općina nije mogla prodati Norvežanima, te raskida Ugovor, dok u drugome postupku taj isti sud Općinu utvrđuje vlasnikom nekretnina! Na taj prijedlog “Norvežani” nisu pristali ali nažalost u ovoj situaciji oni su ti koji su za volanom koji im je u ruke dao sud.

- Navodi se i nekakvo knjiženje u tajnosti. Tajno knjiženje naravno nije moguće, a u stvarnom svijetu radi se o upisu uknjižbe prava vlasništva na ime Općina Sućuraj uz brisanje postojećeg arhaičnog upisa “opća narodna imovina”. Pritom treba navesti da su i bez tog upisa “Norvežani” mogli zatražiti i ishoditi ovrhu na ovim nekretninama bez ikakve zapreke, samo uz dopunu svog Prijedloga za ovrhu jednim dodatnim “papirom”.

- Nepošteni stav i postupci Općine prema “šest obitelji”:

Te obitelji su prema dokumentaciji koju je odvjetnik Bašura dostavio nedavno u jedan sudski spis 2006. godine sklopile Predugovor o kupnji s jednim trgovačkim društvom, te primile kaparu u iznosu od cca 1000.000,00 eura. Nakon preuzimanja kapare su, umjesto da tuže Općinu Sućuraj, tužili Republiku Hrvatsku. Trgovačko društvo s kojim su sklopili Predugovor 2009. godine je sudskim putem zatražilo povrat dvostruke kapare. Krajem studenoga 2021. godine, dakle 15 godina nakon sklapanja Predugovora, podnijeli su tužbu protiv Općine. Općina je njihov tužbeni zahtjev zaprimila osam mjeseci nakon što je doneseno Rješenje o ovrsi u korist Norvežana. Odvjetnik gosp. Bašura SD-u navodi da je s “Norvežanima” “komunicirao” još 2018. godine, dakle barem tri godine se čeka s podnošenjem tužbe u njegovom uredu. Na tim nekretninama je evidentirana zabilježba spora radi utvrđivanja prava vlasništva koji vodi treća osoba (i on) protiv Republike Hrvatske. Općina Sućuraj je podnijela prijedlog za ponavljanje postupka protiv odluke kojom joj je naloženo plaćanje duga od 14 mil. kuna prije nego što su se te obitelji, zastupane po odvjetniku gosp. Bašuri, “sjetile” podnijeti tužbu radi utvrđenja prava vlasništva. Ne postoji “pravna čarolija” u ovakvim okolnostima po kojoj bi Općina mogla udovoljiti zahtjevima “šest obitelji” a da načelnik i vijećnici ne dobiju (zasluženu) “čestitku” od DORH-a osim da se stvari riješe kroz tekuće postupke.

- Uknjižba zemljišta obitelji Slavić u odnosu na ostale mještane.

Obitelj načelnika je ishodila presudu za zemljište koje se spominje u tekstovima 22. 11. 2012. godine, dakle prije stupanja na dužnost, a koje zemljište je stečeno agrarnom reformom. U njegovu mandatu npr., gosp. Ante Pavlović (kojeg je u dopisima prema Općini odvjetnik Bašura “uzeo u zaštitu” iako on ima drugog odvjetnika) je podnio tužbu protiv Općine dana 21. 4. 2021. godine, a ishodio Presudu 18. 10. 2021. godine, dakle nakon 6 mjeseci - toliko o maltretiranju drugih koji nisu rodbina načelnika.

- Da se netko “sjetio” podnijeti tužbu barem 2018. godine uz uvjet da su dokazi sudu jednako uvjerljivi kao kod gosp. Ante Pavlovića, danas bi “šest obitelji” bilo uknjiženo, umjesto da preko medija “traže” od Općine “poseban status” da im prizna tužbu suprotno Odluci OV iz 2013. godine bez provođenja dokaznog postupka. Općina Sućuraj je posebno osjetljiva na tužbe radi utvrđenja prava vlasništva iz razloga koji javnosti nije nepoznat pa smatramo neprimjerenim raditi ovakve pritiske na Općinu.

Zahtjev za ispravak članaka objavljenih u Slobodnoj Dalmaciji naslova “Mještani izgubili posjede i - milijune” “načelnik je mještanima ovršio posjede, a svoj je uknjižio i prodao Norvežanima” objavljenih u SD, 28. 5. 2022. godine u tiskanom i internetskom izdanju, kao i naslova “Općina Sućuraj svjesno prepušta naše stoljetne posjede Norvežanima” objavljenog u tiskanom i internetskom izdanju SD 7. 6. 2022. godine.

Pogrešne teze/navodi koji se provlače kroz tekstove ispravljamo na način kako slijedi:

- Prioritetno je navesti da je Općina temeljem pravomoćne odluke Visokog trgovačkog suda dužna cca 14 milijuna kuna “Norvežanima” koji su podnijeli prijedlog za ovrhu i doneseno je Rješenje o ovrsi na nekretninama koje su upisane na Općinu Sućuraj. Općina je ovršenik u tom postupku, a ne onaj koji ovršava “mještane”.

- U tom ovršnom postupku nakon višemjesečnih pregovora s “Norvežanima” usuglašen je tekst Ugovora o neposrednoj prodaji nekretnina, temeljem procjene vrijednosti nekretnina od strane sudskog vještaka. Nitko od gore spomenutih ne spominje Ugovor ili namjerno manipulira prijedlozima ugovora koji su tijekom pregovora dostavljani od strane “Norvežana”, a koji nisu prihvaćeni od strane Općinskog vijeća (OV). Odvjetnik Bašura je krivi Ugovor dostavio i u sudski predmet P-1512/22. Treba napomenuti da je “Norvežanima” u pregovorima ponuđeno da se naplate “preko nekretnina” za koje Visoki trgovački sud u jednom postupku zaključuje da ih Općina nije mogla prodati Norvežanima, te raskida Ugovor, dok u drugome postupku taj isti sud Općinu utvrđuje vlasnikom nekretnina! Na taj prijedlog “Norvežani” nisu pristali ali nažalost u ovoj situaciji oni su ti koji su za volanom koji im je u ruke dao sud.

- Navodi se i nekakvo knjiženje u tajnosti. Tajno knjiženje naravno nije moguće, a u stvarnom svijetu radi se o upisu uknjižbe prava vlasništva na ime Općina Sućuraj uz brisanje postojećeg arhaičnog upisa “opća narodna imovina”. Pritom treba navesti da su i bez tog upisa “Norvežani” mogli zatražiti i ishoditi ovrhu na ovim nekretninama bez ikakve zapreke, samo uz dopunu svog Prijedloga za ovrhu jednim dodatnim “papirom”.

- Nepošteni stav i postupci Općine prema “šest obitelji”:

Te obitelji su prema dokumentaciji koju je odvjetnik Bašura dostavio nedavno u jedan sudski spis 2006. godine sklopile Predugovor o kupnji s jednim trgovačkim društvom, te primile kaparu u iznosu od cca 1000.000,00 eura. Nakon preuzimanja kapare su, umjesto da tuže Općinu Sućuraj, tužili Republiku Hrvatsku. Trgovačko društvo s kojim su sklopili Predugovor 2009. godine je sudskim putem zatražilo povrat dvostruke kapare. Krajem studenoga 2021. godine, dakle 15 godina nakon sklapanja Predugovora, podnijeli su tužbu protiv Općine. Općina je njihov tužbeni zahtjev zaprimila osam mjeseci nakon što je doneseno Rješenje o ovrsi u korist Norvežana. Odvjetnik gosp. Bašura SD-u navodi da je s “Norvežanima” “komunicirao” još 2018. godine, dakle barem tri godine se čeka s podnošenjem tužbe u njegovom uredu. Na tim nekretninama je evidentirana zabilježba spora radi utvrđivanja prava vlasništva koji vodi treća osoba (i on) protiv Republike Hrvatske. Općina Sućuraj je podnijela prijedlog za ponavljanje postupka protiv odluke kojom joj je naloženo plaćanje duga od 14 mil. kuna prije nego što su se te obitelji, zastupane po odvjetniku gosp. Bašuri, “sjetile” podnijeti tužbu radi utvrđenja prava vlasništva. Ne postoji “pravna čarolija” u ovakvim okolnostima po kojoj bi Općina mogla udovoljiti zahtjevima “šest obitelji” a da načelnik i vijećnici ne dobiju (zasluženu) “čestitku” od DORH-a osim da se stvari riješe kroz tekuće postupke.

- Uknjižba zemljišta obitelji Slavić u odnosu na ostale mještane.

Obitelj načelnika je ishodila presudu za zemljište koje se spominje u tekstovima 22. 11. 2012. godine, dakle prije stupanja na dužnost, a koje zemljište je stečeno agrarnom reformom. U njegovu mandatu npr., gosp. Ante Pavlović (kojeg je u dopisima prema Općini odvjetnik Bašura “uzeo u zaštitu” iako on ima drugog odvjetnika) je podnio tužbu protiv Općine dana 21. 4. 2021. godine, a ishodio Presudu 18. 10. 2021. godine, dakle nakon 6 mjeseci - toliko o maltretiranju drugih koji nisu rodbina načelnika.

- Da se netko “sjetio” podnijeti tužbu barem 2018. godine uz uvjet da su dokazi sudu jednako uvjerljivi kao kod gosp. Ante Pavlovića, danas bi “šest obitelji” bilo uknjiženo, umjesto da preko medija “traže” od Općine “poseban status” da im prizna tužbu suprotno Odluci OV iz 2013. godine bez provođenja dokaznog postupka. Općina Sućuraj je posebno osjetljiva na tužbe radi utvrđenja prava vlasništva iz razloga koji javnosti nije nepoznat pa smatramo neprimjerenim raditi ovakve pritiske na Općinu.
