Nakon malo više od pola odslužene zatvorske kazne zbog izazivanja pomorske nesreće u kojoj je smrtno stradao talijanski bračni par Salpietro, Tomislav Horvatinčić je od Županijskoga suda u Puli zatražio uvjetno puštanje na slobodu, što mu je odbijeno.

Premda je kaznionica u kojoj trenutno služi kaznu od četiri godine i deset mjeseci zatvora navodno dala pozitivno mišljenje o Horvatinčićevu zahtjevu, tročlano vijeće Županijskog suda zaključilo je da je, s obzirom na kazneno djelo koje je počinio, još prerano za puštanje na slobodu.

Horvatinčiću je do kraja odsluženja zatvorske kazne preostalo malo više od dvije godine, a na ovu odluku suda u Puli može se žaliti Visokom kaznenome sudu (VKS).

Nakon trećeg ponovljenog suđenja, Horvatinčić je u rujnu 2019. konačno bio pravomoćno osuđen na četiri godine i deset mjeseci zatvora, a prvi mu je put upućivanje u Remetinec bilo određeno za 30. ožujka 2020. Nakon toga je četiri puta odgodio odlazak u zatvor zbog zdravstvenoga stanja, a na odsluženje kazne stupio je 14. srpnja 2021. kada je primljen na Odjel za dijagnostiku zatvora u Remetincu.

Međutim, nedugo nakon početka služenja kazne dobio je nekoliko prekida zbog zdravstvenog stanja te je počeo ostvarivati pogodnosti poput izlazaka za vikend. Naime, za ostvarivanje tih pogodnosti ključno je bilo da je Horvatinčić dobio najprije odsluženje kazne u kaznionici poluotvorenog tipa da bi poslije bio premješten u zatvor otvorenog tipa u Valturi, gdje se i danas nalazi.

Poluotvoreni ili otvoreni tip zatvora, u koji se obično šalju počinitelji prometnih nesreća, ostavlja diskrecijsko pravo upravitelju zatvora da odobri izlazak osuđeniku. "Na temelju provedenog postupka, a na prijedlog stručnog tima, odobrena je zakonska mogućnost navedenom zatvoreniku", odgovorili su Jutarnjem listu iz Ministarstva pravosuđa i uprave nakon što smo u lipnju 2022. godine snimili Horvatinčića na izlasku iz jedne privatne zagrebačke klinike.

Nakon malo više od pola odslužene zatvorske kazne zbog izazivanja pomorske nesreće u kojoj je smrtno stradao talijanski bračni par Salpietro, Tomislav Horvatinčić je od Županijskoga suda u Puli zatražio uvjetno puštanje na slobodu, što mu je odbijeno.

Premda je kaznionica u kojoj trenutno služi kaznu od četiri godine i deset mjeseci zatvora navodno dala pozitivno mišljenje o Horvatinčićevu zahtjevu, tročlano vijeće Županijskog suda zaključilo je da je, s obzirom na kazneno djelo koje je počinio, još prerano za puštanje na slobodu.

Horvatinčiću je do kraja odsluženja zatvorske kazne preostalo malo više od dvije godine, a na ovu odluku suda u Puli može se žaliti Visokom kaznenome sudu (VKS).

Nakon trećeg ponovljenog suđenja, Horvatinčić je u rujnu 2019. konačno bio pravomoćno osuđen na četiri godine i deset mjeseci zatvora, a prvi mu je put upućivanje u Remetinec bilo određeno za 30. ožujka 2020. Nakon toga je četiri puta odgodio odlazak u zatvor zbog zdravstvenoga stanja, a na odsluženje kazne stupio je 14. srpnja 2021. kada je primljen na Odjel za dijagnostiku zatvora u Remetincu.

Međutim, nedugo nakon početka služenja kazne dobio je nekoliko prekida zbog zdravstvenog stanja te je počeo ostvarivati pogodnosti poput izlazaka za vikend. Naime, za ostvarivanje tih pogodnosti ključno je bilo da je Horvatinčić dobio najprije odsluženje kazne u kaznionici poluotvorenog tipa da bi poslije bio premješten u zatvor otvorenog tipa u Valturi, gdje se i danas nalazi.

Poluotvoreni ili otvoreni tip zatvora, u koji se obično šalju počinitelji prometnih nesreća, ostavlja diskrecijsko pravo upravitelju zatvora da odobri izlazak osuđeniku. "Na temelju provedenog postupka, a na prijedlog stručnog tima, odobrena je zakonska mogućnost navedenom zatvoreniku", odgovorili su Jutarnjem listu iz Ministarstva pravosuđa i uprave nakon što smo u lipnju 2022. godine snimili Horvatinčića na izlasku iz jedne privatne zagrebačke klinike.

Horvatinčić zatražio uvjetno puštanje na slobodu, sada mu je stigao odgovor: ‘Još je prerano‘

Nakon malo više od pola odslužene zatvorske kazne zbog izazivanja pomorske nesreće u kojoj je smrtno stradao talijanski bračni par Salpietro, Tomislav Horvatinčić je od Županijskoga suda u Puli zatražio uvjetno puštanje na slobodu, što mu je odbijeno.

Premda je kaznionica u kojoj trenutno služi kaznu od četiri godine i deset mjeseci zatvora navodno dala pozitivno mišljenje o Horvatinčićevu zahtjevu, tročlano vijeće Županijskog suda zaključilo je da je, s obzirom na kazneno djelo koje je počinio, još prerano za puštanje na slobodu.

Horvatinčiću je do kraja odsluženja zatvorske kazne preostalo malo više od dvije godine, a na ovu odluku suda u Puli može se žaliti Visokom kaznenome sudu (VKS).
