Inicijativa Lex Franak dobila je odgovor Europske Komisije na upit Ruže Tomašić, zastupnice RH u Europskom parlamentu u svezi nepoštenih CHF kredita, objavio je portal Hrvatska danas.

Ruža Tomašić zastupnica RH u Europskom parlamentu dana 13.12.2019. uputila je prioritetno pitanje Europskoj Komisiji:

“…Koji je stav Europske komisije, vezano za presudu Suda Europske unije C 118/17 o neosnovanosti provođenja ovrha dok traju sudski postupci, o tome da individualne države članice Unije vodeći računa o poštovanju pravnih stečevina Unije, donose zakone o ništetnosti kredita s valutnom klauzulom u švicarskim francima na svom državnom teritoriju?”

Dana 20.02.2020. u ime Europske komisije odgovorio je potpredsjednik Europske Komisije Valdis Dombrovskis koji odgovor prenosimo:

“…..U predmetu C-118/17, Sud Europske unije napomenuo je da se za nepoštenu ugovornu odredbu mora smatrati, načelno, kao da nikada nije postojala, tako da ne može imati učinak u odnosu na potrošače, koji moraju biti u istoj pravnoj i činjeničnoj situaciji u kojoj bi bili da predmetna odredba nije postojala.

Stoga je Sud Europske unije odlučio da se može smatrati da nacionalni zakoni kojima se izmjenjuju određene odredbe ugovora o kreditu u stranoj valuti koje se odnose na tečajnu razliku poštuju Direktivu 93/13/EEZ o nepoštenim uvjetima u ugovorima, ako se njima omogućuje ponovna uspostava pravne i činjenične situacije u kojoj bi potrošači bili da te nepoštene odredbe nisu postojale, među ostalim, uspostavom prava na povrat koristi koje je financijska institucija neopravdano stekla na temelju tih nepoštenih odredbi.

Sud je zaključio i da se odredbom koja se odnosi na tečajni rizik definira glavni predmet ugovora, tako da se u slučaju da se dokaže nepoštenost te ugovorne odredbe nastavak ugovora koji sadržava takvu odredbu ne čini pravno mogućim, o čemu mora odlučiti nacionalni sud.

Sva nacionalna zakonodavstva moraju poštovati temeljne slobode jedinstvenog tržišta utvrđene u Ugovoru o funkcioniranju Europske unije, uključujući slobodno kretanje kapitala, kao i opća načela prava EU-a.

Prethodna odluka u predmetu C-118/17 odnosila se na ugovore o kreditu sklopljene prije 21. ožujka 2016.

Možemo se samo nadati da će oni koji odlučuju o nepoštenim kreditima vezanim uz CHF valutu, napokon početi primjenjivati praksu EU suda, a koju je u svom odgovoru u ime Europske komisije izrekao i potpredsjednik Europske komisije Valdis Dombrovskis.

Građanska inicijativa Lex Franak će nastaviti zahtijevati da se napokon započne primjenjivati i na hrvatskim sudovima praksa EU suda, piše Lex Franak.

Inicijativa Lex Franak dobila je odgovor Europske Komisije na upit Ruže Tomašić, zastupnice RH u Europskom parlamentu u svezi nepoštenih CHF kredita, objavio je portal Hrvatska danas.

Ruža Tomašić zastupnica RH u Europskom parlamentu dana 13.12.2019. uputila je prioritetno pitanje Europskoj Komisiji:

“…Koji je stav Europske komisije, vezano za presudu Suda Europske unije C 118/17 o neosnovanosti provođenja ovrha dok traju sudski postupci, o tome da individualne države članice Unije vodeći računa o poštovanju pravnih stečevina Unije, donose zakone o ništetnosti kredita s valutnom klauzulom u švicarskim francima na svom državnom teritoriju?”

Dana 20.02.2020. u ime Europske komisije odgovorio je potpredsjednik Europske Komisije Valdis Dombrovskis koji odgovor prenosimo:

“…..U predmetu C-118/17, Sud Europske unije napomenuo je da se za nepoštenu ugovornu odredbu mora smatrati, načelno, kao da nikada nije postojala, tako da ne može imati učinak u odnosu na potrošače, koji moraju biti u istoj pravnoj i činjeničnoj situaciji u kojoj bi bili da predmetna odredba nije postojala.

Stoga je Sud Europske unije odlučio da se može smatrati da nacionalni zakoni kojima se izmjenjuju određene odredbe ugovora o kreditu u stranoj valuti koje se odnose na tečajnu razliku poštuju Direktivu 93/13/EEZ o nepoštenim uvjetima u ugovorima, ako se njima omogućuje ponovna uspostava pravne i činjenične situacije u kojoj bi potrošači bili da te nepoštene odredbe nisu postojale, među ostalim, uspostavom prava na povrat koristi koje je financijska institucija neopravdano stekla na temelju tih nepoštenih odredbi.

Sud je zaključio i da se odredbom koja se odnosi na tečajni rizik definira glavni predmet ugovora, tako da se u slučaju da se dokaže nepoštenost te ugovorne odredbe nastavak ugovora koji sadržava takvu odredbu ne čini pravno mogućim, o čemu mora odlučiti nacionalni sud.

Sva nacionalna zakonodavstva moraju poštovati temeljne slobode jedinstvenog tržišta utvrđene u Ugovoru o funkcioniranju Europske unije, uključujući slobodno kretanje kapitala, kao i opća načela prava EU-a.

Prethodna odluka u predmetu C-118/17 odnosila se na ugovore o kreditu sklopljene prije 21. ožujka 2016.

Možemo se samo nadati da će oni koji odlučuju o nepoštenim kreditima vezanim uz CHF valutu, napokon početi primjenjivati praksu EU suda, a koju je u svom odgovoru u ime Europske komisije izrekao i potpredsjednik Europske komisije Valdis Dombrovskis.

Građanska inicijativa Lex Franak će nastaviti zahtijevati da se napokon započne primjenjivati i na hrvatskim sudovima praksa EU suda, piše Lex Franak.

Inicijativa Lex Franak dobila je odgovor Europske Komisije na upit Ruže Tomašić, zastupnice RH u Europskom parlamentu u svezi nepoštenih CHF kredita, objavio je portal Hrvatska danas.

Ruža Tomašić zastupnica RH u Europskom parlamentu dana 13.12.2019. uputila je prioritetno pitanje Europskoj Komisiji:

“…Koji je stav Europske komisije, vezano za presudu Suda Europske unije C 118/17 o neosnovanosti provođenja ovrha dok traju sudski postupci, o tome da individualne države članice Unije vodeći računa o poštovanju pravnih stečevina Unije, donose zakone o ništetnosti kredita s valutnom klauzulom u švicarskim francima na svom državnom teritoriju?”

Dana 20.02.2020. u ime Europske komisije odgovorio je potpredsjednik Europske Komisije Valdis Dombrovskis koji odgovor prenosimo:

“…..U predmetu C-118/17, Sud Europske unije napomenuo je da se za nepoštenu ugovornu odredbu mora smatrati, načelno, kao da nikada nije postojala, tako da ne može imati učinak u odnosu na potrošače, koji moraju biti u istoj pravnoj i činjeničnoj situaciji u kojoj bi bili da predmetna odredba nije postojala.

Stoga je Sud Europske unije odlučio da se može smatrati da nacionalni zakoni kojima se izmjenjuju određene odredbe ugovora o kreditu u stranoj valuti koje se odnose na tečajnu razliku poštuju Direktivu 93/13/EEZ o nepoštenim uvjetima u ugovorima, ako se njima omogućuje ponovna uspostava pravne i činjenične situacije u kojoj bi potrošači bili da te nepoštene odredbe nisu postojale, među ostalim, uspostavom prava na povrat koristi koje je financijska institucija neopravdano stekla na temelju tih nepoštenih odredbi.

Sud je zaključio i da se odredbom koja se odnosi na tečajni rizik definira glavni predmet ugovora, tako da se u slučaju da se dokaže nepoštenost te ugovorne odredbe nastavak ugovora koji sadržava takvu odredbu ne čini pravno mogućim, o čemu mora odlučiti nacionalni sud.

Sva nacionalna zakonodavstva moraju poštovati temeljne slobode jedinstvenog tržišta utvrđene u Ugovoru o funkcioniranju Europske unije, uključujući slobodno kretanje kapitala, kao i opća načela prava EU-a.

Prethodna odluka u predmetu C-118/17 odnosila se na ugovore o kreditu sklopljene prije 21. ožujka 2016.

Možemo se samo nadati da će oni koji odlučuju o nepoštenim kreditima vezanim uz CHF valutu, napokon početi primjenjivati praksu EU suda, a koju je u svom odgovoru u ime Europske komisije izrekao i potpredsjednik Europske komisije Valdis Dombrovskis.

Građanska inicijativa Lex Franak će nastaviti zahtijevati da se napokon započne primjenjivati i na hrvatskim sudovima praksa EU suda, piše Lex Franak.
