Poštovani,

prijatelj mi je početkom sezone na brodici imao dosta ozbiljnu štetu i premda je kod jedne osiguravajuće kuće bio kasko osiguran, ukupnu štetu nikako ne može naplatiti. Prvo su mu osporavali razlog nastanka oštećenja, a nakon dugotrajnog i mukotrpnog dokazivanja razlog su prihvatili, ali ne i ukupnu visinu štete. Sada mu nude nagodbu koju on ne želi prihvatiti i sve će izgleda završiti na sudu. U društvu je netko spomenuo kako je kod ugovaranja osiguranja trebao angažirati brokera i kako ga to ne bi ništa koštalo. Mene interesira kakva su u praksi iskustva s brokerima u osiguranju, kako bi mu to bilo bolje da se osigurao preko njih i koliko to stvarno ništa ne košta?

Razlozi zbog kojih osiguravatelj ne može ili ne želi isplatiti ukupan iznos štete mogu biti razni, realni i irealni. Dovoljno je da se neka oštećenja ne mogu povezati sa štetnim događajem, što u praksi kod prijava šteta nije rijetko, pa da taj dio štete na taj način nije naplativ.

Primjera radi, ako se plovilo nasukalo i oštetilo u podvodnom dijelu trupa, to nema nikakve veze s kvarom elektroničkih uređaja. Kako bi kod druge prijave štete u istoj sezoni izbjegli dvostruku franšizu, iznos do kojeg osiguravatelj ne snosi štetu, odnosno iznos koji će se kod isplate umanjiti, vlasnici često žele sva oštećenja na plovilu prikazati kroz jedan štetni događaj.

U ovakvim je slučajevima sasvim svejedno jeste li bili osigurani preko agencije, agenta ili brokera, jer šteta koja se ne može povezati sa štetnim događajem nije naplativa.

Nova djelatnost

S druge strane, ponekad se dogodi da osiguravatelj iz nekog vama ne baš jasnog razloga ne želi prihvatiti kompletan iznos štete, već bez ikakvog drugog kvalitetnog rješenja jednostavno nudi nagodbu na znatno manji iznos. U ovakvim situacijama broker vam možda može biti od velike pomoći.

Brokerska djelatnost kod nas je prisutna tek petnaestak godina i o njoj se relativno malo zna, a često se povezuje s agencijama za osiguranje. Agenti ili agencije za osiguranje angažiraju osiguravatelji i bez obzira koliko se trude izići vam u susret oni su ipak zastupnici osiguravajuće kuće.

Brokere ili posrednike u osiguranju, kako su do nedavno bili navedeni u Zakonu o osiguranju, angažira sam klijent, osiguranik, te kao neovisni nisu kontrolirani ni od jednog osiguravajućeg društva, iako profesionalno surađuju sa svima. Dakle, broker je predstavnik klijenta i u spornim situacijama zastupa interese osiguranika, a ne osiguravatelja.

Obavlja sve poslove oko pripreme za zaključivanje ugovora o osiguranju, te pruža pomoć prilikom izvršenja prava iz ugovora i rješavanja odštetnih zahtjeva. U praksi to znači da za klijenta procjenjuje rizike, te prema njima pronalazi optimalnu ponudu osiguranja, jer nisu ponude svih osiguravatelja iste i ne koštaju jednako.

Zastupanje klijenata

Naravno, kao stručnjaci u svom poslu u obzir uzimaju i reputaciju osiguravatelja. Brinu se o rješavanju odštetnih zahtjeva, a ako ipak dođe do spora, klijenta zastupaju i pred sudom.

Činjenica je da i sve više čarter tvrtki kod osiguranja svojih plovila koristi usluge brokera, jer osim što za ove poslove imaju stručnog suradnika, ne gube vrijeme oko administracije i poslova s osiguranjem, a u slučaju štete prijavu šalju brokeru koji dalje komunicira s osiguravateljem.

Premda izgleda paradoksalno, da točno je, usluge brokera klijenta ne koštaju ništa. Člankom 435. Zakona o osiguranju jasno je navedeno kako proviziju brokera plaća osiguravajuće društvo, a ne klijent.

Poštovani,

prijatelj mi je početkom sezone na brodici imao dosta ozbiljnu štetu i premda je kod jedne osiguravajuće kuće bio kasko osiguran, ukupnu štetu nikako ne može naplatiti. Prvo su mu osporavali razlog nastanka oštećenja, a nakon dugotrajnog i mukotrpnog dokazivanja razlog su prihvatili, ali ne i ukupnu visinu štete. Sada mu nude nagodbu koju on ne želi prihvatiti i sve će izgleda završiti na sudu. U društvu je netko spomenuo kako je kod ugovaranja osiguranja trebao angažirati brokera i kako ga to ne bi ništa koštalo. Mene interesira kakva su u praksi iskustva s brokerima u osiguranju, kako bi mu to bilo bolje da se osigurao preko njih i koliko to stvarno ništa ne košta?

Razlozi zbog kojih osiguravatelj ne može ili ne želi isplatiti ukupan iznos štete mogu biti razni, realni i irealni. Dovoljno je da se neka oštećenja ne mogu povezati sa štetnim događajem, što u praksi kod prijava šteta nije rijetko, pa da taj dio štete na taj način nije naplativ.

Primjera radi, ako se plovilo nasukalo i oštetilo u podvodnom dijelu trupa, to nema nikakve veze s kvarom elektroničkih uređaja. Kako bi kod druge prijave štete u istoj sezoni izbjegli dvostruku franšizu, iznos do kojeg osiguravatelj ne snosi štetu, odnosno iznos koji će se kod isplate umanjiti, vlasnici često žele sva oštećenja na plovilu prikazati kroz jedan štetni događaj.

U ovakvim je slučajevima sasvim svejedno jeste li bili osigurani preko agencije, agenta ili brokera, jer šteta koja se ne može povezati sa štetnim događajem nije naplativa.

Nova djelatnost

S druge strane, ponekad se dogodi da osiguravatelj iz nekog vama ne baš jasnog razloga ne želi prihvatiti kompletan iznos štete, već bez ikakvog drugog kvalitetnog rješenja jednostavno nudi nagodbu na znatno manji iznos. U ovakvim situacijama broker vam možda može biti od velike pomoći.

Brokerska djelatnost kod nas je prisutna tek petnaestak godina i o njoj se relativno malo zna, a često se povezuje s agencijama za osiguranje. Agenti ili agencije za osiguranje angažiraju osiguravatelji i bez obzira koliko se trude izići vam u susret oni su ipak zastupnici osiguravajuće kuće.

Brokere ili posrednike u osiguranju, kako su do nedavno bili navedeni u Zakonu o osiguranju, angažira sam klijent, osiguranik, te kao neovisni nisu kontrolirani ni od jednog osiguravajućeg društva, iako profesionalno surađuju sa svima. Dakle, broker je predstavnik klijenta i u spornim situacijama zastupa interese osiguranika, a ne osiguravatelja.

Obavlja sve poslove oko pripreme za zaključivanje ugovora o osiguranju, te pruža pomoć prilikom izvršenja prava iz ugovora i rješavanja odštetnih zahtjeva. U praksi to znači da za klijenta procjenjuje rizike, te prema njima pronalazi optimalnu ponudu osiguranja, jer nisu ponude svih osiguravatelja iste i ne koštaju jednako.

Zastupanje klijenata

Naravno, kao stručnjaci u svom poslu u obzir uzimaju i reputaciju osiguravatelja. Brinu se o rješavanju odštetnih zahtjeva, a ako ipak dođe do spora, klijenta zastupaju i pred sudom.

Činjenica je da i sve više čarter tvrtki kod osiguranja svojih plovila koristi usluge brokera, jer osim što za ove poslove imaju stručnog suradnika, ne gube vrijeme oko administracije i poslova s osiguranjem, a u slučaju štete prijavu šalju brokeru koji dalje komunicira s osiguravateljem.

Premda izgleda paradoksalno, da točno je, usluge brokera klijenta ne koštaju ništa. Člankom 435. Zakona o osiguranju jasno je navedeno kako proviziju brokera plaća osiguravajuće društvo, a ne klijent.
