Lapaine je rekao danas Hini da je Županijski sud tu odluku donio još prošlog mjeseca, a da bi u nastavku postupka Općinski sud trebao odlučiti o visini štete kojom bi ga država trebala obeštetiti.

"Sada svi ostali ovršitelji mogu bez straha tražiti naknadu za svoju prerpljenu štetu", kazao je Lapaine dodavši da bi se država zbog toga mogla suočiti s velikim materijalnim izdacima.

Lapaine je sredinom 2012. podnio prvu tužbu protiv Hrvatske radi utvrđivanja povrede prava na rad i naknade imovinske i neimovinske štete zbog odgode zakona o javnim ovršiteljima, koji je na kraju ukinut.

Nesuđeni javni ovršitelj naknadu materijalne štete potražuje zbog ulaganja u prostor, opremu i školovanje, ali i nematerijalne štete radi povrede prava osobnosti i pretrpljene duševne boli.

Osim dva milijuna kuna naknade štete, Lapaine potražuje i rentu do umirovljena radi izgubljene zarade.

Objasnio je kako je uložio velika sredstva u osiguranje uvjeta za dobivanje dozvole za rad, što uključuje zapošljavanje djelatnika, osiguranje prostora, tehničku opremljenost i fizičku zaštitu, ali zbog odgode primjene, a potom i ukidanja novog zakona nije niti počeo raditi.

Lapaine napominje da je za dobivanje rješenja za rad ovršitelja morao zatražiti i brisanje iz Hrvatske odvjetničke komore, a povratak među odvjetnike još mu nije dozvoljen.

potvrdio je tužbeni zahtjev kojim Marko Lapaine traži od države naknadu štete u iznosu dva milijuna kuna radi ukidanja zakona o javnim ovršiteljima.

Lapaine je rekao danas Hini da je Županijski sud tu odluku donio još prošlog mjeseca, a da bi u nastavku postupka Općinski sud trebao odlučiti o visini štete kojom bi ga država trebala obeštetiti.

"Sada svi ostali ovršitelji mogu bez straha tražiti naknadu za svoju prerpljenu štetu", kazao je Lapaine dodavši da bi se država zbog toga mogla suočiti s velikim materijalnim izdacima.

Lapaine je sredinom 2012. podnio prvu tužbu protiv Hrvatske radi utvrđivanja povrede prava na rad i naknade imovinske i neimovinske štete zbog odgode zakona o javnim ovršiteljima, koji je na kraju ukinut.

Nesuđeni javni ovršitelj naknadu materijalne štete potražuje zbog ulaganja u prostor, opremu i školovanje, ali i nematerijalne štete radi povrede prava osobnosti i pretrpljene duševne boli.

Osim dva milijuna kuna naknade štete, Lapaine potražuje i rentu do umirovljena radi izgubljene zarade.

Objasnio je kako je uložio velika sredstva u osiguranje uvjeta za dobivanje dozvole za rad, što uključuje zapošljavanje djelatnika, osiguranje prostora, tehničku opremljenost i fizičku zaštitu, ali zbog odgode primjene, a potom i ukidanja novog zakona nije niti počeo raditi.

Lapaine napominje da je za dobivanje rješenja za rad ovršitelja morao zatražiti i brisanje iz Hrvatske odvjetničke komore, a povratak među odvjetnike još mu nije dozvoljen.

Varaždinski Županijski sud potvrdio je tužbeni zahtjev kojim Marko Lapaine traži od države naknadu štete u iznosu dva milijuna kuna radi ukidanja zakona o javnim ovršiteljima.
